RECOMMENDATIONS
ADOPT Resolution 2003/178 to create a Municipal Advisory Council for the Pleasant Hilt
BART Station vicinity; and
DISSOLVE effective this date the Pleasant Hill BART Station Area Steering Committee,
and in doing so acknowledge the valuable services rendered by its members on behalf of
the County.
FISCAL IMPACT
None at this time.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Pleasant Hill'BART Station Municipal Advisory Council (MAG) would be established
as an advisory body to the County on discretionary land use matters, local government
services, and such other matters as the Board of Supervisors may direct.
The Pleasant Hill BART Steering Committee, which focused solely on the area within the
boundaries of the Pleasant Hill BART Specific Plan, is no longer needed as the area is
virtually built out and the preliminary development plan for the BART property has been
fully approved. The proposed MAC would be a smaller, more focused group than the
Steering Committee with membership specific to the Pleasant Hill BART Station vicinity.

SUBJECT: In the matter of the establishment } Resolution No. 2003/178
of the Pleasant Hill BART }
Municipal Advisory Council }
It is hereby RESOLVED by the Board that:
1. Establishment of the Pleasant Hill BART Municipal Advisory Council
Pursuant to the authority granted by Section 31 010 of the California Government Code,
the Pleasant Hill BART Municipal Advisory Council, (PHB-MAC), is hereby established.
The PNB-MAC will have duties and powers as enumerated in Paragraph 5 below.
2. Membership
The Council shall consist of seven (7) members who shall either reside, work, or own
property in the Pleasant Hill BART community (as described below) and whom the
County Beard of Supervisors shall appoint.
3. Pleasant Hill BART Community.
The Pleasant Hill BART Area community is that territory contained within the
unincorporated community of Walnut Creels at the Pleasant Hill BART Station Area
located generally between the cities of Concord, Pleasant Hill, and Walnut Creek, as
more particularly described on the attached map, marked as Exhibit A.
4. Term of Office.
Upon creation of the Council, the Board of Supervisors shall, by lot, select three persons
who will serve two (2) year terms and four persons who will serve four(4) year terms. All
subsequent terms shall be for four(4) years.
5. Council Duties and Powers.
The Council shall advise the Board of Supervisors on local government services for the
community, as requested by the Board; and provide input and reports to the Board,
county staff or any county hearing body on issues of concern to the community, and
shall advise the Board of Supervisors on land-use planning matters affecting the
Pleasant Hill BAIT community, such as land-use designations, General Plan
amendments, environmental-impact reports, negative declarations, rezonings, land use
permits, preliminary and final development plans, variances, etc. The Council shall also
represent the community before the County Planning Commission, the Zoning
Administrator, and the County Board of Supervisors on such land use, planning, and
zoning matters.
The Council may not represent the community before other public entities and agencies.
It is understood that the Board of Supervisors is the final decision-making authority with
respect to issues concerning the Pleasant Hill BART community and that the Council
shall serve solely in an advisory capacity.

6. Compensation.
Council members shall serve without compensation of any kind and the Board shall not
provide funds for the payment of Council meeting stipends or reimbursement of Council
members' expenses.
7. Staff and Financial Support.
a. The Board shall provide no ongoing professional or clerical staff support to the
Council or funds to pay for any of the Council's operating costs.
b. County staff will provide the Council in a timely manner with information and reports
on planning matters (referenced in paragraph 5 above)that are to be located in, or
will have an effect on, the Pleasant Hill BART community; County staff will also
provide notices of decisions on all such matters to the Council.
c. County staff will provide Pleasant Hill BART community planning entitlement
applicants with the time and place of Council meetings and the names and any non-
restricted phone numbers of Council members so that timely discussion of pending
applications may be conducted between them, (the Council and applicants), before
County Planning Agency hearings and decisions.
8. Council Operatio .
Within the parameters of this Resolution, the Council may organize itself and operate as
it determines but shall hold regular meetings monthly or such other frequency it deems
necessary at an established time and place. Any such meeting may be adjourned to the
next regular meeting date if there is no business to be transacted at that time. The
Council's open public meetings shall be conducted in accordance with the provisions of
the "Brawn Act" (Government Coda sections 54950 ff.), including the pre-meeting
posting'of meeting calendar notices, and the Better Government Ordinance (County
Ordinance Code Division 25, commencing with Section 25-2. 202). In addition, the
Council shall comply fully with the Board of Supervisors' policy concerning conflict of
interest and open meetings (Resolution No. 2002!876) and the Political Reform Act
(Government Code sections 81000 ff.) as applicable.
9. Advisory Council Funds.
Any funds transferred to or received by the County for the PHBMAC shall be accepted
pursuant to Resolution No. 901334 and only used for the benefit of PH'BMAC and its
area.
10. Council dissolution-2011.
The provisions of this Resolution shall be of no further force and effect after July 1,
2011, and the Council dissolved on that date, unless prior to that date, the Board of
Supervisors has taken action to extend the Council's existence.
