Poppleton SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS After hearing the appeal, it is recommended to deny the appeal and affirm the determinations of the County Abatement Officer and direct the County Abatement Officer to proceed and perform the work of abatement. FISCAL IMPACT $10,500.00 if the county does the abatement. BACKGROUND/REASONS FOR RECOMMENDATIONS On May 7, 2001, a complaint was received regarding a contractor's yard, storage of heavy equipment and inoperable vehicles on the premises. On May 15, 2001, a site inspection was conducted and the inspection revealed there were numerous pieces of commercial equipment, commercial vehicles, land sea cargo containers, and scrap building materials on the property. After postings for abatement on September 13, 2001, and January 2, 2002, it was agreed, on January 15,2002, that Mr. Poppleton would comply by building a barn to store the equipment and materials. The permit for the barn was issued on June 13, 2002. A site inspection on January 7, 2003, revealed that the barn had not started to be erected and that there were no signs of the materials for the barn on site. The property was posted again on January 31, 2003,and the materials for the barn were still not on site. There were violations on the property including land-sea cargo containers, scrap lumber, and commercial type equipment and machinery. The property owner is in violation of the following County ordinances: Title 8, Chapter 82-2.005 (Land use violation enforcement) Title 8, Chapter 88-4.205 (Junkyard conditions) Title 8, Chapter 84-38.002 (Land use violation uses permitted on A-2 zoning) The owner of the property has been notified of the violations through written correspondence and certified mail. As of this date, compliance has not been gained. On January 31, 2003, the Building Inspection Department declared the property a public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6. This appeal is being made under the provisions of this title. The notice issued is essentially identical to that issued previously on January 2, 2002. Since that time we have worked continuously to bring the use of our property into compliance with County regulations. A meeting was held to discuss this matter between Catherine Kutsuris, Michael Silva and our representative, Eric Hasseltine,on January 15, 2002. A memorandum of the agreement reached at this meeting was sent to the parties involved on February 6, 2002 in which an inventory of all materials on site was presented in three parts: material to be removed, material that is permissible to remain as is and material permissible to remain if stored in a barn. In this memorandum,we also agreed to file an application for a building permit for the barn, Subsequently,the necessary approvals from County agencies to accompany the permit application were obtained and a set of structural plans for the barn was obtained from a manufacturer, Steelmaster Buildings. The plans were submitted for checking on April 9, 2002 and the building permit was issued on June 13, 2002. In the meantime, all of the material listed for removal in the February 6 memo was in fact removed from the property. The current citation for storage of an office trailer is groundless. There was one small office trailer on site in early 2002 that was used for equipment and records storage by the local Boy Scout troop. This trailer was invisible from any public road or neighboring property,but it has been removed as required. We take exception to the allegation of junkyard conditions. We have had a number of home improvement projects on this property that have entailed at times the temporary storage of materials such as concrete,mortar,bricks, stone, lumber and metal. These can now be found in our patio, walkways, fences, animal pens etc. There is no dismantling, wrecking,salvage materials or scrap metal. There is no long term storage of material. .....................................................................................................................-.................................................................. There is frequent temporary storage of materials as noted, some of which is metal, definitely not scrap, from our business operation in Martinez that is used for decorative and structural purposes on the property. The solution to which the County has agreed is to keep such material in the barn, now under construction. We, like many others on large lots throughout the County, find the use of cargo containers for material, equipment and agricultural supplies very convenient as they are weather and vermin proof and secure. We are now aware that the A-2 zone does not allow these containers. Accordingly, the materials we are currently storing in our two containers, as per our agreement, will be stored instead in the barn. The only valid basis for this Abatement Notice is the presence of containers, which is then redundantly also the basis of the land use violation allegation. Once the barn is built,there will be no violations. Despite having an agreement as to what would be done on the site, and despite the fact that the Building Inspection Department is well aware of what has been done and is being done, this Abatement Notice has been issued. The only reason for this at this time is the contention that the work is not being performed as rapidly as some think it could be or should be. We have been given some arbitrary deadlines,which could not be met. We have made reasonable progress working on this matter continuously for over a year and are close to completion of all agreed tasks. However, in order to build the barn, several other things had to be done first. New fencing was needed to keep our animals out of the construction area,a retaining wall was needed to protect the barn and a new drainage system needed to capture runoff from the hill behind us, also to protect the barn. In addition, we had a well failure last summer, which needed immediate attention. Late last year, we had the area for the barn graded and the stab floor poured. The weather in January prevented getting the barn started. The material for the barn is now all on site and construction is beginning this week. We respectfully submit that this notice is untimely and unnecessary since we are in the midst of the actions agreed to in the resolution of this problem. Therefore, we request that any action by the County to abate this property be cancelled and that we be given a reasonable, not arbitrary, amount of time to complete our work. This is our home and we want the job done properly. We are capable of doing this work and we are doing it ourselves. Thank you for your consideration.
