The First Amendment to the Leaseback with the Central Contra Costa Sanitary District has
been negotiated to extend the term of the Leaseback from.November'4, 2002 to November
4, 2003 and to specify that the County clear certain equipment and improvements from the
Premise upon the County surrender of the Premises.

COUNTY RESPONSIBILITY: Removal of kennels, corral,barn, trailers, cold box and
clearing the Premises of all debris upon County's surrender of the Premises. If requested
by District, County shall also remove the existing chain link fence and paved area.

RECOMM.ND,ATION
1. APPROVE the First Amendment to the Leaseback with the Central Contra Costa Sanitary District
(Sanitary District) for the Premises at 4849 Imhoff Place, Martinez (Martinez Animal Shelter) to
extend the term and monthly' rental of the Leaseback and clarify the duties of the parties upon
surrender of the Premises under the terms and conditions more particularly set forth in the First
Amendment to the Leaseback.
2. AUTHORIZE the Director of General Services to execute the Amendment on behalf of the,
County.
FINANCIAL IMPACT
The First Amendment extends the term of the Leaseback and monthly rental amount of$5,800.00 per
month from November 4, 2002 to November'4, 2003. The original term of the Leaseback would have
ended on November 4, 2002 and the monthly rental amount for holding over beyond that date would
increase to $23,200.00 for the first three months and $29,000.00 per month thereafter.
BACKGROUND
On 'November 2, 1999, the Board of Supervisors approved the sale of the Martinez Animal Services
facility and associated vacant property to and leaseback from the Sanitary District. At that time it was
anticipated that the Animal Services Replacement Facility would be completed by November 4, 2002,
the 'end of the Leaseback term. On February 2, _2002, the Board approved' the plans and
specifications and authorized the advertisement for bids for the Replacement Project. It is anticipated
that construction of the Replacement facility will take approximately fourteen months.:Under the terms
of the November 2, 1999 Leaseback, the :monthly rent would have increased to $23,200.00 per
month for the first three months, then to $29,000.00 per month thereafter. The Sanitary District and
County have reached an agreement whereby the leaseback term would be extended to November 4,
2003 and the monthly rental remain at $5,800.00 in exchange for the County, at its sole cost and
expense, to clear certain equipment and improvements from the Premises upon surrender of the
Premises.

HONORING THE CENTRAL CONTRA COSTA SANITARY DISTRICT FOR ITS COl TINUED
SUPPORT AND COOPERATION IN ASSISTING THE COUNTY IN REPLACING TH MARTINEZ
AND PINOLE ANIMAL SHELTERS
WHEREAS, the Board of Supervisors approved the sale of the existing Martinez Animal Shelter and
associated property to the Central Contra Costa Sanitary District for a sum of$2,930,000,as well as the
lease back of this property from the District,on November 2,1999;
WHEREAS, the District's willingness to purchase the existing animal shelter site and lease back the
property to the County has been an integral part of the successful planning for the new Martinez Animal
Shelter
WHEREAS, the original leaseback arrangement was structured in a fashion that anticipated that the
replacement Martinez Animal Shelter would be completed by November 2002;
WHEREAS,the County has experienced delay in the construction of the Martinez Animal Shelter while a
solution was crafted that would allow for the replacement of both the Martinez and West County Animal
Shelters;
WHEREAS,the District has graciously agreed to a one year extension of the original terms of the lease
arrangementswith the County,which will save the County in excess of$250,00(7 in rental costs;
NOW, THEREFORE, RE IT RESOLVED that the Board of Supervisors of Contra Costa
County does hereby recognize and honor the Central Contra Costa Sanitary District for its
continued support and cooperation in assisting the County' in the replacement of the
County's animal shelters in Martinez and Pinole. .
