SUBJECT: Establishment of a County Service Area-Pleasant Hill BART Station Area
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
ADOPT Resolution of Application initiating the formation "process for a County Service Area for
transportation demand management services in the 'Pleasant Hill BART 'Station Area; AUTHORIZE
submittal of said resolution to the Local Agency Formation Commission(LAFCO)for authority to establish
the County Service Area; DETERMINE that the activity,'forming a County Service Area fortransportation
demand management services,is exempt from the California Environmental Quality Act(CEQA)pursuant to
Section 16061(b)(3)of the CEQA Guidelines; DIRECT the Director of Community Development to file a
Notice of Exemption with the County Clerk;and DIRECT the Deputy Director–Redevelopment to arrange
for payment of the$25.00 handling fee to the County Clerk for fling the Notice of Exemption.
FISCAL IMPACT
No general funds are involved in the establishment of the County Service Area. The cost of the proceeding
is being covered by the Redevelopment Agency. Annual assessments to the commercial property would
result-from the establishment'of the County Service Area.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Pleasant Hill BART Station Area is a transit village in which residents and workers have a variety of
travel mode options. A core element of the travel mode options for employees,and a key traffic mitigation
measure in the CEQA documents certified at the time of adoption and amendment of the Pleasant Hill
BART Specific Plan,are transportation demand management(TDM)programs. TDM includes carpooling,
vanpooling,rideshar ng;flex time,staggered work hours,guaranteed ride home,telecommuting,walking,
biking,etc. The commercial property owners in the area collectively have a mandate to achieve at least 30
% TDM performance, i.e. 30% or more of the area employees arrive at work via something other than a
single'occupied car.

BACKGROUNDIREASONS FOR RECOMMENDATIONS
The Contra Costa Centre is the collective mechanism by which the developer/property owner
obligation for TOM Programs is undertaken. The Contra Costa Centre Association is a private non-
profit corporation who's membership is the commercial property owners in the area. The Center
Association,has been in existence since the mid 1980s.
Contra Costa Centre's TOM Program has been in operation since its formation. The program was
initially funded through an assessment district proceeding,those funds are now depleted, and an
on-going source of revenue to fund the TOM Program is needed. After consulting with County
Counsel regarding available options it was determined that the establishment of a County Service
Area was the most appropriate mechanism to accomplish this source'of on going revenue.A map of
the proposed County Service Area boundaries is included. ,
Can November 8,2001 the Contra Costa Centre Association Board of Directors voted unanimously
to request the County Board of Supervisors to initiate the process to form the County Service Area
for the ongoing funding of the Contra Costa Centre's Transportation demand Management
Program. A copy of a November 29, 2001 letter stating this is attached as background.
The process for establishing a County Service Area requires this recommended action to initiate the
formation of the service area and to initiate LAFCO proceedings. The Board would subsequently
act upon a resolution of formation(tentatively scheduled for April 23,;2002)and a final hearing and
vote of the affected property owners(tentatively scheduled for June 11,2002). LAFCO's tentative
schedule would provide for the LAFCO action to occur on May 8,2002.

DESCRIPTION OF THE ACTIVITY: The County Services District would be established to
finance the ongoing Transportation Demand Management(TDM)program in the area. The
TDM program,` which is managed by the Contra Costa Centre Association, provides
commute alternative services to the employees at the Centre. The program is is funded by
assessments from the commercial property owners. The program has been in place since
1988. The program services of the program are provided to encourage the use of
commute alternatives to the business park and reduce demand for parking and traffic
congestion:
LOCATION: The activity involves the establishment of a County Service Assessment
District in the commercial areas of the Pleasant Hill BART Station Area, in Central Contra
Costa County.
This activity is;not subject to the California Environmental Quality Act(CEQA)pursuant to
Article 5,Section 15081 (b) (3)of the CEQA Guidelines. It can be seen with certainty that
there is no passibility that the activity may have a significant adverse effect on the
environment.

Dear Chair Uilkema and Members of the Contra Costa Board of Supervisors;
On November 8,2001,the Contra Costa Centre Association Board of Directors voted'
unanimously to request the County Board of Supervisors to initiate the process to form a County
Service Area for the ongoing funding of the ContraCosta Centre Association's Transportation
Demand Management(TDM)Program.
As background,the original TDM obligation was a condition of development approval for
Pleasant Hill BART commercial projects,and it was designed to mitigate parking and traffic
impacts of the transit oriented development program at the Pleasant Hill BART Station. The
TIM program has served as.a valuable tool for employers'and their tenants. The program has
achieved signifieant.success as a model of transit based development;approximately 32 percent
of the employees take alternative modes of transportation to work. The initial funding of the
TDM program through a 1983 assessment proceeding has nearly'been exhausted,and a new
source of ongoing funding needs to be established." After numerous discussions with Jim
Kennedy and advice of your County Counsel,it was agreed that forming a County Service Area
is the most appropriate means to generate funds for the TDM program.
Please consider this letter a request to initiate a County Service Area for the ongoing funding of
the Contra Costa Centre Association's Transportation Demand Management(TDM)Program.

A RESOLUTION OF APPLICATION BY THE
CONTRA COSTA COUNTY BOARD OF SUPERVISORS REQUESTING THE
CONTRA COSTA LOCAL AGENCY FORMATION COMMISSION (LAFCO)TO INITIATE PROCEEDINGS
FOR A JURISDICTIONAL CHANGE
RESOLVED, by the Board of Supervisors that is wishes to initiate proceedings pursuant to the
Cortese-Knox-Hertzberg ,Local' Government Reorganization Act of 2000 for a change of reorganization (i.e.,
annexation, 'dissolution, detachment, etc.); and
WHEREAS, a notice of intent to adopt this resolution of application has been given, and this Board has
conducted a'public hearing based upon this notification; and
WHEREAS, the reason for the proposed change of organization or reorganization is the formation of a
County Service Area and
WHEREAS, the following agency or agencies would be affected by the proposed jurisdictional change:

WHEREAS, the territory proposed to be changed is uninhabited, and a map of the boundaries of
territory are attached hereto as Exhibit A and by this reference incorporated herein; and
WHEREAS, it is desired that the proposal be subject to the following terms and conditions: (None); and
WHEREAS, this proposal is not consistent with the adopted spheres of inf#uence for the affected
480es; and
WHEREAS, this Board certifies that as lead agency pursuant to the California Environmental Quality
Act it has determined that this activity is not subject to the California Environmental Quality Act (CEQA)
pursuant to Article 5, Section 15061 (b)(3) of the CEQA Guidelines. It can be seen with certainty that there is
no possibility that the activity may have a significant adverse effect on the environment'.
WHEREAS, this Board has determined that this proposal'`meets the criteria for a waiver of protest
hearings as set forth in Government Code Section 56663;
NOW, THEREFORE, this Resolution of Application is hereby adopted and approved by the Board and
the Contra?Costa Local Agency Formation Commission is hereby requested to take proceedings for the
change of reorganization as authorized and in the manner provided by the Cortese-Knox-Hertzberg
Reorganization Act of 2000.
