APPROVE a Sixth amendment authorizing extra work under the Consulting Services Agreement' dated May 25, 1999, with Interactive Resources, Inc. for architectural design services for- Remodeling and Office Landscape Partitions at Various Sites for the Employment and Human Services Department. The Sixth Amendment increases the scope of services and increases the Payment Limit from $733,795.00 to $936,655.00, an increase of$202,860,00. 2. AUTHORIZE the Director of General Services; to execute the Sixth Amendment to the Consulting Services Agreement, and to issue written authorizations for extra work, in addition to the authorizations in the previous amendments, provided that the cumulative total extra cost for such additional authorizations shall not exceed $25,000.00. FINANCIAL IMPACT Funds for this project are 80% State/Federal and 20% General Fund Budgeted in the Employment and Human Services Department budget. At 4545 delta Fair Blvd., Antioch, OLP scope increased from 170 to 226 workstations. Provided additional architectural services to _accommodate increased number of workstations, minor mechanical modifications and reviewed existing electrical site conditions. 2. At 151 Linus Pauling', Hercules, OLP scope increased from 100 to 195 workstations, Provided revised architectural drawings to accommodate new fluor layout. Changes included demolition of existing walls, modifications to existing mechanical and electrical systems, new doors and modifications to floors and ceilings.. This amendment did not include redoing hardware in doors not directly affected by revised design. 3. At 201 East 18th Street, Antioch, provided additional architectural, mechanical, electrical and furniture layout revisions, including new hardware throughout building. The Second Amendment increased the scope of services at 151 'Linus'Pauling, Hercules to revise layout of workstations to place the Social Service and Child Welfare Divisions on opposite sides of the second floor. The Third' amendment increased the scope of services at 4545 Delta Fair Blvd., Antioch to provide' design modifications, minor changes` to the construction drawings and major changes to bill of materials required for splitting Phase 2' into two phases (2a and 2b) and changed the electrical from a 6-wire system to a68-wire system. The Fourth Amendment increased the scope of services at 151 Linus Pauling, Hercules to include a new preliminary design to accommodate new project requirements and a structural analysis of the existing second:floor framing system. The Fifth' Amendment increased the scope of services at 30 and 40 Muir Road, Martinez to: accommodate additional staff, increased space planning services, provide structural, civil, data/voice' work, and additional mechanical engineering services required to modernize the mechanical and electrical infrastructure. The Sixth;Amendment increases the scope of services as follows: 1. At 30 and 40 Muir Road, Martinez prepare three-phased construction drawings; and specifications, structural survey, analysis, drawings, calculations and specifications to strengthen the 2nd Floor of both buildings to accommodate additional floor loads, additional voice/data work required for new workstations, an aerial survey'of the entire site, and civil engineering services required to provide accessibility ramps from the main parking,area to the main doors of both buildings. 2. At 151 Linus' Pauling, Hercules provide updated survey of .existing OLP components, data/voice work that was not a part of the original 'proposal, and one set of two-phased construction documents, bidding and construction administration for the 2nd Floor remodel. 3. In Appendix B, Paragraph F, increase the Reimbursable Payment Limit from $600.00 to $4,900.00, an increase of$4,300.00. Purpose: On May 25, 1999,the parties entered into a contract entitled"Consulting Services Agreement," referred to as the "Agreement," which covers architectural design services for Remodeling and Office Landscape Partitions at Various Sites for the Employment and Human Services Department. The Agreement has previously been amended as follows: First Amendment dated March 7,2000,Second Amendment dated May 4, 2000,Third Amendment dated September 25,2000,Fourth Amendment elated October 16,2001, and Fifth Amendment dated November 6,2001. The parties desire to further amend the Agreement to expand the scope of service and to increase the payment limit accordingly. 3. Amendments to Agreement: A. In the Agreement,Section I (e),change the Payment Limit from$733,795.00 to$936,655.00,an increase of$202,860.00. This change shall apply to charges',from and atter December 13,2001. B. In accordance with Section 14 of the Agreement,provide the following services: I. FINANCIAL. IMPACT: No impact on General Fund. Legal services will be provided on a contingency basis. BACKGROUND The City of San Francisco and other plaintiffs, including Lt. Gov. Cruz Bustamante, have filed lawsuits against several power companies, alleging that the companies engaged in unfair business practices and committed antitrustviolations. The plaintiffs generally seek restitution to ratepayers of the revenues and profits obtained by these companies as a result of these practices and civil penalties, as well as injunctive relief to stop the defendants from engaging in these activities. The County has decided to join as a plaintiff in the San Francisco lawsuit, along with Santa Clara County and the City of Oakland. The firm of Milberg Weiss Bershad Hynes & Lerach LLP„ is prosecuting the San Francisco lawsuit. In order to join as a plaintiff and coordinate with other plaintiffs, and to minimize legal expenses on behalf of the County, it is recommended that the County retain Milberg Weiss Bershad Hynes & Lerach, LLP, to represent the County in this lawsuit. FINANCIAL IMPACT: The testing and inspection contract will not result in a financial impact to the County. These services are budgeted for each project. BACKGROUND: On June 1, 2001 the County Administrators Office entered into an agreement with Consolidated Engineering Laboratories for building code mandated testing and inspection of the Juvenile Hall Expansion and Family Law construction projects. The County selected Consolidated Engineering after conducting an open solicitation for testing and inspection'services. Consolidated provided the lowest priced proposal coupled with the highest technical qualifications. The scope of the contract includes continuous inspection of concrete block installation,concrete testing, rebar and steel inspections, and other tests and inspections mandated by the building code or the County's Building Inspection Department. The contract includes an estimated quantity of hours (provided by the Construction Manager)and a competitively bid unit price for each category of work. The purpose of this amendment is to increase the estimated quantity of hours to reflect the workload demands of each project. Each project budget contains a line item and contingency for testing and inspection services. This amendment falls within those budget allowances.
