FISCAL IMPACT
None. The applicant has paid application fees to process this project and is obligated to pay
supplemental fees for staff time and material costs which exceed 100% of the initial fee
payment;
BACKGROUND AND ANALYSIS
The Board of Supervisors reviewed this application and took testimony in support and in
opposition to the proposal on December 11, 2001. The Board;approved the project for 3 single
family residences and 8 clustered "duet' units.
Based on the staff recommendation, the motion of the Beard included approval of the rezoning
portion of the application. However,the Board inadvertently did not set a date for adoption of the
ordinance, and the required rezoning exhibit'was not included with the Board Order.
To resolve this matter,the Board is now being asked to introduce the ordinance and set the date
of April 16, 2002 for its adoption.

The Board established the In-Home Supportive Services {IHSS} Public Authority;Advisory
Committee in (March 1998. In April 1999, the Burd of Supervisors accepted and approved .:
the IHSS Public Authority Implementation Team Findings and Recommendations, including
recommendations regarding Advisory Committee membership criteria. In Mercy 2001, the
Board approved amendments to the membership criteria.

As amended, the Advisory Committee consists of 11 members: 4 Consumers aged 60 or
older, 2 Consumers aged 'under 60, and one member from each Supervisorial District.
Under Board policy, the IOC would typicallyreview only general membership or "At-Large
seats, and would not review appointments to supervisorial district seats. However, when
this advisory committee was originally established, the Board of Supervisors directed that
the IDC review and coordinate supervisorial district appointments to ensure that none of the
following categories have more ,than ;one representative: senior advocate, advocate for
younger disabled, representative from the developmental disability 'community, IHSS
individual provider, IHSS family provider, social worker, nurse, community-based
organization, and home health agency. Therefore, nominations to all Advisory Committee
seats, including supervisorial districts:.seats, are reviewed and coordinated by the Internal
Operations Committee.
The''IOC considered the nominations to reappoint David Johnson and David Thayer at its
March 18,'2002`meeting, and recommends reappointment.

RECOMMENDATION
Approve reappointments to the IHSS Public Authority Advisory Committee as recommended by
the Advisory Committee. The Advisory'Committee recommends that David Johnson and David
Thayer be appointed to second terms on the Advisory Committee.
BACKGROUND
Mr. Johnson was appointed on 9/25/01 to fill a vacated seat. His seat is designated for an IHSS
consumer under 60 years of age. His current term ended on 3/6/02.
Mr. Thayer was appointed on 8/14/01 to fill a`vacated seat. His seat is designated for an IHSS
consumer 60 years of age or older. His current term ended on 3/6/02.
Considering the service given by these members, their willingness to continue and: the
contributions they have made and will continue' to make, the Advisory Committee is
recommending that these members be appointed to second terms.

RECOMMENDATIONS:
1. ACCEPT AND PROCEED with the process for selection of the IHSS Public
Authority Executive Director developed by the Employment and Human Services
Department in conjunction with the Human Resources Department.
2. RE-ACKNOWLEDGE the responsibility of the IHSS Public Authority Executive
Director and his/her staff to initiate the process for establishment of the Public
Authority Advisory Committee and for recruitment and selection of Advisory
Committee members by the Board of Supervisors in its role as the governing body of
the.Authority.
BACKGROUND INFORMATION:
On May 4, 1999, the Board of Supervisors, in its role as the governing body of the IHSS
Authority, authorized "recruitment, hiring, and location processes for the Public
Authority staff who will in turn operationalize the Public Authority based upon the
Implementation Team Report" adopted by the Board of Supervisors in that same Board
Order.
The County Human Resources Department has engaged a consultant to recruit candidates
for Public Authority Executive Director. The closing date for this recruitment was
extended through July 30, 1999. The consultant is in the process of reviewing the

qualifications for IHSS Public Authority Executive Director to the Human Resources
Department.
Employment and Human Services staff have made arrangements to convene an interview
panel consisting of the Aging and Adult Services Director and three community members
who served on the IHSS Public Authority Implementation Team to conduct an oral
interview of the qualified applicants. The three community representatives includea
younger disabled consumer, an elderly consumer, and a community-based organization
representative. This panel will interview and refer the names of the most qualified
candidates to the Employment and Human Services Director for a final appointment.
In accordance with the Board Order adopted on May 4, 1999, it will be the responsibility
of the newly hired Public Authority Executive Director and his/her subordinate staff to
initiate the process for the Board of Supervisors, in its role as governing body of the
Authority, to establish the Public Authority Advisory Committee and to provide for
recruitment and selection of Advisory Committee members as set forthin the detailed
stipulations of Recommendation. 7.4 of the Findings and Recommendations of the
Implementation Team(Attachment).

Public Authority Regulations require that the Boardof Supervisors. acting as the
Public Authority: 1) appoint an advisory committee of no more than`eleven (11)'
members; and 2) no fewer than 50' percent of the advisory committee members shall
be 'persons who are current or past users of personal assistance services paid for
through public or private funds.
Using the regulatory requirements and County Ordinance as a starting point, the
Implementation Team addressed the membership of;,the Advisory Committee.- The
group addressed the issues of: the total number of Committee members: number and
characteristics of consumer representatives, including current or past users, services
paid for by public funds or private pay and the appointment of consumer members
based on age, disability and/or other criteria, thenumber and representative categories
for "other' members; and the desire that membership represent the ethnic, racial,
geographic, age and other diversities of the County's IHSS consumer and provider
populations.
After careful consideration, the majority of Team members agree that the following
recommendation will give broad, fair and representative consumer and stakeholder
membership on the Advisory Committee.

The majority of Implementation Team members recommend the following regarding
Advisory Committee membership:
1. Membership shall include six(6)consumers:
a) Consumer members shall be ,individualswho are current or past users of
personal assistance services paid for through public or private funds;
b)' At least 50 percent of consumer members shall be current users of IHSS;
c) Consumer members will represent two age categories, i.e., consumers over 65
years of age and consumers under 65 years of age,
d) The number of members appointed from each age category will be
representative of the IHSS caseload. In the current IHSS caseload 66.66
percent of consumers are over 65 years of age and 33.3)3 percent are under 65
years of age;
e) This will result in four (4) consumer members being appointed who are over
65 years of age; and two (2) consumer members being appointed who are
under 65 years of age; and
f) Consumer members shall be residents of Contra Costa County.
Minorite minion on consumer members: There was a significant minority of
Team members that felt appointing three (3) consumer members over 65
years of age; and three (3) consumer members under 65 years of age would
give fairer consumer representation than that reflected in the majority
recommendation.
2. Membership shall include five (5)other positions:
a) The five positions shall be appointed from each of the five supervisorial
districts;
b) Individuals appointed shall live or work in Contra Costa County: and
c)' Supervisors will attempt to select the members from the list of recommended
categories
d)' The selection process shall be coordinated to achieve the following no
category shall have more than one representative and one of the appointments
shall be an IHSS individual provider or IHSS family provider.

* List of recommended Advisory Committee member categories
The Implementation Team believes individuals representing the following
categories will bring significant and relevant expertise to the Advisory
Committee'
■ senior advocate
• advocate for younger disabled
■ representativefrom the developmental disability community
■ IHSS individual provider
■ IHSS family provider
• social worker
• nurse
• community-based organization representative
■ home health agency representative
3. The Implementation Team recommends that efforts be made to recruit and select
Advisory Committee members representing the ethnic, racial, geographic, age and
other'diversities of the County's IHSS consumer and provider populations.
• It is suggested':that the application for Advisory Committee membership include a
statement regarding the Board's desire that Advisory Committee membership
reflect the ethnic. racial, geographic, age and other diversities of the County`s
IHSS consumer and provider populations, and that the application include a
section where the applicant may voluntarily state his/her ethnicity.
4.' To further address the issue of -Advisory Committee membership. the Team,
recommends that the Public Authority reviews Advisory Committee membership
annually to determine if the membership 'meets the needs of the key stakeholder
groups. and make appropriate membership adjustments. if necessary.
