THE BOARD OF DIRECTORS OF THE CANYON LAKES GEOLOGIC HAZARD ABATEMENT
DISTRICT RESOLVES THAT:
Public Resources Code Section 25500' provides that the Board of Directors may negotiate
improvement contracts or may award such contracts by competitive bidding pursuant to procedures established
by the Board. In order to facilitate the ability of the Canyon Lakes Geologic Hazard Abatement District
(GHAD) to undertake repair, maintenance and improvements as necessary, the Board of Directors of the
Canyon Lakes GHAD on June 24 1986, by Resolution No. 86/406, established Procedures for Awarding
Contracts for Canyon Lakes CHAD Repair, Maintenance and Improvement Projects and for Professional and
Support Services.
Board Resolution No. 98/381, approved by the Board of Directors of the Canyon Lakes GRAD
on July 14, 1998, amended Resolution No. 85/406 and modified' the General Manager's contract approval
thresholds to levels consistent with those in effect for the Contra Costa County Public Works Department.
Board of Supervisors..Resolution 86/408, approved July 15, 1986, authorized a Joint Exercise of
Powers Agreement (JEPA)between the District and the County and, among other things, designated the Public
Works Department to serve as a liaison between the GHAD staff (General Manager) and the Board of
Supervisors(sitting as the GHAD Board of Directors).
Resolution No. 86/406 (as amended by Resolution No. 98/381) is silent with respect to contracts
for CHAD-General Manager services. In this regard, the GRAD General Manager and the Contra Costa Public
Works Director, .:as provided'"under the JEPA between the District and the County, are recommending that
Resolution 86/406 be amended to clarify the role of the Public Works Department with respect to the recruiting,
retention and evaluation of the General Manager, as follows:

NOW, THEREFORE, THE BOARD OF DIRECTORS HEREBY RESOLVES, FINDS, CERTIFIES
AND ORDERS AS FOLLOWS:
1. A new Section II.0 is hereby added to Resolution 86/406, Procedures for Awarding Contracts for
Canyon Lakes GHAD;Repair, Maintenance and Improvement Projects and for Professional and Support
Services, as follows.
C. Contracts for GHAD General Manager Services.
The Board may appoint an individual or firm to'serve as the General Manager of the District. The
Board may establish a job description for the position of General Manager. The Board may request
the assistance of the Contra Costa County Public'Works Director with the development of said job
description and in matters related to the recruiting, retention and evaluation of the General Manager
as well as with the terms and;.conditions of the employment or professional services contract with
the General Manager as provided in the Joint Exercise of Powers Agreement (JEPA) between the
County and the District elated July 15, 1986`(Resolution 86/408) and any amendments thereto. With
the exception projects defined as "Emergencies" under Section II.D.2 of these procedures, said
contract shall prohibit the General Manager or his firm from providing civil and/or geotechnical
engineering design services on a GHAD improvement project with an estimated repair cost in
excess of$10,000.
2. Except for the paragraph added by this Resolution, all provisions of Resolution 86/406 (as amended by
Resolution 98/381)and Resolution'86/408 shall remain in full force and effect.
