SUBJECT: Second and Third Amendments to Agreement to Provide Right of Way Services to the Contra
Costa Transportation Authority
Project No. 4660-6X4287 Task No. ACQ Account No. 3540
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action: APPROVE second and third amendments to Agreement#124 to provide right
of way services to the Contra Costa Transportation Authority (CCTA) for proposed State Route 4
Widening Projects, and AUTHORIZE the Board Chair to sign the agreements on behalf of the County.
II. Financial Impact: There is no financial impact.
III. Background and Reasons for Recommendations: Contra Costa Transportation Authority requires a
variety of right of way services but has no right of way staff and has contracted with the County for these
services. On April 4, 2000, the Board approved the original agreement . The above-referenced
amendments change the scope of services, allowing the County to acquire other"protection" parcels in
the corridor between Somersville Road and SR 160 and increases the base work compensation by
$675,000 for an overall total Agreement Value of $1,225.000. All other terms and conditions of the
original agreement remain in effect.
IV. Consequences of Negative Action: Less efficient government because the Contra Costa
Transportation Authority would have to hire additional private contractors at a greater expense.

RIGHT OF WAY SERVICES

WHEREAS,the Contra Costa Transportation Authority and Contra Costa County Real Property Division
("CONSULTANT") entered into Agreement No. 124 on January 1, 2000; and
WHEREAS,the parties entered into the first amendment to the agreement on May 17, 2000 to increase the total
compensation; and
WHEREAS,the parties now wish to amend the Agreement to modify the geographic limits of the corridor; now
therefore be it
MUTUALLY AGREED:
(1) that Article 2 of the Agreement is amended by adding a third sentence: "The CCTA may also choose to
use the County's services to acquire other"protection"parcels in the corridor between Somersville Road
and SR 160; and
(2) that all other items and conditions of the Agreement shall remain in effect.
In witness whereof, the parties hereto have executed this Second Amendment to the Agreement as of the day and
year above written.

WHEREAS,the parties now wish to amend the Agreement to increase the total compensation; now therefore be it

(1) that Article 4 of the Agreement is amended to increase the base work compensation by $675,000 for an
overall total Agreement Value of S 1,225,000; and
(2) that all other items and conditions of the Agreement shall remain in effect.
