SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. RESCIND the Rules and Procedures pertaining to parking for car/van pools
at the County-owned parking lot at the corner of Pine and Escobar Streets
in downtown Martinez.
2. ADOPT attached resolution which revises the Rules and Procedures regarding
car/van pool parking at the County-owned parking lot at the corner of Pine and
Escobar Streets in downtown Martinez which will supercede any previous regulations.
FINANCIAL IMPACT:
This action will have no financial impact.
BACKGROUND:
The DRAFT Downtown Martinez Parking Plan was adopted by the Board of
Supervisors in October of 2000. Since that time the County, City and CCCTA have
worked together to implement the Martinez Free Shuttle which has redirected juror
parking to remote parking lots. In addition, the recent reconstruction of the parking
lot behind 651 Pine has added 43 spaces to downtown parking supply.

The attached resolution revises the Rules and Procedures for the carpool parking
lot that were originally adopted in 1999. Currently employees must apply annually
to the Department of Community Development for a permit which allows them to
park in the carpool lot. In addition to this requirement, the revised Rules and
Procedures will require that two people exit any car utilizing the carpool lot. This
requirement assures that the carpool lot addresses parking demand in downtown
Martinez and simplifies enforcement of the carpool permit system. In further
collaboration with the City of Martinez, the City Police Department has agreed to
enforce these additional regulations.

RESOLUTION NO. 3969
SUBJECT: Adoption of revised Rules and Procedures for administration of the carpool lot at the
County-owned parking lot at the northeast corner of Pine and Escobar Streets in
Martinez.
WHEREAS on May 4, 1999 the Board of Supervisors adopted Traffic Resolution No. 3895 designating
marked spaces in the County-owned parking lot at Pine and Escobar as reserved for carpools,and
WHEREAS on that same date the Board of Supervisors adopted Rules and Procedures for the
administration of the carpool lot
IT IS BY THIS BOARD APPROVED that the previously adopted Rules and Procedures are rescinded and
the attached Rules and Procedures are henceforth adopted in their place:
The County Administrator of designee is authorized and directed to:
1. Post and maintain in conspicuous places in said parking lot appropriate signs giving notice of parking
restrictions and any other special conditions or regulations adopted pursuant to this resolution applicable
to the Reserved Area;
2. Act as agent and representative of the County and taking whatever action is necessary and appropriate
for the administration of this resolution.
3. Pursuant to Vehicle Code section 21113, file with the Clerk of the Board and at the County
Administrator's Office a copy of this resolution and any special conditions and regulations adopted
pursuant hereto for examination by all interested persons.

- RULES AND PROCEDURES
Traffic Resolution 3969
Adopted July 17,2001
1. For the purpose of these Rules and Procedures,"car/van pool"means a group of two or more
persons who regularly commute to work in the same vehicle. A minimum of two people must be
present in the vehicle when parking in the designated permit-only parking area.
2. A permit to park in the designated car and vanpool commute lot shall be issued by the Director of
Community Development Department(DCD)or his designee.Employees who wish to participate
in the car and vanpool program must register with the Community Development Department
(CDD)and a permit shall be assigned. Each permit will be assigned a unique number identifying
the member's car/van pool number and the vehicle(s) license plate information. A master list of all
Employee's assigned permits will be maintained by the Community Development Department
staff and provided to the County Administrators Office.
3. When a vehicle is parked in a designated permit only parking area,the permit must be displayed
on the rear view mirror holder. The permit must be visible when parked and no two vehicles may
be parked in the permit only area with the same permit number.
4. A vehicle may be parked in designated permit-only parking lot areas only if at least two members
of the car/vanpool have actually shared a ride during the commute trip,as described in Rule 1.
The vehicle must display the permit,as described in Rule 4. If any member of the car/van pool is
absent from work for any reason(vacation, illness,etc.),the other members may use the permit-
only parking lot area only if there are at least two.members using the vehicle,as described in Rule
1
5. Issuance of a parking permit by the DCD or his designee does not guarantee a parking space in the
permit-only parking lot area
6. Changes of participants in the car/van pool from the original member's listed on the application
shall be reported immediately in writing to the DCD or his designee.
7. Violation of these rules and Procedures after one warning shall be just cause for the DCD or his
designee to revoke the permit. The holder of the permit shall immediately surrender the permit to
the DCD or his designee upon receipt of a"Notice of Revocation". The violator(s)shall not be
eligible for issuance of a new permit for a period of at least six months.
8. Rules 4 and 5 shall be enforced between the commute hours of 6:30a.m. to 11:00a.m.,Monday
through Friday. Any empty spaces in a designated permit-only parking lot will not be available
for general use until after 4:00p.m. and on Saturday and Sunday.
9. The provisions of Rule 7 shall not limit other remedies to the County. In particular, violators of
Rule 3 or 4 shall be subject to citation and removal of their vehicles in accordance with law.
10. All car pool lot permit(s)shall expire on July 1 of each year.The primary permit holder is
responsible for renewing their permits before the expiration date and for requesting new permits
from the DCD or his designee when permits become illegible,damaged,or lost. As of July 1,
2001 all permits issued to car/van pool participants are null and void. CDD staff will issue new
permits with a rear view mirror holder on/or before July lof each year.
