(WH408B) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): ADOPT the attached Resolution authorizing the County Administrator or his Designee to execute a construction contract with Taber Construction of Martinez, California, the lowest responsive and responsible bidder, for construction of the new Family Law Center in Martinez. FINANCIAL IMPACT: Local bond funds have been set aside for the construction costs of this project. Debt service will be covered through use of annual revenues from the Courthouse Construction Fund and other revenues achieved pursuant to the County's Memorandum of Understanding with the Superior Court. BACKGROUND: On February 13, 2001 the Board of Supervisors approved the plans and specifications for the new Family Law Center and authorized the County Administrator to request competitive bids for construction of the project. O'Brien Kreitzberg, acting as agent for Contra Costa County, issued a Notice to Contractors on February 14, 2001. Bids were due March 22, 2001. The deadline for submitting bids was extended two times to accommodate the addition of a project labor agreement. Five contractors submitted bids on May 17, 2001 with the lowest price bid coming from Taber Construction; a woman owned small business headquartered in Martinez. The County's Affirmative Action Officer evaluated Taber's good faith effort to comply with the County Outreach Program and Mandatory Subcontracting Minimum documentation and found them acceptable on June 5, 2001. On June 11, 2001 the County Administrators Office notified Taber Construction of its apparent low bidder status and authorized Taber to commence negotiations with the Contra Costa Building and Construction Trades Council for a Project Labor Agreement (PLA). These negotiations were successfully concluded within the specified time frames and the County Counsel Office approved the PLA as to form. ATTESTED July 10, 2001 JOHN SWEETEN,CLERK OF THE BOARD OF SUPERVISORS BY ,DEPUTY Contact: George Roemer, CAO (5-1055) cc: See Attached Resolution DAMark's Dccuments\Board Order for testing.doc BACKGROUND CONTINUED: Taber's base bid of$10,280,000 exceeded the Architect's estimate of $8,500,000 by approximately 20%. An extensive review and analysis of the bids indicates that market factors unrelated to the cost of local labor and higher than expected costs for construction materials led to the increased bids. These market factors have affected recent bids for important public buildings in the County such as the Martinez Health Center and Laboratory, the County Juvenile Hall, a parking garage for the city of Concord, and the Walnut Creek City Hall Expansion. The following table summarizes the bid results for these projects. Project GC Plan Bidders Estimate Low Base Bid Variance Holders Martinez Health Center 6 3 $14,371,890 $16,128,000 12.22% Juvenile Hall 10 8 $24,543,416 $26,784,000 9.12% Concord Parking Garage 10 1 5 $5,670,000 $7,550,046 33.16% Walnut Creek City Hall Approximate $10,000,000 $13,600,000 36.00% Contra Costa Laboratory 10 5 $5,800,000 $6,369,300 9.82% Family Law Center 15 5 $8,500,000 $10,280,000 20.94% In addition to these market factors, the professional cost consultant may have undervalued the unique elements of courthouse construction. Construction costs for durable architectural finishes such as stainless steel, concrete, and stone all exceeded the estimated unit prices. The new Law Center will provide desperately needed space for family court operations. Current facilities do not provide adequate space for attorneys, litigants, facilitators, and security. Family Court Services, an essential element of the family court program, is currently housed in leased space on Escobar Street thereby impeding efficiency and increasing court operating costs. If authorized by the Board of Supervisors the County Construction Administrator will award the contract and issue a Notice to Proceed by August 15, 2001. Construction completion is targeted for February 2003.
