RECOMMENDATION
ACCEPT supervisorial redistricting Scenario 4e and DIRECT staff to prepare an
ordinance in accordance with Scenario 4e to establish a supervisorial redistricting plan
for introduction on July 17, 2001.
FISCAL IMPACT
No additional impact beyond those specified on April 24, 2001 Board Order concerning
redistricting of the County supervisorial boundaries.

BACKGROUND/REASONS FOR RECOMMENDATIONS
On July 3, 2001 the Board of Supervisors directed Community Development staff to modify
supervisorial redistricting Scenario 4d as follows:
(1) Move Bethel Island, Knightsen and the unincorporated part of census tract 3010
into District 5;
(2) Move the unincorporated part of census tract 3551.06 into District 4;
(3) Move Tara Hills CDP into District 2;
(4) Move census tract 3390 into District 3; and
(5) Place the unincorporated area of Saranap into District 2.
The population totals by District for the modified scenario are:
District 1 185,339
District 2 184,473
District 3 192,765
District 4 186,789
District 5 199,450
The difference between the districts with the lowest and the highest population totals is
14,977 which is an 8.1 percent difference.
Exhibit 1 is a map showing the boundaries of the cities and census designated places
(CDP) in each district and Exhibit 2 is a map overlaying the county's census tracts with the
proposed supervisorial boundaries in Scenario 4e. Exhibit 3 shows the population of each
city and CDP in each district and also the population in each census tract in each district.
ADDENDUM TO ITEM DA
July 10, 2001
On this day, the Board considered accepting the supervisorial redistricting Scenario 4e and direct
staff to prepare an ordinance in accordance with Scenario 4e to establish a supervisorial
redistricting plan for introduction on July 17, 2001.
Linda Moulton, Community Development Department presented staff report and
recommendations. Also present were Mr. Silvano Marchesi, County Counsel.
Following discussion of the Board, the Chair invited the public to speak. The following persons

Following further discussion, the Board took the following actions:
ACCEPTED supervisorial redistricting scenario 4e, as modified by dividing census tract 3551.06
(population 614) in the vicinity of south Antioch area:
■ Census blocks 2043 through 2045 and 2047 through 2051 remain with District 4 as
outlined in the scenario presented;
■ The remainder of the unincorporated area are placed in District 5.
(The area to remain in District 4 population - 112; area moved to District 5 population— 502)

Dear Supervisor Uilkema,
The Sierra Club San Francisco Bay Chapter opposes the proposed Contra Costa County
redistricting plan to split Walnut Creek into three parts. The plan creates a district so
geographically spread out, and with such difficult transportation barriers, that it will be nearly
impossible for a supervisor properly to serve the district's constituents.
On its surface, this redistricting plan is obvious "gerrymandering," and the plan has created valid
questions concerning political payback.
This district has for nearly ten years consistently sent the strongest environmental voice to the
Board of Supervisors, and the district itself has been the strongest constituency for slower
growth. The implications that this is an attempt to weaken this district's environmental voice are
not lost on Contra Costa residents,.or attentive observers around the Bay Area.
The Sierra Club urges the Board to reconsider, and to put good government principles ahead of
political payback or personal animosities.

Dear Supervisor Uilkema,
The Sierra Club San Francisco Bay Chapter opposes the proposed Contra Costa County
redistricting plan to split Walnut Creek into three parts. The plan creates a district so
geographically spread out, and with such difficult transportation barriers,that it will be nearly
impossible for a supervisor properly to serve the district's constituents.
On its surface, this redistricting plan is obvious "gerrymandering," and the plan has created valid
questions concerning political payback.
This district has for nearly ten years consistently sent the strongest environmental voice to the
Board of Supervisors, and the district itself has been the strongest constituency for slower
growth. The implications that this is an attempt to weaken this district's environmental voice are
not lost on Contra Costa residents, or attentive observers around the Bay Area.
The Sierra Club urges the Board to reconsider, and to put good government principles ahead of
political payback or personal animosities.

On July 9, 2001, the Lafayette City Council unanimously voted to affirm the Board's
May 1, 2001 position that all Contra Costa County cities be kept intact through the
redistricting process. The Board's present redistricting plan is inconsistent with this
policy.Therefore, on behalf of the City of Lafayette, I request that the actions of the
Board in this matter be reconsidered so as to be consistent with the previous resolution
and that all cities remain intact within the revised boundaries.

You have asked me to discuss the potential Brown Act problems that could be created
if three members of the Board of Supervisors represented various parts of the City of Walnut
Creek.Your concern was brought about because three members of the Board constitute a
m4lority of the Board of Supervisors.
As you correctly noted,the Brown Act states"any use of direct communication,
personal intermediaries,or technological devices that is employed by a majority of the
members of a legislative body to develop a collective concurrence as to action to be taken on
an item by the members of the legislative body is prohibited."
The Brown Act states that individbal contact or conversations between a member of a
legislative body and any other person are not a violation of the law. However,a serial
meeting can result'where the one or two members of the legislative body initially
communicate but then eventually involve a majority. Clearly if one supervisor represented
the City,no communication with a constituent or another Board member could create a
Brown Act problem. Even if two supervisors represented the City of Walnut Creek,no
Brown Act violation would occur when a constituent spoke to one or both supervisors,or
even if the two supervisors communicated with each other on a matter affecting the City or its
residents. gpen&Public 17I.the Brown Act publications sponsored by the California
Newspapers Publishers Association,among others,squarely states the concern. "A member
has the right,if not the duty,to meet with constituents to address their grievances. That
member also has the right to confer with a colleague about local agency business. But if in
that process a'collective concurrence as to action to be taken'is reached among a majority,
the Brown Act has been violated."
In the situation where three supervisors represented Walnut Creek,they could not
collaborate except in a formal meeting on their position on matters that might come before the
Board that would affect the City. Similarly,were two of the supervisors to discuss a matter
before the Board of interest to the City,each of them would be required to then refrain from
involving the third member in the issue where a serial meeting might occur.
A person with an interest in any matter before the Board of Supervisors always has the
option of contacting one or more supervisors. And a person can quite properly contact three,
four or even all five supervisors on any matter before the Board. It is only when
communication with or between a majority of the Board is used to formulate a collective
concurrence that the law is violated.
If one believes that a supervisor has special responsibilities to a city when the
supervisor represents all or part of its residents,then the Brown Act can impose constraints on
the conduct of elected officials and others when a majority of the Board is involved that do
not Exist if the City is represented by less than a majority. To cite the most obvious example,
only logistics prevents anyone from privately meeting with one or two superosors on an
issue. Three supervisors are almost never going to wast to discuss County business outside of
a fnnnal meeting unless a clear exception to the formal meeting requirement exists.
Should Walnut Creek be represented by. than two supervisors,the Brown Act
and its serial meetmg prohibition will ceauudy have to be kept high in a nh of their minds as
they meet with and represent their Walnut Cre&constituents.

1 axn writing to request reconsideration of two areas proposed to be moved out of District
5. Census Tract 3551.06 has been proposed to be divided in a manner that would place
Roddy Ranch in District 4. Census Tract 3032 has been divided in a mariner that would
place the Ginochio property that is outside the city's incorporated area in District 3. (The
balance of the contiguous Ginochio property is inside the city limits.) The City of
Antioch and the representatives of both parcels have expended considerable time and
money for over a year in preparing planning and environmental reports for the long-term
use of this land.
The development of these areas has an,immediate;and dramatic impact upon the City of
Antioch. Considerable time will be spent working with the Supervisor of District 5 to
find a plan that can be supported by all parties. We will probably have some differences
oi'opinion regarding how tho.areas should develop. But the differences rest with one
Supervisor and one City Council. Adding two more Supervisors to the process
unnecessarily complicates matters.
The land areas under consideration do not contain significant populations. They do
not fall into another distriict by virtue of demographic, geographic or topographic
features. They do not share any unusual community of purpose,history or design
with District 4 and District 3 to any greater extent than they currently do in District
5. In short,they work well within District S as currently configured and do not
detract in any way from the goal of the redistricting process of more evenly
spreading the current population of the County.
On behalf of the City of Antioch,I respectfully request the Board of Supervisors revise
the proposed Redistricting Map to leave the entire Roddy Ranch area in CensusTract
3551.06 and the entire Ginodhio property in Census Tract 3032 within District 5. l thank
