SUBJECT: PUBLIC HEARING REGARDING SUPERVISORIAL REDISTRICTING
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
(1) Open public hearing;
(2) Receive public testimony;
(3) Determine whether to direct Community Development Department staff to
perform the following activities:
(a) Prepare alterations to any of the proposed scenarios, and/or
(b) Prepare additional scenarios based on Board's recommendations;and
(4) Continue the hearing to June 19th, 2001 at a designated time.
FISCAL IMPACT
No additional impact beyond those specified on April 24, 2001 board order
concerning redistricting of the County supervisorial boundaries.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On May 1, 2001 the Board Of Supervisors directed Community Development
Department staff to create two additional supervisorial redistricting scenarios and
to modify three of the original scenarios.
The resulting scenarios were numbered: 1, 1A, 2, 3,4,4A, 5,6, 6A, 7,and 8. At
the May 22, 2001 Board meeting, staff was directed to modify 4A to create 4B.
These eleven scenarios are available for viewing on the internet (at
www.coco plans.org)and at all of the County's public libraries, The scenarios were
presented at the nine public meetings held throughout the County. At the meetings
held from May 91h through May 215` scenario 4A was shown in the power point
display. At the four meetings held after May 22"d, scenario 4B was included
instead of scenario 4A.

BACKGROUND/REASONS FOR RECOMMENDATIONS -Continued
At the nine meetings held in May,the attendance was greater in the districts which may
experience the most change. There was minimal attendance at the meetings held in
supervisorial districts 1 and 2 and more attendance in the remaining districts.Attached
as attachment 1 is a synopsis of the comments at each meeting. In general the concerns
expressed by residents were as follows:
1. Residents of the City of Walnut Creek expressed concerns that the city might be
divided among two or three districts and expressed preference for the city
remaining as a whole in District 3.
2. Other residents and elected officials of District 3 felt that by dividing Walnut Creek
into more than one district that the community of interest between Walnut Creek
and the San Ramon Valley would be divided.
3. Residents of Saranap asked that consideration be given to keeping the area of
Saranap in one district(either District 2 or 3).
4. Residents of Pleasant Hill were concerned that their city might not be included in
District 4.
5. At the meeting in Pittsburg, several comments reflected the concerns that Bay
Point might be divided between two districts or not included within District 5.
Other speakers voiced concerns that Pittsburg remain entirely in District 5 while
other speakers felt that the scenarios in which Brentwood is redistricted to either
District 3 or 4 would break up the community of interest between the cities in East
County and would divide the voting power of Hispanics living in the area.
6. At the Antioch meeting, residents of District 5 again expressed concerns about
dividing the four cities (Pittsburg,Antioch, Oakley and Brentwood).
7. The last meeting in Brentwood is scheduled for May 315'after the writing of this
board order. Staff will give an oral report during the hearing on the results of that
meeting.
The meetings in San Pablo (District 1), Walnut Creek (District 3), Concord (District 4),
and Brentwood (District 5)will be shown on CCTV at the following times:
District 1, Monday, June 11, 9:00pm
District 1, Wednesday, June 13, 3:00pm
District 3, Wednesday, June 13, 9:30pm
District 3, Friday, June 15, 10:00am
District 4, Monday, June 18, 9:00pm

District 5,Thursday , June 21, 1:00pm

To Board Order dated June 5, 2001 Concerning Supervisorial Redistricting
DISTRICT 1
May 16, 2001 at the Maple Hall in the City of San Pablo
Two Members of the public from EI Sobrante were present. No Comments
DISTRICT 2
May 17, 2001 at the Pinole City Council Chambers
No members of the public were in attendance.
May 23, 2001 at the Lafayette Community Center
Two Members of the public were in attendance. No Comments.
May 29, 2001 at the Board of Supervisors Chambers in Martinez
No members of the public were in attendance.
DISTRICT 3
May 9, 2001 at the Walnut Creek City Council Chambers.
Twenty-three members of the public were in attendance and eleven spoke on the
redistricting issue. Ken Peifer from Rossmoor opposes any scenario in which the
Rossmoor area (census tract 3511) is redistricted to another district or in which the city
is split into more than one district. A letter from Mr. Peifer is attached.
Walnut Creek's Mayor Kathy Hicks favors scenarios 1 A or 6A which keeps all cities and
communities intact (within one district). She feels that Walnut Creek should remain
wholly in District 3 and encourages the Board of Supervisors to keep to the principal of
not dividing cities and places.
Nancy Tatarka, the Vice-Mayor of San Ramon, enumerated the many ways that the San
Ramon Valley and Walnut Creek shared a community of interest: transportation issues;
college and library districts; issue related to the 1680 corridor; and other shared issues
and problems. She favors either scenario 1 A or 6A.
John Rusek of the Saranap Homeowners Association requested that the Saranap area
be in one district, either District 2 or 3, but not split.
Millie Greenberg favors keeping District 3 together so that the subregion's integrity stays
intact.
Speakers who expressed concern with the redistricting problems that are being faced in
east county were Gene Wolfe and Gwen Regalia, who also discussed the importance of
Walnut Creek remaining within a single district.
Frank Quesada, Mayor of Pittsburg, felt the cities should remain in District 5. Lou
Rosas, from Latinos United for Political Empowerment and Mary Rosas, from the
Latinos Leadership Council, also felt Brentwood and the other cities should remain in
District 5. Alieda Rios also supported leaving Brentwood in District 5 and moving Bay
Point to District 4.
Alan Valentino, Jimmy Dorsey and Willy Mims also provided comments.
May 24, 2001 at the Antioch City Council Chambers
Seven members of the public were in attendance. Don Freitas, Mayor of Antioch,
suggested that perhaps there could be a scenario where Brentwood, Antioch, Oakley
and most of Pittsburg remains in District 5 while Discovery Bay, Byron and the Byron
area would be in District 3. Jim Conley also felt it was important for the four cities to
remain together since they share a community of interest. He favors a modification of
scenario 8.
A copy of a letter to Supervisor Uilkema from the Donald P. Freitas, the Major of
Antioch, and a resolution regarding redistricting from the Antioch City Council is
attached.
May 31, 2001 at the Brentwood Community Center
At the time of the writing of this board order, the meeting in the City of Brentwood had
not been held. Staff will give an oral report during the hearing about this meeting.

redistricting issue.

Those desiring to speak having been heard,the Board continued their discussions.
Supervisor Gioia moved to eliminate Scenario#7. He commented that if it were kept intact,the
population would make District 5 excessively large. Supervisor Glover seconded the motion.
The vote was as follows:

Discussions continued.Supervisor DeSaulnier suggested that a scenario be developed where the
three Supervisors which do not have portions of far East County,each be given a part of East
County to equalize districts.
Supervisor Gerber requested that in Scenarios 1 A and 6A,the Saranap area be kept intact,and
included in either District 2 or District 3. Additionally,she suggested eliminating Scenarios 1
and 6.
The Chair then suggested that the Board act on the various proposals individually.She stated
there was a motion to remove Scenarios 1 and 6.Supervisor Glover seconded the motion.

Dennis Barry inquired if the motion was to eliminate Scenarios 1 and 6,to modify IA and 6A,
and keep Saranap area in one Supervisorial District? Supervisor Gerber agreed that was her
motion.Supervisor Glover also agreed.
The vote on that motion was as follows:
AYES: SUPERVISORS GIOIA,GERBER,DeSAULNIER,GLOVER and UILKEMA

Supervisor Uilkema advised the Board that in future recommendations,she would include a
request to increase staff since the workloads would increase.
Following further discussion,Supervisor Uilkema suggested that staff"finagle"boundaries in
Scenario 4B to proportionately balance the districts in terms of population,and review the
implications.
Mr.Barry informed the Board that staff could try to gain closer equality,however,it probably
could not be done and still maintain whole cities.He stated it was his understanding that staff
had a request from Supervisor DeSaulnier for an additional alternative,a request for research,
and a request to"finagle"alternative 4B,he inquired if staff could have a motion on those
requests and a vote for direction.
The Board continued their discussions.They determined that Supervisor DeSaulnier would
restate his previous suggestion. Supervisor DeSaulnier recommended that an additional scenario
be presented that included Districts 5,4 and 3 all reach into far East County.For example,
District 4 going to Brentwood,and District 3 having Discovery Bay and Byron.
Mr.Barry inquired if that included a request for additional research on similar counties that have
Supervisorial cities split.
Supervisor DeSaulnier stated that it did.
Supervisor Glover seconded the motion.The vote was as follows:

NOES: SUPERVISOR GERBER

Supervisor Uilkema moved that staff examine Scenario 413,to see if more equal numbers could
be achieved among the districts. Supervisor Gerber stated she would not support the motion
because she did not believe it made sense on the criteria and it was impractical.The Board
continued their discussions. Supervisor Gioia seconded the motion,and noted that it was not an
indication that this would be the version he would support,but it was a courtesy to Supervisor
Uilkema who wanted to adjust population boundaries on one of her proposals.
Chair Uilkema called for the vote and it was as follows:

Redistricting Issues:
My name is Vicki Nuetzel - I am a resident in Walnut Creek and maintain a law
practice in the City of Walnut Creek
I have asked to speak because 1 am concerned about the proposed redistricting
plans for Contra cost County and more specifically concerned about those plans that
involve districts that split cities or established communities.
In considering redistricting proposals, this board is directed to consider among
other things the community of interest. In electing our board of supervisors we—as
voters— look to elect a representative that will serve the interests of our local community
in its relationship to the county as a whole. As Contra Costa County continues to grow
and develop, each individual city and its surrounding area will develop new or different
coricerns and represents a distinct community. Each city has a unique perspective and
has its own unique problems—the individuals residing in those cities want a
representative that knows and understands that unique community and can respond to its
needs. It is for that reason that I am opposed to any redistricting proposal that divides
any city—not just Walnut Creek—
As I.understand it 5 of the proposed redistricting plans involve the division of
Walnut Creek=and several involve splits or other cities as-well
To divide the cities—in effect giving— for example —Walnut Creek two or three
representatives - would result in confusion among the citizens of the city and dilute the
city's ability to respond to county issues -- it also creates duplicate responsibilities for
the supervisors themselves and creates potential conflicts within the board—the needs of
the city should be addressed by one voice and it cannot if there are as many as three
board members that represent some portion of the city—moreover—the supervisor that
represents for example both a portion of Walnut Creek and a portion of another city may
be placed in a position where he or she cannot adequately represent either—the
supervisor is elected and obligated to represent that the need of those that have elected
him —the proposed redistricting combines areas that do not have a community of interest
and therefore the supervisor cannot truly represent that group— someone is left without a
voice. —
Seen from another perspective-arguably a board that has three members each of
which provide some representation of Walnut Creek gives that community undue weight
or influence— if I am a resident of another city or community with interests adverse to
those interests of the city of Walnut Creek I'd question the ability of the board to consider
my needs adequately when three board members are in part elected by the City of Walnut
Creek—
Either there is dilution or undue influence—but what there is not is direct and
appropriate representation by a member of the board of supervisors of a unique and
distinctive community.

Dear Supervisor Uilkema:
I have attached a resolution adopted by the City of Antioch at the City Council meeting
of May 8, 2001, urging the Board of Supervisors not to split the cities east of Bay Point
into separate districts.
Currently, the five supervisorial district boundaries comprising Contra Costa County are
being reconfigured to establish a more balanced representation of the total population of
the county. State lav requires each district have as close to equal distribution of the
population as possible. The recent U.S. Census report indicates the growth in population
in the East Contra Costa County area has placed a disproportionate number of residents in
District 5.
Among the options being considered is one that would remove the City of Brentwood and
possibly other areas in the easternmost part of the county from District 5. Doing so
would adversely impact the coordinated efforts among the cities of Fast County and our
Board Supervisors to address the transportation. land use and economic development
needs of our area. Considerable time and expense has gone into this work over the past
four years. Having the entire area represented by the same Supervisor has been helpful in
creating a regional effort that is referred to as the Delta 5. A commonality of purpose,
resources, land use potential.. transportation needs and political will to move forward as a
sub-region of %Contra -Costa C-ounty are, arid will continue to be, Essential to the resident
of all our cities and the surrounding unincorporated communities.
After consideration, I urge you not to split the cities east of Bay Point into separate
districts.

WHEREAS, the Ashford Court condominium complex, which coni is of 147 units, is located in an
unincorporated area of Contra Costa County that is within the Sphere,>f Influence('301!1)of the City
of Walnut Creek;
WHEREAS, the Ashford Court Homeowners Association is responsil:le for protecting and promoting
the common interests of all Ashford Court homeowners;
WHEREAS, Contra Costa County is now in the process of redrawing Supervisorial District lines;
WHEREAS,the California Elections Code specifies that the Board of Supervisors,when establishing the
boundaries of supervisorial districts, may give consideration to: (a) to (b) geography; (e)
cohesiveness, contiguity, integrity, and compactness of territory;and(d)community of interest;
WHEREAS, several maps have been prepared by County staff to illustrate alterative redistricting
scenarios; and near the center of every one of those maps there is :t small white area labeled PH
BART ;

The League of Women Voters of Diablo Valley congratulates the Board on opening the
redistricting process to the public through the recent series of local meetings,.as well as
your meeting today, and for making the relevant materials available to the public on the
County's Website.
In our 1988 study of redistricting, Leagues around the state concluded that specific time
lines and public hearings were essential to a good redistricting process—we would
certainly add Web access if we were doing the study now!
The League study is also the basis for our support of standards for redistricting, which
include:
1. substantially equal population
2. geographic contiguity
3. protection from diluting the voting strength of a racial or linguistic minority
Many of the options the Board is considering meet these qualifications, but not all.
The League standards oppose:
1. the goal of protecting incumbents, and
2. preferential treatment of one political party(which is not an issue in
supervisorial districts)
The League position supports standards that, to the extent possible, also include:
1. respect for boundaries of cities and counties;
2. preservation and protection of"communities of interest"
It is sometimes difficult to separate protection of incumbents from protection of
"communities of interest,"when such communities provide a political base for an
incumbent. Although it may not be a primary goal, all of the County's proposed plans do
protect incumbents. This makes it difficult to determine whether a plan,which shifted a
district away from an incumbent, might better meet the League's other criteria, including
respect for city boundaries. The Board and the public might still choose.one of the
current proposals over such an alternative, but at least they would have had the choice.

The League does not have a preferred redistricting scenario, although we would urge you
to discard Scenario 7 because of the greater population in District 5, a problem which is
likely to increase over the next ten years. Your process has made it clear that your
criteria are similar to the League's, with the exception of the issue of incumbent
protection, and no proposal satisfies all those criteria.
We are also satisfied that, whatever your decision, it will have been made with adequate
information and significant public input, which are characteristics of good government.
Once again, the League congratulates the Board on opening the redistricting process to
the public.

On May 31, 2001, the Contra Costa Centre Association sent a letter regarding the
upcoming supervisoral redistricting. We thought it would be helpful to list the Contra

Dear Chairperson Uilkema and Members of the County Board of Supervisors:
On behalf of the Contra Costa Center Association Board of Directors, we strongly urge
the Board of Supervisors to approve a redistricting scenario which respects the
longstanding ties of the Pleasant Hill BART Station Area(the"Centre Area") to the City
of Walnut Creek. Specifically, we believe there are important past and present policy
justifications making it critical that the Board adopt a redistricting approach that
substantially tracks with Scenario 1, 1A, 6 or 6A as it relates to the Centre. In each of
these scenarios, the supervisorial representative for the City of Walnut Creek would also
represent the County's successful "smart growth" redevelopment of the Centre Area.
We applaud the Board for its May 1 Statement of Principle that all cities in the County
should be kept intact to the fullest extent possible. Instead of politicizing the redistricting
process, this Board action was a common sense recognition that representative County
government should reflect cohesive neighborhoods and communities of interest. The
California Legislature, in its passage of the California Elections Code supported this
"good government approach"to setting boundaries of supervisorial districts.
As you know, until 1995 the Centre Area was split between Supervisorial District 3,
which includes the City of Walnut Creek and Supervisoral District 4, which includes the
City of Pleasant Hill. This split could be justified for so long as the LAFCO sphere of
interest(SOI) boundaries were split between these 2 cities. However, LAFCO
determined in 1995 that the entire Centre Area SOI should be changed to Walnut Creek
and that no portion of the Centre Area should remain in Pleasant Hill's SOI. Now that
the Board is considering reapportioned supervisorial districts, it would be consistent with
the Board's May 1 Statement of Principle to also respect the Walnut Creek SOI. As a

result of this SOI change in 1995, the Centre Association believes it would be
indefensible to sever the Supervisorial District of Walnut Creek from its SOI with the
Centre Area.
Chairperson Uilkema will recall that when she voted in favor of changing the SOI of the
Centre Area to Walnut Creek that she joined other LAFCO Commissioners in finding
that the Centre Area has a strong community of interest with Walnut Creek. The
Statement of Determinations made by Chairperson Uilkema and the other LAFCO
Commissioners stated:
"The social and economic interdependence and interaction between the two cities
is perceived differently based upon interest. Basically,the residents and
property owners affected by the SOI amendment in the Pleasant Hill BART
Station Area feel a community of interest with Walnut Creek. They have
Walnut Creek addresses, do business in Walnut Creek,and they have registered
their intention to annex to Walnut Creek, not Pleasant Hill. They perceive a much
greater interaction with Walnut Creek." .
The business community joins with the residents of the Centre Area in requesting that the
Board of Supervisors recognize that a supervisor will be better able to represent our
common goals if that supervisor represents both the entire City of Walnut Creek and the
Centre Area. Splintering our interests politically could undermine the progress to date
and future vision of this model redevelopment project.

WHEREAS the Fox Creek condominium complex, which consists of fifty-nine individual homes, is
located in an unincorporated area of Contra Costa County that is within the Sphere of Influence("SOI")
of the City of Walnut Creek;
WHEREAS the Fox Creek Residential Association, acting by its Board of Directors, is responsible for
managing the Fox Creek condominium complex and protecting and promoting the common interests
of all Fox Creek homeowners;
WHEREAS Contra Costa County is now in the process of redrawing Supervisorial District lines;
WHEREAS the California Elections Code specifies that the Board of Supervisors, when establishing
the boundaries of supervisorial districts, may give consideration to: .
• topography
• geography
• cohesiveness, contiguity, integrity, and compactness of territory
• community of interest;
WHEREAS County staff has mapped eleven alternative redistricting scenarios for public discussion,and
near the center of each map is a small white area labeled "PH BART";
WHEREAS the Fox Creek condominium complex is located near the middle of the "PH BART"area;
WHEREAS that"PH BART"area constitutes all of the unincorporated land between the City of Walnut
Creek and the City of Pleasant Hill, and all of that land (excepting one senior apartment complex
immediately adjacent to Pleasant Hill) is within the Sphere of Influence of the City of Walnut Creek;
WHEREAS there is a firmly-established and strongly-felt "community of interest" between residents
of the "PH BART" area and Walnut Creek;
(For most of that area, the community of interest has been officially recognized by the Local
Agency Formation Commission("LAFCO") since SOI lines were first drawn decades ago. For
the rest of the area—which includes the Fox Creek complex,other condominiums,apartments
and single family homes, plus most of the commercial properties around the BART station—
the "community of interest" was officially addressed by LAFCO in 1995. At that time, a
determined combination of homeowner and community associations, together with the area's

commercial property owners, represented by the Contra Costa Centre Association, petitioned
LAFCO to move their area into Walnut Creek's SOI. After extensive hearings, LAFCO found
a strong and universal "community of interest" with Walnut Creek. In view of that and other
factors, LAFCO ordered the SOI change.)
WHEREAS the "PH BART" area is part of a cohesive and integral territory, specifically, that
neighborhood long-known as the Walden District, and the Walden District itself is part of a cohesive
and integral territory which is commonly referred to as incorporated and unincorporated Walnut Creek;
(The "PH BART" area constitutes approximately two-thirds of the historic Walden District of
Walnut Creek. The remaining one-third of the Walden District is within the city boundaries of
Walnut Creek. For more than one-half century,the interests of the Walden neighborhood have
been served by the Walden District Improvement Association. The Walden Association's
volunteer directors and officers have continuously worked closely with officials from the City
of Walnut Creek (as well as those of the County). There have been no such relationships with
other adjacent cities.)
WHEREAS consideration of the geography of the"PH BART"area shows that it is virtually surrounded
on the east, south and west by the City of Walnut Creek;
WHEREAS, in connection with the current redistricting process, the Board of Supervisors of Contra
Costa County has adopted the principle that all cities should be kept intact to the fullest extent possible;
WHEREAS dividing cities, SOI territories and established communities between two or more
Supervisorial Districts produces confusion, diminishes citizen and city influence, invites political
divisiveness and delay, and dilutes operational inefficiency;
WHEREAS there are scenarios that work very well for all the people of Contra Costa County without
dividing cities or established communities;
NOW, THEREFORE,the FOX CREEK RESIDENTIAL ASSOCIATION respectfully requests
that the Contra Costa County Board of Supervisors keep the"PH BART" area, the essentially-
similar Walnut Creek Sphere of Influence area, the long-established neighborhood know as
the Walden District, and the entire City of Walnut Creek together within one Supervisorial
District when the new District boundaries are adopted this year.

RESIDENTIAL ASSOCIATION, a California Nonprofit Mutual Benefit Corporation, and that at the May 22,
