BACKGROUND: Currently, there are no Institutes for Mental Disease (IMDs) or Mental Health Rehabilitation Centers (MHRCs) for adults who are seriously and persistently mentally ill located within Contra Costa County. As a result, the County has had to contract these services with providers in Santa Clara and Solano counties. There are usually between 90 — 100 county residents housed in out-of-county IMDs at any given time. IMDs and MHRCs are 24 hour, 7 day a week, long-term skilled nursing facilities with Special Treatment Programs (STP) for psychiatrically disabled adults. IMDs are always locked facilities, whereas MHRCs may or may not be locked. Additionally, MHRCs provide rehabilitation services that prepare consumers for reintegration and independent community living. The State Department of Mental Health provides funding for these services. The average daily rate per person for an IMD is $125; the STPs can range from $20 - $190/day per person, depending upon the enhanced program. Earlier this year, they discovered that the 75-bed former skilled nursing facility at 1515 Geary Road was for sale and contacted the County. about the possible acquisition .of the site. To that end, on March 20, 2001 the Board of Supervisors directed ,staff to evaluate the feasibility of acquiring 1515 Geary Road, Walnut Creek, for use as an IMD or MHRC. The subject property has been vacant for approximately two years. Prior to that time, the facility was licensed as a 75-bed skilled nursing facility for Alzheimer patients. Redwood Mortgage, who foreclosed on the previous tenants, currently owns the property, which is listed for sale at $3.2 million. Disclosure reports provided by the listing agent, Micheal Harris of Marcus and Millichap, indicate that the roof needs replacing and that there is extensive termite damage in a portion of the building. Conversations by Health Services staff with other parties who were at one time interested in acquiring the property (Telecare and Crestwood) suggest that structural upgrades and other tenant improvements may also be required before the facility could be licensed as a MHRC. Crestwood estimated that building improvements might be in the neighborhood of $1 million, making the overall cost the facility, in their estimation, cost-prohibitive. This property, along with others along a narrow strip of parcels along North Main Street, north of San Luis Road and South of Geary Road was rezoned as a Service Commercial District by the City of Walnut Creek in 1996. While the skilled nursing facility then in existence was grandfathered in as an existing use, the Service Commercial designation by the City of Walnut Creek took effect six months after the closing of the Alzheimer's facility. The Service Commercial zoning designation does not permit the following uses at 1515 Geary Road: ➢ Group Residential ➢ Housing for the Homeless, either emergency shelter or transitional housing ➢ Residential Care Facility ➢ Skilled Nursing Facility Given the current zoning of the site and the preliminary estimates of at least $4.2 million for acquisition and improvement costs that may be required to convert the facility to a MHRC, it does not appear that 1515 Geary Road is a feasible site for this needed in-county facility given the State reimbursement rates for these services. Facility planning staff of the County Administrator's and Health Services Department and the Mental Health Division of the Health Services Department will continue to work with MHRC providers and members of the mental health community in identifying an alternate location that is both cost-effective and within an appropriately zoned neighborhood within Contra Costa County. Attached is the definition of a Skilled Nursing Facility which, I think is the definition that fits the use you described. As you can see on page 225 of the ordinance, this use is not permitted in the Service Commercial (S-C) district. This area was rezoned to Service Commercial in 1996. P.O. Processing Facilities. Recycling facilities located in a building or enclosed space and used for the collection and processing of recyclable materials_ Processing means the preparation of material for efficient shipment or to an end-users specifications by such means as baling,briquet- ting,compacting, flattening, grinding, crushing,mechanical sorting, shredding,cleaning and remanu- facturing. Processing facilities include light processing facilities that occupy an area of under 45,000 square feet of gross collection,processing, and storage area anA has up to an average of two(2)out- bound truck shipments per day. Light processing facilities are limited to baling,briquetting,crush- ing,compacting. grinding, shredding and,sorting of source-separated recyclable materials and repair- ing of reusable materials sufficient to qualify as a certified processing facility. A fight processing facility shall not shred,compact,or bale ferrous metals other than food and beverage containers. Processing facilities also include heavy processing facilities which are any processing facility other than a light processing facility. 19. Religious Assembly. Facilities for religious worship and incidental religious education, but not including private schools as defined in this section. 20. Residential Care Facilities. Facilities which provide 24-hour non-medical care for 7 or more persons in need of personal services,protection,supervision,assistance,guidance, or training essential for sustaining the activities of daily living, or for the protection of the individual. This classification includes group homes,residential care facilities for the elderly,adult residential facilities,wards of the juvenile court, and other facilities licensed by the State of California. 21. Schools, Public or Private. Educational institutions having a curriculum comparable to that required in the public schools of the State of California. (See also Commercial Use Classi- fcations- Personal Improvement Services.) 22. Skilled Nursing Facilities. Health facilities or a distinct part of a hospital which pro- vides continuous skilled nursing and supportive care to patients whose primary need is for availability of such care on an extended basis. It provides 24-hour inpatient care and, as a minimum, includes physical, skilled nursing, dietary,pharmaceutical services and an activity program. This classifica- tion includes convalescent hospitals. 23. Utilities, Major. Purpose and Intent. The service commercial zone encompasses a narrow strip of parcels along North Main Street, north of San Luis Road and south of Geary Road. The primary purpose of the zone is to maintain and promote service commercial facilities, as well as retail establishments, that rely on customer arriving by auto. Land uses appropriate for this zoning district are those related to the sale, lease, service and maintenance of automobiles and related equipment, as well as custom manuring, storage warehouses, and home improvement businesses. The zoning district is bisected by North Main Street. The parcels to the west side of North Main Street, adjacent to the residential district, could support more neighborhood-serving land uses, such as banks, offices and small retail stores. These uses are permitted in this zoning district only when they do not interfere with the established service commercial character of the area. The properties to the east, between North Main Street and the I-680 freeway, would be suitable for the heavier commercial uses which may not be appropriate in close proximity to residential neighborhoods. The intent is to protect the regional-serving service commercial land uses, and balancing the need for more local-serving businesses, while ensuring minimal disruption to the adjacent residential areas. Because the service commercial zoning district is conveniently located along a major thoroughfare with easy access to the I-680 freeway, it also attracts eating and drinking establishments and businesses that serve the traveling public such as hotels. Vendor Carts 18) USE REGULATIONS L(1) Permitted subject to the issuance of a Large Family Day Care Home Permit by the Zoning Administrator. L(2) Automated teller services through machines are permitted; all other uses under this classification are prohibited. L(3) Not permitted if located within 600'of the boundary of any school (as defined in Article 4, See.]0-2.1.403.E). A Conditional Use Permit shall be required if it is to be located on a parcel within 600'of the boundary of any hospital or residential zoning district, otherwise it is a permitted use. The Planning Commission shall only grant the Use Permit subject to the findings in Sec. 10- 2.4.605 and also if it finds that noise, litter, crowd control and parking associated with the proposed use will not adversely impact hospitals or residentially zoned property. The Planning Commission, in making the findings for approval, may impose conditions in regards to the following items(or any other items it deems appropriate to mitigate land use impacts associated with the proposed use): a) Hours and days of operation. b) Location of queuing for patrons waiting to enter the facility. (There should be an identified area for queuing which is not located within the public right-of-way,nor that blocks required parking or driveways). c) Adequacy of restroom facilities for patrons inside the facility as well as accommodations for ' queuing patrons waiting to enter the facility. d) Adequate drop off areas, if valet parking is to be provided. e) If needed, provision of security personnel which can be readily identified by the public and the police. Security personnel, if required, should be responsible for monitoring activities in the parking lots and should act as doorpersons to facilitate crowd control both inside and outside the facility. f) Installation of sound attenuation material, if necessary,to mitigate noise impacts. g) Provision of maintenance personnel to police the residential area for litter. h) If outdoor areas, including decking,balconies and porches are to be utilized as public assembly area, the Planning Commission may consider the square footage of the outdoor area in determining required parking. lTitle 10 - Page 226 Supp. 4. 12/97 FILE No.099 06/01 '01 09:21 ID:City of Walnut Creek CDD FAX:9252563500 •�"• � PAGE 10/ 13 §I0-2.2.1102 Walnut Creek Municipal Code §10-2.2.1102 L(4) Not permitted if located within 600'of a school. A Conditional Use Permit shall be required if is to be located within 600'of the boundary of any hospital or residential zoning district,otherwise it is a permitted use. The criteria found in Section 10-ZA-605 shall not apply to such conditional use permit,nor shall any such use permit be modified or revolted except for reasons related to this paragraph. The Planning Commission shall grant the conditional use permit unless it finds that noise from the use or its customers or patrons will be audible from the hospital or residentially zoned property. L(5) Outdoor seating which requires the construction of permianemt structures or alterations to existing buildings shall be subject to Design Review (see Part 1V, Article 12. Design Review.). A Temporary Encroachment Permit is required for the temporary use of tate public right-of-way for the placement of tables and chairs. L(6) A Conditional Use Permit shall be required if it is to be located on the west side of North Main Street, otherwise it is a permitted use. The Planning Commission shall grant the conditional use permit if it finds that noise associated with the proposed use does not adversely impact residentially zoned property. The Planning Conunission, in making the finding for approval, may impose conditions in regards to the following items (or any other items it deems appropriate to mitigate noise): a) Hours and days of operation. b) Installation of sound attenuation material, if necessary,to mitigate noise impacts. L(7) Crematories, columbariums and mausoleums are not permitted. Mortuaries are permitted sub'ect to the issuance of a Conditional Use Permit. i L(8) Permitted on the ground floor provided that the office is an accessory use to a permitted use. Permitted on floors above the ground floor. Offices not accessory to a permitted use, or on the floors above the ground floor level, are subject to the issuance of a Conditional Use Permit and the finding that the office use will not alter or interfere with the character of the service commercial businesses in the zoning district. L(9) A Conditional Use Permit shall be required if located on the west side of North Main Street subject to the findings that: a) The site fronts North Main Street with access from North Main Street; b) There is adequate space so that all vehicles for rent or lease can be parked on site at all times, and/or the use can demonstrate that it has other facilities that can accommodate the additional vehicles in excess of the subject site; c) The business will not negatively impact the abutting residential area. To ensure that the finding can be made, the Planning Commission may impose conditions relating to noise attenuation, screening, landscaping and setbacks. This use is also subject to the conditions in L(10). d) Are found in Sec. 10-2.4.605 for Conditional Use Permits. !� L(I0) All facilities which have repair, loading, storage and other visually detractive activities (this does not include car sales inventory) which would be visible from the North Main I Street corridor or the 1-680 freeway shall be reviewed and approved by the Design Review Commission. The Design Review Commission shall not approve any application where such activities cannot be adequately screened so as to preclude visibility from the North Main Street corridor or the I-680 freeway. The sale or rental of motorcycles, mobile homes, recreational vehicles, and similar equipment is permitted. All vehicles and equipment for sale or rent must be parked or stored on site at all times, unless it can be demonstrated that there are other facilities that can accommodate the additional vehicles in excess of the subject site. L(12) Permitted subject to the approval of the Community Devel2Mgent Director. L(I 3) EIectrical substations, above-ground electrical transmission lines, water pumping stations and switching buildings are permitted uses. All other uses within this classification are not permitted. L(14) Accessory structures are permitted subject to Sec. 10-2.3.1103. Property Development Regulations.
