Adopted this Resolution on May 22, 2001 by the following vote:
AYES: Supervisors Gioia , Gerber, DeSaulnier , Glover , Uilkema

RESOLUTION NO.: 2001/215
SUBJECT: Accept Completion of Improvements and Declaring Certain Roads as County Roads,
Subdivision 8174, Walnut Creek area.
The Public Works Director has notified this Board that the improvements in Subdivision
8174 have been completed as provided in the Subdivision Agreement with Cherry Lane Associates,
LTD., heretofore approved by this Board in conjunction with the filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of May 22, 2001 thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

SUBJECT: Accept Completion of Improvements and Declaring Certain Roads as County Roads,
Subdivision 8174, Walnut Creek area.
DATE: May 22, 2001

BE IT FURTHER RESOLVED the payment (labor and materials) surety for$125,100.00,
Bond No. P2794489 issued by the above surety be RETAINED for the six month lien guarantee
period until November 22, 2001, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the widening of Lucy Lane is ACCEPTED and
DECLARED to be a County Road; the right of way was conveyed by separate instrument, recorded
on November 20, 1998, in Book 404 of Maps on page 33.
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby
established, and the$2,500.00 cash deposit(Auditor's Deposit Permit No. 318691, dated August 20,
1998) made by Cherry Lane Associates, LTD., and the performance/maintenance surety for
$247,700.00, Bond No. P2794489 issued by Reliance Surety Company be RETAINED pursuant
to the requirements of Section 94-4.406 of the Ordinance Code until release by this Board.
