THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

SUBJECT: GRANT permission to completely close all of Dougherty Road, for the purpose of
realignment and reconstruction of a portion of Dougherty Road from the northerly
San Ramon City limits to Bollinger Canyon Road, for Road Improvement
Agreements RA 1103, RA 1104, and RA 1105 (XREF SUB 7984), in the Dougherty
Valley area.
BACKGROUND: The conditions of approval for SUB 7984 require Shapell Industries to
reconstruct and realign Dougherty Road, from the northerly San Ramon City Limits to Bollinger
Canyon Road. The newly aligned road will be graded for the ultimate alignment and will provide
four through lanes of traffic, including left-turn lanes, medians, bike lanes, sidewalks, landscaping,
and.traffic signals. The proposed improvements will also improve traffic circulation and public
safety for the Coyote Creek Elementary School.
To construct the ultimate roadway, approximately 250,000 cubic yards of embankment fill will need
to be placed for the new Dougherty Road alignment. These embankment fills will be approximately
20-feet in height. The Public Works Department has reviewed the various construction phasing
options with the applicant to determine how the improvements can be constructed most efficiently
and provide the least amount of inconvenience to the traveling public and the adjacent elementary
school. One of the reviewed options was to partially leave the road open to daily traffic and
simultaneously place roadway fill adjacent to the traffic lanes. Each new phase would require
grading, interim paving or surfacing, and the placement of interim striping and signs. This type of
construction phasing could extend the construction schedule up to a year. Additionally, the public
would be traveling through an active construction zone and would be subject to delays. We would
also expect much of the traffic to divert to other routes during this time period.

The other alternative is to allow the applicant to completely close Dougherty Road to complete all
the grading, most of the paving, and the installation of underground utilities during the summer
months. It should be noted a major gas line providing service to the Danville/Blawkhawk area will
need to be installed in this section of Dougherty Road and be operational by September 1, 2001.
Once the pavement and underground utilities are installed,Dougherty Road could be safely reopened
to traffic while the remainder of the work is completed. The complete closure of Dougherty Road,
while the San Ramon Unified School District is out of session during the summer, is the
reconunended alternative.
IT IS BY THE BOARD ORDERED that permission is granted to Shapell Industries of Northern
California to completely close Dougherty Road, from the northerly San Ramon City limits to the
southerly San Ramon City limits, from June 18, 2001 through August 24, 2001, for a period of 24
hours a day, subject to the following conditions:
1. Shapell Industries shall obtain a road closure permit for the Dougherty Road closure and shall
obtain an encroaclunent pen-nit for all work within the existing public right of way.
2. All work shall comply with road improvement plans: RA 1103 (Dougherty Road); RA 1104
(N. Gale Ridge Road); and .RA 1105 (Bollinger Canyon Road).
3. Traffic will be detoured via Interstate 680 and Interstate 580.
4. All signing to be in accordance with the State of California Manual of Traffic Controls.
5. Shapell Industries of Northern California shall comply with the requirements of the
Ordinance Code of Contra Costa County.
6. Have on file with the County a Certificate of Insurance in the amount of$1,000,000 for
Comprehensive General Public Liability, which names the County as an additional insured.
7. Obtain approval for the closure from the Sheriff's Department, the California Highway Patrol
and the Fire District.
8. Liquidated damages will apply if the road closure extends beyond August 24, 2001.
9. Progress reports and construction schedules shall be submitted by the applicant to the Public
Works Director every two weeks during the road closure.
10. The Public Works Director shall notify Supervisor Gerber one week in advance should staff
believe the applicant cannot meet the August 24, 2001 deadline.

On this day, the Board of Supervisors considered granting permission to Shapell Industries to
completely close Dougherty Road, from June 18, 2001, to August 24, 2001, for the period of 24
hours a day, for the purpose of realignment and reconstruction of Dougherty Road from the
northerly San Ramon city limits to Bollinger Canyon Road, in the Dougherty Valley area.
Maurice Shiu, Public Works Director, presented the staff report.
The Board discussed the matter, the public hearing was opened, and the following persons
appeared to speak:
Steve Savage, Project Manager, Shapell Industries;
Herb Moniz, City of San Ramon, 2222 Camino Ramon, San Ramon;
Peter Muller, 7 Bel Air, Orinda.
All those desiring to speak having been heard, the Board continued their discussions.
Supervisor Uilkema inquired if the Dougherty Valley Oversight Committee had voted for
closure. Supervisor Gerber responded the committee had not voted. She informed the Board
this closure was the least impact for the shortest time.
Supervisor Gerber moved staffs recommendations and included direction that the Public Works
Director notify her one week in advance should staff believe the project could be completed by
the August 24, 2001, deadline. Supervisor Glover seconded the motion.
The vote on the motion was as follows:
