AUTHORIZE a General Plan Amendment and Rezoning Study for several parcels located along the 4600 block of Pacheco Boulevard in the Pacheco area to change the parcels current General Plan land use designation from the Multi Family Residential - Low Density (ML) to Light Industrial (LI) and rezone the parcels to a Light Industrial zoning district (L-1), including parcels owned by the Cola Family Trust at 4677, 4683, 4685, and 4687 Pacheco Boulevard, and 4615 Pacheco Boulevard. 2. DETERMINE that granting authorization for this request does not imply any support for this application, but only that this matter is appropriate for study. Marie Cola Family Trust Pacheco Town Council May 8, 2001 Board of Supervisors GPA Study Authorization Request for the 4600 block of Pacheco Blvd. Page 2 FISCAL IMPACT Costs associated with the General Plan and Rezoning Study are to be paid by the applicants. BACKGROUND / REASONS FOR RECOMMENDATION The Marie Cola Family Trust owns a 5-acre site located at 4677-4687 Pacheco Boulevard on the eastside of the street just south of the Santa Fe Railroad track trestle. The subject site is currently designated as Multi-Family Residential -Low Density (ML) under the County General Plan and zoned P-1 (Planned Unit Development). See attached map marked Exhibit"A"which depicts the location of the subject parcels. The Department is in receipt of a letter from Mr. David Deutscher, a realtor representing the Cola Family, requesting authorization for a General Plan Amendment and Rezoning Study for the subject site to change the current General Plan land use designation from ML to Light Industrial (LI) and rezone the parcel from P-1 to a Light Industrial (L-1) zoning district. See attached letter marked as Exhibit "B". The Department has reviewed the authorization request and generally agrees that a study to consider re-designation of the site to a Light Industrial or Commercial Service land use designation is warranted give the prevailing conditions along this portion of Pacheco Boulevard. This section of Pacheco Boulevard between the I-680/SR-4 interchange and the Santa Fe Railroad track trestle has over the years transformed into a corridor with predominantly light industrial and commercial service oriented uses. As originally envisioned under the current County General Plan,the site of Cola Family properties and adjoining properties were designated for multi-family residential development but such residential uses seem unlikely given current market trends along the Pacheco Boulevard to site light industrial or commercial uses along the corridor. Anecdotal information received by the Department suggests that there is growing demand for light industrial or commercial service space in the Central County area with good freeway access, particularly for the construction industry and related services. The 4600 block of Pacheco Boulevard is an attractive location for such uses because it has very good freeway access and there is no firmly established residential neighborhood that would pose a conflict with such uses. It is also noted that a portion of Pacheco Boulevard between the freeway interchange and the railroad track trestle is within the City of Martinez. The Martinez General Plan has designated this section of Pacheco Boulevard for Commercial Service land uses.This use designation allows many of the same uses as those permitted under the County's Light Industrial designation. If authorized, however, the study will need to address the implications of removing the subject sites from the inventory of land in the unincorporated area designated for housing and the impact on General Plan policies to promote production of affordable housing. May 8, 2001 Board of Supervisors GPA Study Authorization Request for the 4600 block of Pacheco Blvd. Page 3 Representatives from the Pacheco Town Council and City of Martinez Planning Department have been advised of the study request from the Cola Family, and have not indicated any.objection to conducting the General Plan and Rezoning Study. In addition, property owners adjacent to the Cola Family site were contacted about the potential re-designation of the Cola Property to a Light Industrial use. No one has stated an objection to the study. In fact, in response to a survey conducted by the realtor representing the Cola Family several of these property owners have expressed an interest in joining the Cola Family's application for a study to change the use designation of their properties to Light Industrial. Koch_ 4744 Pacheco 161-262-014 .20 MUM-12 4754 Pacheco 161-262-015 .20 MUM-12 14.56 All but one of the above listed properties is on the westside of Pacheco Boulevard across from Cola Family site (except for 4615 Pacheco Boulevard). Aside from a 12 acre site designated as Open Space (OS), these properties are also designated a Multi-Family - Low Density (ML) under the General Plan with a mix of underlying zoning designations. See map of these properties marked as Exhibit "C ". Although the properties on the westside of Pacheco Boulevard maybe subject to the same market pressures as the Cola Family site, there are number of factors which in staff's view indicate that a General Plan Amendment Study to consider a change to Light Industrial use would not be appropriate at this time: 1. There is an approved development plan for a 120-unit apartment complex located at 4640-4670 Pacheco Boulevard. The foundation for the apartment complex was constructed but construction has been idle for a number of years.The Department has been contacted by a group interested in completing the apartment project. Should construction of the apartment complex be renewed, the designation of a land area directly north or south of the apartment complex as Light Industrial, as requested by the adjoining property owners, would be incompatible with a multi- family residential use. The five parcels listed at 4628 Pacheco have an irregular shape and are set back from the street. There is an existing single family residence at 4626 Pacheco which fronts these parcels, and this owner has not indicated an interest in changing the land use. Changing to a Light Industrial use for 4628 Pacheco would be incompatible with the established residence at 4626 Pacheco. 3. The 12-acre parcel at 4616 Pacheco is parallel to and south of the Santa Fe railroad tracks. Access to the parcel is setback from Pacheco Boulevard. It is designated as Open Space and zoned A-2, which indicates that the site may not be appropriate for Light Industrial use at this time. Staff believes that the request for a study to change the land use designation for the 5- acre parcel at 4677-4687 Pacheco Boulevard owned by the Cola Family Trust is reasonable and recommends that it be authorized. Staff further recommends that the parcel located at 4615 Pacheco Boulevard be included in the Light Industrial use study for 4677-4687 Pacheco Boulevard given its proximate location to the Cola site (eastside of the street) and 'a neighboring property with an existing Light Industrial use. Staff notes that the study will need to address the policy issue of converting the subject sites from Multi Family Residential (ML) to Light Industrial (LI), and the implications this would have on General Plan policies to encourage the production of affordable housing. Staff recommends that the Board decline consideration of the request to include the parcels on the westside of the street, located at 4616, 4628, 4630, 4744, and 4754 Pacheco Boulevard, as part of this study until such time as the development of the approved apartment complex at 4640-4670 Pacheco Boulevard is formally abandoned. The authorization of this General Plan Amendment and Rezoning study does not imply the Board's concurrence or endorsement of the requested land use change, but only that the matter is appropriate for study. Dear Patrick: Please accept this letter as a request for the county to proceed with a request to the Board of Supervisors for a General Plan Amendment of the subject properties to a Light Iri ust -dl-zomrig. - I enclosed a check of$750.00 for the application fee. I have enclosed a parcel map showing the Cola Family Property and some of the other interested parcels. I recently sent a letter to the surrounding neighbors letting them know of our intentions to apply for a general plan amendment and re-zoning of the property to Light Industrial. I have enclosed a copy of the letter sent to all the neighbors for your file. I have received two verbal responses both of which would like to join the application to have their propert)'re-zoned as well. I have asked those parties to write me a letter.
