SUBJECT: APPROVE AMENDMENT NUMBER 1 TO THE JOINT EXERCISE OF POWERS
AGREEMENT WITH EBMUD FOR RELOCATION OF THE WATER MAIN CROSSING OF
THE CUMMINGS SKYWAY EXTENSION PROJECT, CROCKETT AREA.

I. Recommended Action:
AUTHORIZE the County Administrator, or their designee, to execute Amendment Number 1 to
the Joint Exercise of Powers Agreement between Contra Costa County Public Works Department
and East Bay Municipal Utility'District in the amount of $112,500 for a new payment total of
$162,500.
II. Financiallmpact:
There will be not impact on the County General Fund. The $112,500 increase will be paid for by
Rodeo/Crockett Mitigation Fund (50%) and State Funds (50%).

III. Reasons for Recommendations and Background:
The original agreement, effective October 14, 1997, required the County to pay for all costs
incurred during the protection of East Bay Municipal Utility District's .24" water main into the
roadway embankment built during the construction of the Cummings Skyway Extension Project.
This amendment increases the maximum amount of actual costs payable to EBMUD.
The Public Works Department constructed the Cummings Skyway Extension Project from
Interstate 80 to San Pablo Avenue in the Crockett Area. As a result, approximately sixty feet of
fill was placed over an existing 24" water main, owned by EBMUD. EBMUD agreed to allow the
County to protect the 24" water main during the construction of the roadway embankment. The
costs associated with the protection of this water main are the responsibility of the Public Works
Department.
During construction of the embankment, a leak was discovered in the 24" water main. Due to
the service area of this water main, this situation was declared an emergency. EBMUD took
immediate actions to correct the leak. Since the water main already had fill placed over it, it was
determined the most efficient method to repair the leak was to construct a bypass water main
instead of re-excavating the original water main. Per the County's original agreement, the
County was responsible for all cost associated with the water main.
Due to the nature of the situation, an amendment was not processed before or during this event.
This amendment will reimburse all actual costs incurred by EBIMUD. The County has been
negotiating with EBMUD since the completion of the project (December 15, 1998) and is pleased
to reach an agreement that will pay EBMUD all actual costs pursuant to this agreement and shall
release the County from any further obligation for reimbursement or payment claimed by EBMUD
in connection with the project.
IV. Consequences of Negative Action:
A negative action would prohibit EBMUD from being paid for construction costs that they
incurred.
