BARRY, AICP �_�� Costa COMMUNITY DEVELOPMENT DIRECTOR - County f u..- DATE: April 24, 2001 SUBJECT: REPORT CONCERNING 2000 CENSUS POPULATION AND PROPOSED SCHEDULE FOR REDISTRICTING THE COUNTY SUPERVISORIAL DISTRICT BOUNDARIES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS DIRECT Community Development staff to perform the following activities to facilitate the required redistricting of the Contra Costa County Supervisorial District boundaries and ADOPT the proposed schedule: 1. ADOPT the proposed redistricting schedule; and, 2. DIRECT Community Development staff to prepare several scenarios for redistricting which would balance the population within the supervisorial districts as "nearly equal as may be" in accordance with the state statute governing supervisorial districts. These possible scenarios would be presented to the Board of Supervisors before the public meetings. FISCAL IMPACT Approximately$10,000 in staff costs to prepare alternatives, arrange meetings and public hearings. County Counsel costs to prepare redistricting ordinance. These costs will be born by budgeted funds. BACKGROUND/REASONS FOR RECOMMENDATIONS The U.S. Census Bureau has compiled the redistricting data from Census 2000. Contra Costa County received the County's Redistficting Data (P.L. 941-171) Summary File on April 2, 2001. The County's population increased from 803,732 to 948,816. This increase of 145,084 persons represents an increase of 18.1%. Dennis Barry, Community Development Director presented staffs report and recommendations. Supervisor Uilkema requested that she would like three meetings scheduled within her district to cover the areas of Lamorinda, Martinez, and West County. Supervisor Glover advised staff he also wanted to request meetings in Bay Point, Antioch and further east. Supervisor Uilkema further requested staff balance the district populations as "nearly equal" in accordance with state statutes. Mr. Barry stated he would accommodate those requests. Supervisor Gioia noted there was a recent U.S. Supreme Court decision on redistricting in a North Carolina district. He requested County Counsel provide the Board with a memo, which explores that issue by the May 8, 2001 meeting. He also added that staff try to make this process user-friendly for the public, and have available at each of the public hearings. The Board continued to discuss the matter, the public hearing was opened, and no one appeared to speak. All those desiring to speak having been heard, the Board continued their discussion. Supervisor Glover moved to approve the board order with the modifications suggested by the Board members. Supervisor Gioia seconded the motion. Supervisor Gerber requested that as an additional modification, staff develop a scenario to keep cities intact, keeping local jurisdictions in one supervisorial district. The maker of the motion and seconder approved her addition. City Elections 21601. 26203 of the Government Code, and may adjust the boundaries of the supervisorial districts on the basis of that census, or on the basis of popula- tion estimates prepared by the State Department of Finance or the county planning department or planning commission,pursuant to Section 21500. (Added by Stats. 1994, c. 920, §2.) 21504. Action against redistricting. Any person claiming that the estimates of population used in the redis- tricting pursuant to Section 21503 do not reflect the current population within the district boundaries more accurately than the most recent census data, may commence an action in the superior court in declaratory relief to determine that fact.The action shall be brought within 30 days after the adop- tion of the redistricting ordinance. (Added by Stats. 1994, c. 920, §2.) 21505. Appointment of advisory committee. The board may appoint a committee composed of residents of the county to study the matter of changing the boundaries of the supervisorial districts. The committee shall make its report to the board of its findings on the need for change of boundaries,and the recommended changes,within six months after the final population figures determined in each federal decennial census have been released,but in any event not later than August 1st of the year fol- lowing the year in which the census is taken. Recommendations of the com- mittee are advisory only. (Added by Stats. 1994, c. 920, §2.) 21506. Effect on existing supervisorial term of office. The term of office of any supervisor who has been elected and whose term of office has not expired shall not be affected by any change in the boundaries of the district from which he or she was elected. At the first election for county supervisors in each county following adjustment of the boundaries of supervisorial districts, a supervisor shall be elected for each district under the readjusted district plan that has the same district number as a district whose incumbent's term is due to expire. A change in the boundaries of a supervisorial district shall not be made within 45 days before the first day for circulating nomination papers for an election of supervisors in the county or between the direct primary election and the general election. (Added by Stats. 1994, c. 920, §2.) Chapter 7. City Elections Article 1. General Law Cities 21600. Application of article. This article applies only to general law cities electing members of the leg- islative body by districts or from districts, as defined in Section 34871 of the Government Code. (Added by Stats. 1994, c. 920, §2.) 21601. Adjustment of councilmanic districts. Following each decennial federal census,and using that census as a basis, the council shall,by ordinance or resolution,adjust the boundaries of any or all of the council districts of the city so that the districts shall be as nearly equal in population as may be and shall comply with the applicable provi- sions of Section 1973 of Title 42 of the United States Code, as amended. In 489 2001 21001. DIVISION 21. STATE AND LOCAL REAPPORTIONMENT (c)The Secretary of State shall also make copi public inspection. EXHIBIT A (d)There shall be no charge for the maps prc tion. (Amended by Stats. 2000, c. 1081, §23.) - 21002. Changes in boundaries. Each house of the Legislature shall be a proper party to,and,if not origi- nally named as a party,shall have the right to intervene in,any action involv- ing the validity or application of any statute that provides for changes in the boundaries of any legislative districts of members of that particular house. (Added by Stats. 1994, c. 920, §2.) Chapter 6. Supervisorial Districts 21500. Equal in population. Following each decennial federal census,and using that census as a basis, the board shall adjust the boundaries of any or all of the supervisorial dis- tricts of the county so that the districts shall be as nearly equal in population as may be and shall comply with the applicable provisions of Section 1973 of Title 42 of the United States Code, as amended. In establishing the bound- aries of the districts the board may give consideration to the following fac- tors: (a) topography, (b) geography, (c) cohesiveness, contiguity, integrity, and compactness of territory,and(d)community of interests of the districts. (Added by Stats. 1994, c. 920, §2.) 21500.1. Public hearing on proposal to adjust boundaries. The board shall hold at least one public hearing on any proposal to adjust the boundaries of a district,prior to a public hearing at which the board votes to approve or defeat the proposal. (Added by Stats. 1999, c. 429, §1.) 21501. Time of boundary adjustment. The boundaries of the supervisorial districts shall be adjusted by the board before the first day of November of the year following the year in which-each decennial federal census is taken. If the board fails to adjust the boundaries before the first day of November following the year in which the federal census is taken, a supervisorial redistricting commission shall do so before the 31st day of December of the same year.The adjustment of the dis- trict boundaries shall be immediately effective the same as if the act of the supervisorial redistricting commission were an ordinance of the board,sub- ject,however,to the same provisions of referendum as apply to ordinances of the board. (Added by Stats. 1994, c. 920, §2.) 21502. Composition of supervisorial redistricting commission. The supervisorial redistricting commission shall be composed of the dis- trict attorney, who shall be chairman, the county assessor, and the county elections official if he or she is elected by the qualified electors of the county, or, if not, the county superintendent of schools if he or she is elected by the qualified electors of the county, or, if not, the sheriff. (Added by Stats. 1994, c. 920, §2.) 21503. County census. The California State statute addresses the issue of Supervisorial redistricting. The statute states that"In establishing the boundaries of the districts the board may give consideration to the following factors: (a) topography, (b) geography, (c) cohesiveness, contiguity, integrity, and compactness of territory, and (d) community of interests of the districts." Also the board "shall hold at least one public hearing on any proposal to adjust the boundaries of a district, prior to a public hearing at which the board votes to approve or defeat the proposal". A copy of the statute is attached as Exhibit A. After the 1990 census, the redistricting process included separate public meetings in each district before the Countywide hearings were held. The Community Development Department has proposed a schedule (shown as Exhibit B), which would include such meetings as well as the Public Hearings by the Board of Supervisors. The State Statute states the supervisorial districts shall be adjusted by the Board before the first day of November. However it appears that this has not been amended since California elections were changed from June to March. The County Elections Department needs the new boundaries by the third week of August in order to prepare precinct boundaries. The schedule presented would allow for the adoption of new boundaries by mid-July in order not to interfere with budget hearings and August vacations. Community Development staff recommends that the Board approve the proposed schedule. Staff also requests direction to prepare possible scenarios for redistricting which would be presented to the Board at their May 1, 2001 meeting before the public meetings in the districts. This would give staff time to make any additional adjustments or other scenarios as requested by the Board before the public meetings.
