FISCAL IMPACT None to the General Fund. Bills related to the "transportation funding" goal as shown in Exhibit A could impact the amount of state funding available for transportation improvements, as indicated in the bill descriptions. BACKGROUND/REASONS FOR RECOMMENDATIONS On April 9, the Transportation, Water and Infrastructure Committee received its first quarterly report on transportation bills introduced in the state legislature and their possible impacts on the County's adopted goals for transportation legislation in 2001 . Based on that discussion and recommendations from the County's advocacy firm (Smith, Kempton & Watts), the Committee recommends the Board adopt positions on bills as indicated in Exhibit A. Exhibit B shows the transportation goals adopted by the Board in November 2000. The recommendations pertain only to transportation-related bills. Positions on smart growth bills related to transportation will be discussed at the May meeting of the Transportation, Water and Infrastructure Committee, when more information is expected to be available. BILL DESCRIPTION POSITION RELATED COUNTY GOAL AB 227 Makes permanent the dedication of gasoline sales SUPPORT Transportation (Longville-D) tax revenue for transportation purposes,after funding expiration of current legislation(Traffic Congestion Relief Fund)on June 30,2006. Companion bill to ACA 9. AB 321 Creates a permanent Congestion Relief WATCH Transportation (Vargas-D) Transportation Trust Fund,to be funded with tax ceding revenues from the sales or lease of new or used motor vehicles. AB 381 Expands eligible recipients of the state's Jobs- SUPPORT Smart growth (Papan-D) Housing Balance Improvement Account to transportation planning agencies,in addition to local governments;expands eligible use of funds from one-fourth mile to one-third mile around rail or bus transit stations. SB 346 Sets a deadline of December 12,2002,for the Bay WATCH (Perata-D) Area Water Transit Authority to submit its state- mandated Implementation and Operations Plan. SB 473 Creates new mandates for MTC,including a new WATCH (Perata-D) congestion reduction plan for bridge corridors, performance measures and goals for all transportation projects in MTC plans and programs, and plans for transportation management and commuter rail and bus services. SB 600 Requires the state Office of Planning and Research WATCH Smart growth (Torlakson-D) to develop by March 1,2002 a set of guidelines incorporating best practices for transit village planning and design. SB 784 Provides at least two years of incentive grants to WATCH Smart growth (Torlakson-D) local jurisdictions for programs that address the jobs-housing balance. SB 829 Extends indefinitely the Traffic Congestion Relief WATCH Transportation (Karnette-D) Fund and changes the split of funding by increasing funding the share going to the Public Transit Account and decreasing the shares going to the STIP and local streets and roads projects. SB 873 Requires Metropolitan Transportation Commission WATCH Regional rail (Torlakson-D) and county congestion management agencies to coordination develop a regional transit expansion agreement,to include the results of certain ongoing rail extension studies. SB 910 Imposes a$1,000-per-housing-unit penalty on WATCH (Dunn-D) jurisdictions whose housing elements are out of compliance with state law. SCA 3 Adds transit vehicle costs as an eligible use of fuel- WATCH (Kamette-D) tax revenues,including capital,operations and maintenance costs. 2 EXHIBIT B Goals for transportation-related legislation in the 2001 legislative session Adopted by the Contra Costa County Board of Supervisors on December 12, 2000 1. Increase transportation funding. This goal would focus on the development of, or support for, bills that would generate major funding for transportation in Contra Costa County. A recent example is SCA 3,which would make it easier for counties to generate new transportation revenues through ballot measures. Other bills that would significantly increase funding, or provide more flexibility in funding, would also fall into this category. Part of this goal will be to seek full funding of the Caldecott Tunnel fourth bore project as a state funding obligation. 2. Regional rail coordination. Several pending rail issues could fit into a goal to reach regional coordination on rail development. One issue is the BART buy-in for Santa Clara County. The buy-in may be determined through negotiations expected to begin shortly involving BART and Santa Clara County. However, legislation requiring a buy-in could be introduced if legislators perceive the negotiations will not result in an equitable buy-in amount. The buy-in payment from Santa Clara County is needed to extend BART facilities and services to Antioch, Livermore, and West County. Expansion of Altamont Commuter Express (ACE) train service also could fit into this category. East County interests have proposed the use of conventional trains on Union Pacific's little-used "Mococo"freight line in East County to connect with the ACE train station in Tracy. Senator Jackie Speier(D-San Mateo) is interested in extending ACE train services from the East Bay to the Peninsula,possibly in the Dumbarton Bridge corridor. Senator Speier's office indicated she would be interested in cooperative arrangements with Contra Costa and Alameda Counties to develop a coordinated approach to rail funding and. expansion to accomplish ACE train expansion. Expansion of intercity rail services on the Capitol Corridor and San Joaquin lines also is part of this goal. 3. School transportation expansion and improvements. The Board of Supervisors has expressed an interest in school transportation issues. Assemblymember Dion Aroner introduced AB 2024 to equalize school transportation funding across school districts in the 2000 session but the bill failed to pass the Legislature. The bill is not expected to be reintroduced, given the lack of statewide support for it. This goal includes support for other efforts to explore new funding for home-to-school transportation, similar to AB 2024. Bills that deal with the planning requirements for new school facilities also would fall into this category. 4. Pedestrian safety. Bicycle legislation and funding programs have been the subject of recent legislative activity but less attention has been given to pedestrian issues. There is a proposal to extend the Safe Routes to Schools grant program beyond its expiration date of January 1, 2002. This initiative, or similar measures, may be the focus of legislation in the next session. 5. Smart gowth. This goal would focus on transportation-related bills that would support, or be part of, initiatives to foster Smart Growth. The Board of Supervisors adopted a Smart Growth Initiative as part of the Urban Limit Line General Plan Amendment in 2000. There were several bills in the last session that dealt with these issues, such as livable communities programs and environmental enhancement programs to improve the design of transportation facilities that pass through neighborhoods. Bills relating to transit-oriented development also would come under this goal, along with bills relating to transit services and facilities that support Smart Growth strategies. EXHIBIT B 6. Inter-regional corridor improvements.This goal deals with development of better transportation linkages between the County and other regions, such as the Central Valley. One example would be State Route 239, an unbuilt segment of the state highway system that would run roughly from Brentwood to Tracy. To date Caltrans has been unable to obtain funding to perform the necessary plans and studies to move this project from the idea stage to project development. County staff has participated in discussions with Caltrans, local legislators and other entities to try to develop a funding strategy for the necessary inter-regional corridor study. The Board declared its support for AB 2864 in 2000, which established the Jobs-Housing Balance Improvement Account that provides an incentive-based strategy to encourage the construction of housing in those areas of the state that over the last decade have experienced the greatest increase in job growth but have not kept pace with necessary housing which may include the construction of infill housing and transit-oriented development. AB 381 would further the intent of state law by making the program consistent with the Metropolitan Transportation Commission's Housing Incentive Program, and by increasing the amount of funds the Commission makes available through that program. AB 381 also supports one of the goals of our Measure C-88 Transportation Improvement and Growth Management Program, which is to address housing options and job opportunities. This legislation makes permanent the dedication of gasoline sales tax revenue for transportation purposes, after expiration of current legislation on June 30, 2006. The Board declared its support for AB 2928 in 2000, which instituted the transfer of general fund revenue to specified transportation projects and allocated revenue derived from the sales tax on gasoline to various transportation purposes, including local transit and street maintenance projects. Since that legislation was signed into law, long-needed transportation projects in Contra Costa County have been accelerated which directly benefit from the new revenue source.
