BACKGROUND
The California Energy Commission is reviewing an application by Mirant (formerly Southern
Energy) to construct a 530-megawat (MW) natural gas-fired combined cycle power plant. The
project is located within the existing Contra Costa Power Plant site formerly owned by Pacific Gas
& Electric Company. The power plant is located along Wilbur Avenue in the unincorporated area
adjacent to the City of Antioch.
The California Energy Commission (CEC) is responsible for reviewing and approving proposals
on the siting of power plants through a hearing process as established under state law. The
hearing process is conducted in a manner similar to an administrative law process in which
interested parties may participate formally or informally on a particular siting case. Formal
participation on a siting case is initiated by filing a petition with the CEC to become an intervenor.
Intervenor status allows a party to not only comment on the project at formal hearings conducted
by the CEC, but it also enables the party to offer testimony and evidence at the hearing. Generally
speaking the testimony and evidence offered by an intervenor is given more weight by the CEC
in considering and deciding on matters pertaining to the siting case.
It is my understanding that the cities of Antioch and Oakley have formally petitioned for intervention
status on the Contra Costa Power Plant Project — Unit 8 to ensure that concerns of those
communities are considered by the CEC in reviewing the project. I believe that, since the project
is actually located in the unincorporated area, Contra Costa County should seek a similar status
with the CEC. I recommend the Board of Supervisors authorize the Community Development
Director to formally file a petition for intervention status with the CEC on the Contra Costa Power
Project - Unit 8 to ensure that concerns of Contra Costa County are considered in this case.
