FISCAL IMPACT: $10, 000, if the County does the abatement. BACKGROUND/REASONS FOR RECOMMENDATIONS: A complaint was received regarding a substandard building and junkyard conditions. A site inspection revealed junkyard conditions consisting of debris, scrap metal, storage containers, tractors, and barrels of unknown substance. On December 28, 2000 a Notice to Comply letter was mailed to the owner. The site is in violation of the following County ordinances: Title 7, Chapter .712-2 . 004 & Uniform Housing Code 1001.0 (Substandard Building) Title 8, Chapter 82-2 .006 (Maintaining an illegal junkyard) The owner of the property has been notified of the violation(s) through written correspondence and certified mail. As of this date, compliance has not been gained. On January 29, 2001, the Building Inspection Department declared the property a public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6. This appeal is being made under the provisions of this title. This appeal is based upon the following facts: 1. The property which the county seeks to abate does not contain junkyard conditions,.-and is therefore not in violation of County ordinances and other codes. 2. The notice issued by the county on December 28, 2000 was untimely in that the permit which was only finally issued on July 12, 2000 was not due to expire until January 12, 2001. This was due to the fact that the county-wpired two permits and two payments. Ahold was placed on the property after the first payment on June 19, and the permit was not fully issued until the second permit was taken and paid for on July 12. 3. There are no inoperable vehicles nor cargo containers on the property. .J 4.
