HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA TO: BOARD OF COMMISSIONERS FROM: Robert McEwan, Executive Director DATE: APRIL 10, 2001 SUBJECT: CONTRACT WITH THE COUNTY OF CONTRA COSTA OFFICE OF THE SHERIFF SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: APPROVE and AUTHORIZE the Executive Director of the Housing Authority to execute a contract, on behalf of the Housing Authority with the County of Contra Costa Office of the Sheriff to provide dedicated security personnel at Housing Authority Projects for up to $198,552 for the period January 1,2001 to December 31, 2001. II. FINANCIAL IMPACT: Funds for this contract are budgeted under the Authority's Public Housing Drug Elimination Program. No County General Funds are required. The Office of the Sheriff has been providing these dedicated security services for the past nine (9) years. This contract reflects increased personnel costs. III. REASONS FOR RECOMMENDATION/BACKGROUND For several years the Office of the Sheriff has provided two full time Deputy Sheriffs to fulfill community policing duties at the Las Deltas and Bayo Vista Housing Housing Developments. These are allowable costs under the federal Housing and Urban Developments guidelines. The Deputies provide an opportunity for residents to participate in crime prevention, to provide them with an enhanced sence of security and to maximize enforcement of laws regarding sale and use of illegal drugs. IV. CONSEQUENCES OF NEGATIVE ACTION: The Office of the Sheriff would not have sufficient resources to provide enhanced security services at the Las Deltas and Bayo Vista Housing Develpments. Parties and Effective Date: Effective January 1,2001;the Housing Authority of the County of Contra Costa, a public body,corporate and politic (hereinafter called "Agency"),and Contra Costa County Office of the Sheriff (hereinafter called "Sheriff") mutually agree as follows: Authority: This agreement is funded under the Agency's Drug Elimination Grant (PHDEP) funds provided by the U.S. Department of Housing and Urban Development (42 U.S.0 3535(d) and 11901 et seq.). Purpose of Contract: This agreement is to eliminate drug-related and violate crime and problems associated with it at the Las Delta and Bayo Vista Public Housing Developments. Term: The term of this agreement shall be for one year. Unless renewed,the agreement will terminate December 31,2001. 2. Sheriff's Obligations (Scope of Services): (a) The Sheriff will assign two full time Deputies to the Project Pride Program operating out of the Las Deltas Public Housing Development located at 1601 North jade Street in North Richmond and the Bayo Vista Public Housing Development located at #2 California Street, Rodeo. Each Deputy will work a forty-hour a week work shift on-site at their assigned area of responsibility. The Deputies will be under the supervision of the Sheriffs Bay Station Commander. (b) While on site,the Deputies will implement a Community Oriented Policing Program. Within the framework of Community Oriented Policing,the deputies will: ■ Make every effort to become an integral part of the Las Deltas and Bayo Vista Community. ■ Exchange accurate information about crime,the community and the goals of policing with residents. ■ Provide residents with an increased sense of police care,and build trust and harmony between residents and the Sheriffs Office. ■ Engage both residents and police in the mutual identification and resolution of issues of crime and disorder. ■ Reduce the fear of crime,and enhance the quality of life in Las Deltas and Bayo Vista. The Deputies will continue the D.A.R.E. program in conjunction with the local school district that will specifically target the youth that live in the Las Deltas Public Housing Development. (c) The Deputies will work with other units in the Contra Costa County Office of the Sheriff to maximize enforcement strategies directed specifically against the use and sale of illegal drugs in Las Deltas and Bayo Vista. Page 1 of 3 (d) The Sheriff's Office will provide the Agency with (1) monthly program reports which describe the activities conducted by the Deputies at Las Deltas and Bayo Vista during the month; (2) quarterly statistical reports and analysis measuring increases or decreases in the number of reported incidents of crime in North Richmond and Las Deltas and in Rodeo and Bayo Vista;and (3) a final statistical year end report and analysis of the program which documents the extent to which incidents of reported crime increased or decreased in North Richmond and Las Deltas and Rodeo and Bayo Vista. 3. Compensation: In consideration of the provision of services as described in Section 3 above,the Agency shall pay the Sheriff a sum not to exceed $198,552 per year. 4. Billing and Payment: The Sheriff shall submit to the Agency a properly documented demand for payment monthly, in the form and manner prescribed by Agency. The payment demand shall not exceed the equivalent to 1/12 of the total compensation identified in Section 3 above. Hence payment shall be base upon services actually rendered. 5. Independent Contractor Status: This contract is by and between two independent contractors and is not intended and shall not be construed to create a relationship of agent, servant,employee, partnership,joint venture or association. 6. Subcontract and Assignment: The Office of the Sheriff shall not subcontract any of the services or assign any rights or obligations under this contract without prior written consent of the Agency. 7. Records: The Sheriff shall at all times keep a complete and thorough record of the time expended and services performed on behalf of Agency and shall also make available to Agency for audit all such records maintained. 8. Indemnification: County shall defend,indemnify, save,and hold harmless Agency and all its officers and employees from all liabilities and claims for damage for death, sickness or injury to persons or property,including,without limitation,all consequential damages from any cause whatsoever arising from or connected with operations or the services rendered Agency hereunder and resulting from the conduct negligent or otherwise of officers,agents or employees. 9. Insurance: The Sheriff's Office is self-insured and will immediately advise the Agency if it ceases to be self-insured. 10.Restrictions: Pursuant to Government Code section 6509,the powers of the parties under this contract shall be subject to the restrictions on such powers applicable to the Sheriff. 11.Termination: This contract may be terminated by either party,at its sole discretion, upon thirty (30) days of written notice to the other party.
