RECOMMENDED ACTION: DETERMINE that the Maritime Business Park (Praxis) Properties Acquisition is a California Environmental Quality Act (CEQA) Class 13 Categorical Exemption, and DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk. AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to Community Development for processing,.and a $25 fee to the County Clerk for filing the Notice of Exemption. Work Order No. 8372. CDD-CP#01-02 DATE: March 6, 2001 PAGE: 2 II. FINANCIAL IMPACT: The estimated project cost is $385,000.00 funded by Grant funds (100%). Ill. REASONS FOR RECOMMENDATION/BACKGROUND: The purpose of the approval of the CEQA document is to allow the Board of Supervisors (acting as the Governing Board for the Contra Costa County Flood Control and Water Conservation District)the option to acquire the Maritime Business Park (Praxis property). Approval of this CEQA document does not commit or obligate the Board of Supervisors to acquire the properties. The acquisition of the land, which consists of two parcels (APN#159-310-030 & APN#159-310-031) (approximately 120 acres) will allow for restoration of wetlands and habitat for fish and wildlife. The properties, if acquired, will be restored by the Contra Costa County Flood Control and Water Conservation District (District) as a mitigation site for future flood control projects in the Walnut Creek area. These flood control restoration projects are still undefined and will be addressed in separate CEQA documents in the future. The District is working collaboratively with the Muir Heritage Land Trust (Land Trust) and East Bay Regional Park District (EBRPD) to acquire and restore the properties. The properties have been tax delinquent for several years and the owner (Maritime Business Park) has abandoned the properties and all interest in them. The Tax Collector has agreed to release the properties to the District via a Chapter 8 tax delinquency sale. The Land Trust will use grant money to finance the acquisition on behalf of the District. The District will restore the land to improve wetland and fish/wildlife values, and the EBRPD will create a staging area and connections to a regional trail system for recreation purposes. The exact nature of the restoration and recreational improvements has not yet been determined. A separate CEQA document to address them will be prepared in the future The project has been determined to be in compliance with the General Plan and is exempt from CEQA. The project consists of the acquisition of land for fish and wildlife conservation purposes (Sec. 15313). IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay in acquisition and may jeopardize funding.
