The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330, et. seq. A description of the portion to be
vacated is described in Exhibit "A" and shown as Exhibit "B" attached hereto and incorporated
herein by reference.
This vacation request is for an excess right of way of a street not required for street
purposes. (S. & H. Code Section 8334).

This Board hereby FINDS that the proposed vacation will not have a significant effect on
the environment, and that it has beenldetermined to be exempt from the California Environmental
Quality Act under State CEQA guidelines Section 15061 (b)(3) and DIRECTS the Director of
Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the
Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for
filing and a $25.00 fee to Community Development for processing of the Notice of Exemption. This
Board having considered the general plan, FINDS pursuant to Government Code Section 65402
that in accordance with its Resolution No. 81/522; this vacation is minor in nature and therefore
exempt from general plan conformance review.
This Board declares that the Hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes
a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the
Streets and Highways Code, the easement and right at any time, or from time to
time, to construct, enlarge, maintain, operate, replace, remove, and renew those
existing and in place utilities, as of the date of recording this instrument, in, upon,
over and across any highway or part thereof proposed to be abandoned,

This activity is not subject to the California Environmental Quality Act (CEQA)
pursuant to Article 5, Section 15061 (b) (3) of the CEQA Guidelines.
It can be seen with certainty that there is no possibility that the activity may have a
significant adverse effect on the environment.
DESCRIPTION OF THE ACTIVITY:
The activity consists of the vacation of the existing right of way and acceptance of a new
deed that correctly describes the actual roadway (approx. 40' by 5,390'). The original deed
is too old to update, therefore the applicant must correct the legal description on the
existing deed where portions of the paved right of way deviate by creating a new deed with
the corrected legal description. In order to accept the new deed, which describes the
actual roadway, Contra Costa County needs to summarily vacate the existing right of way
and quitclaim it with the corrected legal description.
LOCATION:
The project is located on Marciel Road, north of Highland .Road, in south county, in the
Tassajara area. (Figures 1 —4).

Community Development staff has reviewed the attached project, CP 00- to
determine if mandatory referral for General Plan Conformance, as required by Section
65402 of the Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
( ) This project has been determined to be exempt from 65402 review.
M This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.
