(2nd bidder) having submitted a letter protesting the lowest bid by Arntz, and the Board having considered the bid protest; and The Contract Compliance Officer having evaluated all of the documentation of good faith effort submitted by Arntz and having reported that Arntz has complied with the requirements of the County's Outreach Program; and The County Administrator recommending that the bid submitted by Arntz is the lowest responsive and responsible bid, and this Board concurring and so finding; AWARD OF CONTRACT FOR JUVENILE HALL ADDITION, 202 GLACIER DRIVE, MARTINEZ March 27, 2001 NOW, THEREFORE, the Board finds, determines and orders as follows: The Board DETERMINES that the bid protest filed by McCarthy is without merit and OVERRULES the protest; and The Board FURTHER DETERMINES that Arntz, as the lowest responsive and responsible bidder, has complied with the project specifications and the requirements of the County's Outreach Program, and the Board WAIVES any irregularities in such compliance; and The Board ORDERS that the contract for the furnishing of labor and materials for said work is awarded to Arntz at the listed amount (Base Bid, Alternate No. 1, and Alternate No. 2) and at the unit prices submitted in said bid, and that said contractor shall present two good and sufficient surety bonds as indicated above, and that the County Administrator shall prepare the contract therefor; and The Board FURTHER ORDERS that, after the contractor has signed the contract and returned it, together with the bonds as noted above and any required certificates of insurance or other required documents, and the County Administrator has reviewed and found them to be sufficient, the County Administrator or his designee is authorized to sign the contract for this Board; and The Board FURTHER ORDERS that, in accordance with the project specifications and/or upon signature of the contract by the County Administrator or his designee, any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and The Board FURTHER ORDERS that the County Administrator or his designee is authorized to sign any escrow agreements prepared for this project to permit the direct payment of retentions into escrow or the substitution of securities for withheld funds, pursuant to Section 22300 of the Public Contract Code; and Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code Sections 4107 and 4110 to the County Administrator or his designee; and Pursuant to Labor Code Section 6705, the Board FURTHER DELEGATES to any registered civil or structural engineer employed by the County the authority to accept detailed plans showing the design of shoring, bracing, sloping or other provisions to be made for worker protection during trench excavation covered by that section; and The Board DECLARES that, should the award of the contract to Arntz be invalidated for any reason, the Board would not in any event have awarded the contract to any other bidder, but instead would have exercised its discretion to reject all of the bids received. (Via March 27, 2001 CAO) Surety (Via CAO) Kaplan McLaughlin Diaz (Via CAO) g Deputy O'Brien Kreitzberg (Via CAO) Probation Department (Via CAO) -3- ADDENDUM TO ITEM D. 2 March 27, 2001 On this date, the Board of Supervisors considered the following actions regarding the Juvenile Hall Addition Project, 202 Glacier Drive, Martinez: (1)Award contract to the lowest responsible bidder (Amtz Builders), who has met the requirements of the County's Outreach Program, and overrule bid protest from the second bidder(McCarthy Building Construction, Inc.); or(2) reject all bids and direct rebidding of the project; and (3) other appropriate action. George Roemer, Senior Deputy County Administrator, presented the staff report. Also present were Silvano Marchesi, County Counsel, Steven Bautista, County Probation Officer and Mark Tortorich, O'Brien Kreitzberg. The Board discussed the matter. Following that discussion, Supervisor Gioia made the following motion: Overrule the bid protest from McCarthy Building Construction, Inc; award the contract to Arntz Builders at the bid price; direct staff to enter into negotiations to add a "labor harmony clause" to the contract; and to return the clause to the Board for their consideration. Supervisor DeSaulnier advised the Board that he would not be supporting the motion and suggested the County go out to rebid the project. If the motion passed, he stated he would like to see that the project would not be delayed. Supervisor Glover seconded the motion. Supervisor Gerber stated she was concerned about the project costs, and the potential delay once the project had begun. She proposed a substitute motion to rebid the project. Supervisor DeSaulnier seconded the substitute motion. Supervisors Gioia and Uilkema commented on the possible loss of federal funds that would occur if the project were delayed. Supervisor Uilkema further noted that she would not be supporting the substitute motion, and urged the Board to support the project today. It was expressed by Supervisor Glover that he was supportive of accepting the bid today. I—ARNTZ BUILDERS EXPERIENCE Arntz Builders is a family owned and operated construction company. The current principles are second generation contractors operating in the Bay Area. As you can see from the attached list of projects completed and in progress, the Arntz family has a long track record of construction of public works projects in the Bay Area. Some of the major on-going or recently completed projects are as follows: F ercules Middle/High School - $30,000,000 Berkeley Central Library Expansion- $21,000,000 Berk-elev High School Milvia Street Buildings - $29,500,000 "gravis Air Force Base Shopping Center - $18,000,000 Juvenile Hall Housing Replacement, Santa Clara County - $12,000,000 Probably of most interest to you would be the Juvenile Hall Housing Replacement for Santa Clara County. We therefore have included tl-iree letters of recommendation emanating from that project. Two of them are from the owners and one is from Vanir Construction Management. Arntz Builders feels that it is fully capable of building the subject project and doing so on schedule. II—COMPETIVENESS We have heard that the bid of Arntz Builders is approximately $2,000,000 over the County's budget. We can assure you that the owners received abundant ,competition I ' Page Two through the bidding process on this project. There were eight general contractor bids submitted. Arntz Builders received one hundred eighty two subcontractor bids on the thirty-four major subcontractor categories. This averages out to 5.7 subcontractor bids per major subcontractor category. (See attached recap of subcontractor bids received). This is a very substantial amount of subcontractor participation which should be reassuring to the owners that competitive prices j were obtained. Additionally, this bid took place during the winter months when traditionally the construction industry is somewhat slower than in the spring and summer. This should have added to the competitiveness of the market place. If the Board were to decide to reject all bids and put this project out for re-bid, it is our opinion that this would most likely result in fewer subcontract bids received resulting in a higher price as opposed to any cost savings. Even though the economy in general appears to have slowed down somewhat in recent times, this has not translated into a slow-down in the public sector construction industry. It is our opinion that the bid presented by Arntz Builders represents a competitive price that will not be bettered if the County decides to re-bid this project. III—UNION PARTICIPATION We have been advised that there have been complaints by Unions representing the Electricians and Masons regarding our use of Helix Electric and Grossen Company (masonry). Firstly, Arntz Builders is a Union contractor signatory to the Laborers and Carpenters. Additionally, we'd like to point out that Amtz Builders gave every opportunity to Union contractors to obtain the subcontracts for this project. In fact in the vast majority of cases, Arntz Builders is awarding to Union subcontractors. Of the thirty-four major categories, Arntz has only selected four subcontractors that will be using non-union site labor. The major non-union subcontractor listed by Arntz Builders is Helix Electric. It should be pointed out that Helix Electric was listed by the three lowest general contractors. It should also be noted that Arntz Builders received nine electrical bids of which at least six were from Union electrical subcontractors. Union electrical subcontractors were given ample opportunity to bid this work under fair bid practices. Helix Electric was, simply, more competively priced and the savings are being passed on to the County. Additionally Helix will be hiring locally. It should be noted that irrespective of a subcontractor's union status, all site workers must be paid prevailing wage and Arntz Builders guarantees that this will transpire. i Page Three Helix Electric is a large, capable firm and Arntz Builders is currently doing the Berkeley Central Library Expansion project with them. Helix Electric's representative, Arthur Geller, is planning to attend the Board meeting and can answer any concerns you may have as to their qualifications. As to our subcontractor for the masonry work Grossen Company, they will only be using non-union bricklayers but will be using Union hod carriers. Again it is Grossen's as well as Arntz Builders obligation to ensure that these workers are paid the prevailing wages in compliance with the laws of the State of California. As with the electrical, the union masonry contractors had ample opportunity to obtain the subcontract for this work. We received 7 masonry bids, of which at least, four are union subcontractors. Simply put, Grossen Company is offering the best price and the cost savings have been passed on to the County. To put the whole union issue in perspective, the County will be paying only four percent of the $26,784,000 to non-union, on-site workers. The vast majority of the work on the project will be performed by union workers. In closing we urge the Board to make award per our bid and in doing so we believe they should feel confident that they are obtaining a competitively bid project that will be performed by capable and responsible contractors, the vast majority of which are signatory to the unions. The building posed particular challenges, as the site was very constricted and immediately adjacent to an existing twenty-four hour detention facility. The contract period began with a partnership workshop involving all of the stakeholders. This set the stage for the successful completion of the building, which was fully occupied in December of 1998. We are in the last stages of "commissioning" the building and completing a small number of remaining punch list items. Our primary contacts have been Don Arntz and on-site Superintendent Jim Killmon. This was not our first experience with a major construction project. In dealing with Arntz, we found them to be fair and willing to negotiate a reasonable solution for both parties for a given problem.
