BACKGROUND/REASON(S) FOR RECOMMENDATION(S): SB 253 (Perata) would establish eligibility for reconstruction of the Richmond Health Clinic for financing under the provision of §14085.5 of the Welfare and Institutions Code. This would generate a state and federal share of cost for the annual debt service of a new facility. LEGISLATIVE COUNSEL'S DIGEST SB 253, as introduced, Perata. Health facilities: Contra Costa County. Existing law provides for the Medi-Cal program, administered by the State Department of Health Services, under which qualified low-income persons are provided with health care services. Existing law generally defines a disproportionate share hospital as a hospital that has disproportionately higher costs, volume, or services related to the provision of services to Medi-Cal or other low-income patients than the statewide average. Under existing law, an eligible disproportionate share hospital may receive supplemental Medi-Cal reimbursement to defray a portion of the debt service cost for an eligible capital project. The bill would permit Contra Costa County Regional Medical Center to construct or renovate, or both, -any patient care facility, and would permit this construction or renovation, or both, to be considered eligible for supplemental reimbursement if the site meets certain conditions. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no.. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 14085.57 is added to the Welfare and Institutions Code, to read: 14085.57. (a) Contra Costa County Regional Medical Center may construct or renovate, or both, any patient care facility, and any capital project for that construction or renovation, or both, shall be considered eligible for supplemental reimbursement under Section 14085.5, if all of the following conditions are met: (1) The site upon which the facility is constructed is owned or leased by the County of Contra Costa. (2) The final supplemental plans for the capital project or projects are designed to expand the services provided pursuant to the initial capital project for the construction of Contra Costa Regional Medical Center. (3) That initial capital project is eligible for reimbursement under Section 14085.5. (4) The facility built or renovated as a part of the capital project is, or will be, consolidated under the Contra Costa County Regional Medical Center general acute care license, and will be operated by Contra Costa County Regional Medical Center as an adjunct to services in the hospital facility. (5) Final supplemental plans for the capital project are submitted to the Office of Statewide Health Planning and Development on or before December 30, 2001. http://www.leginfo.ca.gov/pubibUYsen/sb 0251-0300/sb 253_bill20010215_introduced.html 3/8/01 SB 253 Senate Bill- INTRODUCED Page 2 of 2 (6) The capital project meets the requirements for eligibility specified in Section 14085.5, as :modified by this section. (b) The final supplemental plans may provide for a capital project with one or more of the following features: (1) Total revision or reconfiguration, or a reduction in size and scope, of an existing patient care facility. (2) Modifications of an existing patient care facility necessary to comply with current seismic safety standards. (3) Expansion of outpatient service facilities. (c) For purposes of calculating supplemental reimbursement pursuant to Section 14085.5 for a capital project complying with this section, the initial Medi-Cal inpatient utilization rate shall be that which is determined at the time of submission of the final supplemental capital project plan. (d) For purposes of determining supplemental reimbursement under Section 14085.5 for a capital project complying with this section, supplemental reimbursement shall be based on actual costs of the capital project eligible for reimbursement under Section 14085.5 as modified by this section. (e) Subject to subdivisions (g) and (h) of Section 14085.5, Contra Costa County Regional Medical Center shall receive supplemental reimbursement under this section for debt service associated with the capital project over the lesser of the following periods: (1) The life of the revenue bonds. (2) The period during which the patient care facility or facilities affected by the capital project is either leased or owned by the County of Contra Costa. SEC. 2.
