Recommended Action: AUTHORIZE the Public Works Director to enter into an agreement with East Bay Regional Park District (EBRPD) for dispersal of the Proposition 12, per capita share monies and APPROVE the recommended disbursement of per capita funds as shown on the attached table. The Proposition 12 monies would be used in park and recreational facilities in the unincorporated areas of Contra Costa County. II. Financial Impact: There is no impact on the General Fund. Reasons for Recommendations and Background: In 2000, the voters of the State of California passed Proposition 12 - the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000. Under Article 4, Grant Program, Section 5096.333, per capita funding section, the bond act allows that "forty percent(40%) of the total funds available be allocated to counties and regional park districts..." and that each county's allocation be the same ratio as the county's population." In accordance with the language of the bond act, EBRPD, Contra Costa County and Alameda County will share the per capita amount allocated by the bond act under Section 5096.333 (b). Monies obtained under the per capita portion of the bond act may be spent for "acquisition, development, improvement, rehabilitation, restoration, enhancement and interpretation of local park and recreational lands and facilities..." The division of the per capita amount must be determined by mutual agreement by March 15, 2001. If an agreement cannot be reached between the affected jurisdictions, then the State Department of Parks and Recreation will "determine the allocation of the grant funds among the affected jurisdictions", Section 5096.332(b)(a). Attached are tables showing unincorporated County population figures and the corresponding per capita funds that are recommended to go to communities with formed service areas or known park and/or recreation facilities. As part of our negotiations with EBRPD, they may consider constructing a new facility in Contra Costa County using the monies generated in areas where there is no formed service area or program in existence. Approval of this Board Order will allow the Public Works Director to negotiate with the EBRPD and enter into an agreement with EBRPD that is mutually agreeable to both parties. IV. Consequences of Negative Action: If a mutual agreement between EBRPD and Contra Costa County cannot be reached by the deadline, then the State will determine the County's share of the per capita portion of the Proposition 12 funds. ti ADDENDUM TO ITEM SD.9 March 13, 2001 On this date, the Board of Supervisors discussed the proposal to authorize the Public Works Director to enter into an agreement with the East Bay Regional Park District for dispersal of Proposition 12, per capita share monies, and to approve the recommended disbursement of per capita funds for the unincorporated areas of Contra Costa County(Countywide) WO 5090. Mitch Avalon, Deputy Director of the Public Works Department, presented the staff report and noted that Proposition 12 per capita distribution was based on the 1990 Census but included population changes from development in the unincorporated areas. The Board discussed the issues. Supervisor Gioia questioned whether the dispersal agreement was for a two year period. Mr. Avalon replied that the agreement covered the per capita disbursement, which he stated he believed to be over a two year period, however, he would verify whether there was one disbursement or there were two disbursements over two years. Following further discussion, Supervisor Gioia expressed concern that a time frame be established to return the monies to the County within a reasonable period, such as 30 days or sooner after they receive the money from the State. He suggested that the Public Works Department get clarification of the dollar amount and requested revisions to the monies if the census numbers justify change. After continued Board discussion, Supervisor Gioia suggested the following motion: to approve the recommendations; that the agreement cover the disbursement of the per capita funds for a two year period; that the Public Works Department work with the Park District to review funding relative to the new census figures; and that the monies be dispersed to the County within 30 days after the Park District receives the money from the State. Supervisor Gerber seconded the motion, and the Board voted unanimously to accept it.
