SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
After hearing the appeal, it is recommended to deny the appeal and affirm the
determinations of the County Abatement Officer and direct the County Abatement
Officer to proceed and perform the work of abatement.
FISCAL IMPACT:'
$16, 500.00 if the County does the abatement.
BACKGROUND/REASONS FOR RECOMMENDATIONS:
On December 29, 1998 a complaint was received regarding the use of a mobile home
as an office trailer. A site inspection on November 12, 1999, revealed a mobile
home is being used as an office trailer. The inspection also revealed that car
parts, inoperable trucks, and general junk are being stored on property. A
Notice to Comply letter was sent on March 8, 1999 . The site is in violation of
the following County ordinances:
Title 8, Chapter 82-2 .006, Land Use Violation: (Office trailer without permits)
Title 8, Chapter 88-4.204, Junkyard conditions
Title 8, Chapter 88-4.402, Junkyard Permit Violation
The owner of the property has been notified of the violation (s) through written
correspondence and certified mail. As of this date, compliance has not been
gained.
On December 13, 2000 the Building Inspection Department declared the property a
public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6.
This appeal is being made under the provisions of this title. The hearing was
opened on February 13, 2001, no one spoke, the Board continued the hearing to
March 13, 2001 at 9:00 a.m.

The public hearing was OPENED; Richard Williams, Attorney for Mr. Brucia, 18 Crow Canyon Court,
#275, San Ramon, appeared to speak; the public hearing was CLOSED. The Board then took the following
action: DENIED the appeal; AFFIRMED the determinations of the County Abatement Officer; and
DIRECTED the County Abatement Officer to proceed and perform the work of the abatement, with an
extension of 60 days to comply.
