(new owner: Kenneth & Patricia Manning) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: After hearing the appeal, it is recommended to deny the appeal and affirm the determinations of the County Abatement Officer and direct the County Abatement Officer to proceed and perform the work of abatement. FISCAL IMPACT: $20, 500, if the County does the abatement. BACKGROUND/REASONS FOR RECOMMENDATIONS: On May 12, 1999 a file was opened regarding junkyard conditions, and running a contractor yard without a Land Use Permit in an A-3 parcel. Items being stored as contractor equipment are: fabric for fencing, non-operable trucks and equipment, truck container, and assorted building materials. Title 8, Chapter 82-2 . 006 (Maintaining illegal mobile homes) Title 7, Chapter 88-4.204 (Junkyards, Declaration of policy) Title 7, Chapter 84-38.4 (A-3, Use Violation) The owner of the property has been notified of the violation(s) through written correspondence and certified mail. As of this date, compliance has not been gained. On January 04, 2001, the Building Inspection Department declared the property a public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6. This appeal is being made under the provisions of this title. When first renting said property, I felt that due to the remote location and heavy agriculture zoning of the land, the equipment and materials I have on the property would not be a violation or concern of the county. Since first being notified of the zoning issue I have removed 90%of the old equipment and materials that were in question. I feel it's unreasonable for the county to demand that I remove any other equipment.or materials. Regarding the zoning issue;since purchasing the property I haven't decided what I want to do with'the property in the future. If you still feel it is necessary please set the matter for hearing.
