TO: BOARD OF SUPERVISORS COSTA Y: FROM: PHIL BATCHELOR, COUNTY ADMINISTRATOR rd °°=� COUNTY DATE: February 6, 2001 SUBJECT: Tax Exchange Agreement for the Proposed Reorganization of the Oakley and Contra Costa Fire Protection Districts SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): ADOPT the attached resolution which determines the tax exchange for the Proposed Reorganization of the Oakley and Contra Costa Fire Protection Districts (LAFC 01-10). The tax exchange is a direct transfer of 100% of the property tax revenue accruing in the affected territory from the Contra Costa Fire Protection District to the Oakley Fire Protection District. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The proposal requests the detachment of +/- 620 acres from the Contra Costa Fire Protection District and concurrent annexation of said territory to the Oakley Fire Protection District. This territory falls within the City of Oakley. The Board of Supervisors acting as the governing board of both districts has requested in Resolution 2001- that LAFCO approve the detachment of the territoryfrom the Contra Costa Fire Protection District and concurrent annexation to the Oakley Fire Protection District. This resolution is a requirement of Section 99.01 of the Revenue and Taxation Code that stipulates jurisdictional changes shall not become effective absent a property tax exchange agreement. Resolution No. 2001/ 62 Proposed Reorganization of the Oakley (OFPD) and (LAFC 01-10) Contra Costa County Fire Protection District (CCCFPD)) WHEREAS, Section 99.01 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been provided previously shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS,the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer for the annexing district; and WHEREAS,the proposed Reorganization of the OFPD and CCCFPD (LAFC 01- 10) 1-10) involves the detachment of territory from the CCCFPD and the concurrent annexation of said territory to the OFPD, which will affect the service responsibilities of the Districts; and WHEREAS,the Board of Supervisors acting as the governing board of the OFPD and CCCFPD has requested that the Local Agency Formation Commission of Contra Costa County concurrently approve the detachment of the territory of the CCCFPD contained within the City of Oakley and approve the annexation of the detached portion to the Bethel Island Fire Protection District; and WHEREAS,the reorganization that involves the detachment of territory from CCCFPD and the concurrent annexation of the territory to the OFPD will result in the transfer of property tax from CCCFPD to the OFPD; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that 100% of the property tax revenue accruing to the CCCFPD from the affected territory shall be transferred to the OFPD for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdiction change. Said transfer shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. Said tax transfer apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the property tax revenue accruing to other agencies serving the subject territory or the affected districts' right to collect taxes for existing bonded indebtedness.
