The Board of Supervisors of Contra Costa County, as the Governing Body of the Contra Costa
County Flood Control and Water Conservation District, RESOLVES THAT;
The Contra Costa County Flood Control and Water Conservation District Act, hereinafter referred to
as "Act," provides authority for said Governing Body to establish and amend drainage areas, institute
drainage plans therefor, and adopt drainage fee ordinances.
This Board has before it for consideration proposed Amendment No. 1 to the adopted Plan for
Drainage Area 107 and Amendment No. 2 to the adopted plan for Flood Control Zone 1.
This Board also has before it the Engineer's Report entitled, "Amendment No. 1 to the Regional
Drainage Plan for Contra Costa County Flood Control and Water Conservation District Drainage Area
107 and Amendment No. 2 to Flood Control Zone 1 Adopted Plan" dated June 2000. Said document
which gives a general location of said drainage area, provides a description of the proposed
amendments, and provides an estimate of the cost of the facilities to be home by property in the drainage
area, is on file with, and may be examined at the office of the Clerk of the Board of Supervisors,
Administration Building, Martinez, California.
It is proposed that the adopted plan for Drainage Area 107 be amended to add two detention basins
and that the adopted plan for Zone 1 be amended to provide for maintenance of said basins.
At 1:00 p.m. on September 12, 2000, in the Chambers of the Board of Supervisors, Administration
Building, Martinez, California, this Board will conduct a public hearing on the proposed amendments.
At said hearing, this Board will consider and act upon the determination of environmental exemption for
this action and will hear and pass upon any and all written or oral objections to the amendments. Upon
conclusion of the hearing, the Board may abandon the proposed actions, or proceed with the same.

6066, once a week for two (2) successive weeks prior to the hearing in the Brentwood News, a
newspaper of general circulation, circulated in the area of Drainage Area 107 and Flood Control Zone
1. Publication shall be completed at least seven (7) days before said hearing and said notice shall be
given for a period of not less than twenty (20) days.
The exterior boundaries of Drainage Area 107 and Zone 1 include lands within the Cities of Antioch,
Brentwood, and Oakley. The Clerk of this Board is DIRECTED to forward to the governing body of said
Cities a copy of this Resolution at least twenty (20) days before the above noted hearing.
The Clerk of the Board is further DIRECTED to mail a copy of the Notice of Public Hearing to any
interested party who has filed a written request for mailed notice with the Clerk of the Board or with the
District, as provided by Government Code Section 54986 (a) and 54992 (1). Said mailing shall be
performed at least fourteen (14) days prior to the hearing.

NOTICE OF PUBLIC HEADING
The Board of Supervisors, as the Governing Body of the Contra Costa County Flood Control
and Water Conservation District, has set 9:00 a.m. on September-12, 2000, Administration
Building, 651 Pine Street, Martinez, California 94553, as the time and place for a hearing on
proposed Amendment No. 1 to the adopted plan for drainage Area 107 and Amendment No. 2
to the Adopted Plan for Flood Control Zone 1.
The amendments provide for the construction and maintenance of two additional detention
basins in the Marsh Greek system.
The Engineer's report, a plan showing the location of two new detention basins, and
environmental documents are on file and available for inspection at the Flood Control District
Office, 255 Glacier Drive, Martinez, California, 94553, or at the office of the Clerk of the Board of
Supervisors.
At the public hearing, the Board will consider all written and oral comments on the proposed
action, and either approve the proposed action, continue the proceedings, or abandon the
proposed action.

I. Recommendation
A. Adopt the Drainage Plan shown on FCD drawing D-12628.2, thereby, amending FCD
drawing D-12628.1 for Drainage Area 107; and
B. Adopt the Drainage Plan shown on FCD drawings D-3141.1 and D-3142.1, thereby
amending drawings D-3141 and D-3142 for Flood Control Zone 1.
C. Determine that the activity will not have a significant effect on the environment, and is not
subject to the California Environmental Quality Act (CEQA) pursuant to Article 5, Section
15061(b)(3) of the CEQA Guidelines.
11. Drainage Area Location and Description:
Drainage Area 107 is located in the middle portion of the Marsh Creek Watershed (Flood
Control Zone 1), south and west of Brentwood. A major portion (80%) of Drainage Area
107 drains to Marsh Creek upstream of Marsh Creek Dam. The remaining portion (20%)
drains to Marsh Creek downstream of Marsh Creek Dam. The northern half of this area
is being developed within the City of Brentwood.
III. Background and Reasons for Amendments
As agricultural land develops, a much larger portion of the total rainfall reaches the creek
or channel due to its inability to infiltrate. This increase in storm water runoff degrades
the level of flood protection provided by the existing Marsh Creek flood control
improvements. Also, as the watershed gradually converts from agricultural uses to urban
uses, the level of flood protection should be increased to protect against damages from a
100-year storm event rather than a 50-year storm which was the design standard for the
existing facilities. The 100-year storm event criteria is consistent with the requirements of
the federal flood insurance program and local ordinances.
Drainage Areas 104, 105, 106, 107 and 108 were adopted in August 1990, by the Contra
Costa County Board of Supervisors to address the accumulative hydrologic impact from
urbanization in the Marsh Creek watershed. At that time no portion of Drainage Area 107
was within the city limits of Brentwood and there was no development proposed in
Drainage Area 107. Since then, the City of Brentwood has annexed a portion of the
drainage area and has approved the construction of Subdivision No. 7940. The City
conditioned the development to construct two detention basins to mitigate the
accumulative hydrologic impact from the development. The developer is proceeding with
the construction of the two detention basins. The purpose of this plan amendment is to
add the two basins to the adopted plan so that the developer can receive credit for the
detention basin construction against his drainage fee obligation and to provide for future
maintenance of the detention basins by Flood Control Zone 1.
IV. Hydraulic Criteria
The goal for the Marsh Creek detention basin system (seven basins) is to limit the flows
in Marsh Creek downstream of the Sand Creek junction to less than 2300 cubic feet per
second.
The two basins being constructed by Subdivision 7940 will bring the total number of
basins in the system to nine. The new basins will regulate the runoff into Marsh Creek
from Subdivision 7940 to less than the amount of runoff that would occur if the land were
not urbanized. The detention basins are not growth inducing in that they serve a limited
area consisting of basically the development area of Subdivision 7940. A detail
hydrology and hydraulic analysis is contained in the report "Drainage Area 107
Brentwood — Hydrology— Hydraulic Analysis for Proposed Detention Basins91 dated June
1999.
V. Proposed Basin Sites
The proposed detention basins are located in a golf course which is an integral part of
Subdivision 7940. Collectively, they will store approximately 35 acre —feet of excess
storm water during the 6 hour 100-year storm event. One of the basins will function as a
permanent lake for the golf course. The other will flood several fairways during storm
events.
VI. Cost Estimate
A cost estimate of the proposed improvement is shown in Exhibit A. The estimated total
cost of the two basins is $712,000 including land cost. The net regional share of the cost
is $356,000 (50%) plus $18,000 for engineering and administration. The existing
Drainage Fees for the Marsh Creek.Drainage Areas will not have to be increased to
cover these costs.

The Board of Supervisors of Contra Costa County, as the Governing Body of the Contra Costa
County Flood Control and Water Conservation District, RESOLVES THAT:
On July 18, 2000, this Board adopted a Resolution proposing to amend the adopted plans for
Drainage Area 107 and Flood Control Zone 1.
On September 12, 2000, pursuant to the Board's Resolution of July 18, 2000, this Board held a
hearing to consider the proposed plan amendments. All written and oral objections presented
concerning the proposed plan amendments were considered.
This Board FINDS that any valid written protests fled do not represent more than one-half of the
assessed valuation of real property contained in the drainage area This Board also FINDS that no
written petition for an election, signed by at least 25 percent of the registered voters within the drainage
area has been filed.
It appears from the affidavits of publication on file with this Board that all notices required to be given
for such a hearing have been duly and regularly given and all procedures to be followed have been
followed, all in accordance with Sections 11 and 12.3 of the Contra Costa County Flood Control and
Water Conservation District Act.
This Board has received no resolution or ordinance adopted by an affected city.
The Board DETERMINES that the activity will not have a significant effect on the environment, and
is not subject to the California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061
(b)(3) of the CEQA Guidelines.
This Board hereby also FINDS that good cause exists for the amendments to the Drainage Area 107
and Zone 1 plans. The drainage plans, as shown on Flood Control District Drawings D-12628.2, D-
3141.1 and D-3142.1 proposed to be instituted for the drainage area and zone respectively, and on file
with the Clerk of the Board of Supervisors, Administration Building, Martinez, California are hereby
INSTITUTED.

III BACKGROUND/REASON(5� FOR RECOMMENDATION(S).
Article 42-2.4 of the County Ordinance Code establishes the Emergency Services Policy Board,
its membership, purposes and duties. The Board assists and advises the County Administrator
on emergency preparedness planning efforts and coordination of those planning efforts
throughout the County. Membership includes senior managers from several County Agencies and
other governmental organizations with Countywide responsibilities which would be involved in
responding to emergency situations. Two additional members are proposed to broaden the
expertise on the Policy Board: The County Director of Information Technology and a
representative from the Public Managers Association.
IV. CONSEQUENCES OF NEGATIVE ACTION:
The Emergency Services Policy Board would continue to function, however, the aditional
expertise available from these two positions would not be available during Board Meetings and
deliberations.

(a)Purpose. The Operational Area Council is created as an advisory council to the
Emergency Services Policy Board. The Operational Area Council consists of emergency
managers from incorporated cities, special districts,key utilities and businesses and staff of
the Sheriffs Office, Office of Emergency Services.
(b)Duties. The Operational Area Council discusses and considers countywide emergency
management areas and issues and makes recommendations thereon to the Emergency
Services Policy Board through the Office of Emergency Services.
(c)Meetings. The Operational Area Council meets quarterly when a date and time are
fixed by the emergency services director or otherwise as requested by any of the member
agencies.
SECTION 111. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage,
and within 15 days after passage shall be published once with the names of the Supervisors voting
and against it in the Contra Costa Times,a newspaper published in this County.
