BACKGROUND: One of the sections of the County's Election Campaign Ordinance is Section 11.530- 2.902, Disclosure of contributors to independent expenditure committees. This section requires that the names and occupations of individuals and the names and business interests of non-individuals of the five largest contributors to an independent expenditure mailing be listed on the mass mailing under the heading: "Major funding The section then goes on to describe that the disclosure of contributors must be on the front of the mailing, in what size type and other details of hove to accomplish the disclosure of information. The purpose of this disclosure is to inform the public as to who and/or what interests are behind the mailings. In the March 2444 primary election;independent expenditure mass mailings regarding the District 3 Supervisor campaign were funded by an independent committee without a listing of the five largest contributors. Apparently,the independent committee had discovered a loophole in the county's existing ordinance. If the committee was set up after a late reporting period,they could avoid listing their contributors on the mass mailing and there would not be an FPPC contribution report until well after the election (in this case July 31, 2444). This loophole is closed by the amendments shown in the attached. This is the only amendment proposed. ORDINANCE NO. 2000- (Amendments to Division 530 Election Campaign) The Contra Costa County Board of Supervisors ordains as follows(omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code). SECTION 1. SUMMARY. This ordinance amends Division 5301, Election Campaign, section 530-2.902 to modify the time period for which an independent expenditure committee must disclose its five largest contributors on the front of a mass mailing. SECTION H. Section 530-2.902 is amended to read: 530-2.902 Disclosure of contributors to independent expenditure committees. (a)Any committee that makes, during the calendar year in which the election is held, more than one thousand dollars in independent expenditures for or against a candidate for county office or more than five thousand dollars in independent expenditures for or against the qualification, or passage, of a local ballot measure being voted on only in this county shall list the following information in a clear and legible manner on the bottom one-third of the front page of any mass mailing(delivered to residences by any means including hand delivery)by the committee in the election for which the independent expenditures were made. (1)The names and occupations of individuals and the names and business interests of non individuals, of the five largest contributors to the committee during the twelve months � c� .€��b ���� � , � listed in order of the amount of contributions. If two or more of the largest contributors have contributed the same amount,they shall be listed according to chronological sequence of contribution. The disclosure shall read: "Major funding by: (name and occupation or business interest)". In the case of contributions from committees,the disclosure shall read: "Major funding by: (name of committee); Expenditures directed by: (name and occupation or business interest of persons or non-individuals who direct or control the expenditures of the committee)"; and (2) If the committee has received at least one third of its total contributions during the twelve months F. most recen..', rting period ..a ­ dh pr 0 00 0 i,„ dt of dfrom large out-of county contributor(s), the whole top one third of the disclosure shall state"Major funding from large out-of-county contributors.” "Large out-of-county contributors"means(a)those contributors 4who either are not residents of the county or do not have a principal place of business in the county and(b) whose cumulative contributions to the committee are one hundred dollars or more for the twelve month period . Wft a to of dXst u � 0 M i tt 1 (b)When making the disclosures required in subsection(a)(1), the committee must use the same type size for all words in that disclosure. When making the disclosures required in subsection(a)(2),the committee must use the same type size for all words in that disclosure. The left and right and top and bottom margins of the disclosures shall not exceed one-half inch. The space between lines of type shall not be more than one half of the type size. The committee must list each contributor on a new line. The committee shall use the bottom one-third of the front page of the mass mailing solely for the purpose of making the disclosure required in subsection(a). (c)For purposes of this section "front page"shall mean the envelope,page, or panel where the address is, or in the case of unaddressed items, any outside panel. (d)This section does not apply to communications from an organization to its members. (Orris. 2000- , § 2, 98-6, 95-8.) SECTION III. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of supervisors voting for and against it in the a newspaper published in this County.
