RECOMMENDATION:
APPROVE and AUTHORIZE the Assistant Risk Manager — Workers' Compensation to amend
the Short Form Service Contract with Essential Staffing, Inc. to increase the payment amount by
$75,000 to a total $150,000 limit for additional consulting services and workers' compensation
staffing services with no change in contract termination date.
FINANCIAL IMPACT:
Costs for workers' compensation claims administration services are funded through the
Workers' Compensation Self-insurance Trust Fund.
BACKGROUND/REASONS FOR RECOMMENDATION:
Essential Staffing, Inc. is a firm with special skills involving workers' compensation claims
services and has provided services to the County since January 5, 1998. The current need for
amending the contract is one of our claims adjusters suffers from a serious medical condition
and to date has missed six weeks of work. Another adjuster sustained injuries in an accident
and it is anticipated she will be out an additional four months. We are also staffing for a vacancy
due to an adjuster on leave to the Human Resources Department.

George C. Beckwith for legal defense services from May 1, 2000 through April 80, 2001 at a
rate of$125 per hour.
FINANCIAL IMPACT:
Costs for legal defense services under this contract are funded through the Self-Insurance
General Liability Trust Fund.
BACKGROUND/REASONS FOR RECOMMENDATION:
Mr. Beckwith is being hired as separate counsel to represent Cliff Hansen individually in the
case of Hasan vs. Contra Costa County (U.S. District Court Case No. C99-0084 WHO).

RECOMMENDATION:
APPROVE and AUTHORIZE the Chief Assistant County Administrator (Acting Risk Manager) to
execute a renewal contract with Skamser and Associates for consultation and technical
assistance on the County's Americans with Disabilities Act (ADA) Program in an amount not to
exceed $60,000.
FINANCIAL IMPACT:
Costs for consultation and technical assistance are funded through the Workers' Compensation
Self-insurance Trust Fund.
BACKGROUND/REASONS FOR RECOMMENDATION:
The Americans with Disabilities Act provides protection against discrimination to disabled
individuals. The Act prohibits discrimination on the basis of disability in employment, public
services and public accommodations. The Act makes employment discrimination against
qualified individuals with a disability unlawful. It prohibits discrimination in training, promotion,
retention and other aspects of employment and requires employers to provide reasonable
accommodation to qualified disabled employees and applicants for employment.

Skamser & Associates provides assistance on finalizing the bank of essential functions job
descriptions; assists departments in developing and modifying essential functions for testing; provides
consultation on modification to existing policies affected by ADA and related law; trains staff on
various ADA related issues including accommodation, hiring and sensitivity training; provides
assistance to departments and Human Resources on hiring issues related to individuals with
disabilities. Skamser & Associates also provides ongoing consultation on a case by case basis on
accommodation for existing staff with disabilities, provides consultation and interacts with County
Counsel on litigation issues, and is developing a system for the identification of employees being
provided job modification and a system for the assessment and response to requests for
accommodation. The contract with Skamser & Associates is for the six-month period, July 1, 2000
through December 31, 2000, at an hourly rate of $60. During that time, the consultative services will
be monitored and evaluated.

RECOMMENDATIONS
APPROVE and AUTHORIZE the Chairperson of the Board of Supervisors to execute a Cooperative Agreement
with the City of Oakley for participation in the Contra Costa County Mortgage Credit Certificate(MCC)
program.
FISCAL IMPACT
None.No General Fund monies are involved. All costs associated with the issuance and administration of this
program is paid through fees assessed of program participants,
BACKGROUND/REASONS FOR RECOMMENDATIONS
Contra Costa County began operation of a MCC program in June 1991. MCCs are an alternative means of
assisting low and moderate-income first-time homebuyers in achieving home ownership. The Contra Costa
County MCC program has provided assistance to over 2,000 households. Recipients of a MCC are eligible for
an income tax credit from the federal government that effectively reduces their net mortgage payment by 200
basis points (2%).
All Contra Costa jurisdictions with the exception of the City of Oakley have entered into a Cooperative
Agreement with the County allowing the County to administer the program for the benefit of the entire County.
In order to participate in this program,the City of Oakley must also enter into a Cooperation Agreemptit with

COOPERATIVE AGREEMENT BETWEEN
THE COUNTY OF CONTRA COSTA AND
THE CITY OF OAKELY
THIS COOPERATIVE AGREEMENT (the "Cooperative Agreement") is made and
entered into as of June 5, 2000 by and between the COUNTY of CONTRA COSTA
("County"), and the CITY OF OAKLEY (the "City").
WITNESSETH: MORTGAGE CREDIT CERTIFICATE PROGRAM
WHEREAS, the Tax Reform Act of 1934 established the Mortgage Credit
Certificate Program (herinafter referred to as the "MCC Program") as a means of
assisting qualified individuals with the acquisition of new and existing single family
housing; and
WHEREAS, the County has heretofore determined to engage in an MCC
Program pursuant to Chapters 1399, Statutes of 1935 Section 50197, et seg of the
Health and Safety Code of the State of California (the "Act") in order to assist individual
home purchasers in the County to afford both new and existing homes within the
statutory limits as provided for in said Act; and
WHEREAS, in furtherance of the MCC Program, the County authorized its staff
to apply to the California Debt Limit Allocation Committee (CDLAC) to obtain allocations
for operation of the Mortgage Credit Certificate Program in Contra Costa County; and
WHEREAS, Contra Costa County has operated a successful Mortgage Credit
Certificate Program since 1991, in which over 2000 qualified individuals and families
have been assisted in the purchase of new andexistinghousing in the County; and
WHEREAS, the City and the County wish to cooperate with one another
pursuant to the Act in the exercise of their powers under the Act for the purposes of the
MCC Program; and
WHEREAS, the County intends to administer an MCC Program in the County,
and the City desires that the Program be applicable to eligible real property in the City;
and
WITNESSETH: MORTGAGE BOND PROGRAM
WHEREAS, the County has determined to engage in a home mortgage finance
program pursuant to Chapters 1-5 of Part 5 of Division 31 of Health and Safety Code of
the State of California (the "Act") to make or acquire, directly or indirectly, loans to
finance the construction or acquisition of homes in the County of Contra Costa, all as
provided for in the Act (the "Home Mortgage Finance Program"); and
WHEREAS, the County of Contra Costa, pursuant to the Act, has adopted a
home finance program by Ordinance No. 82-5; and
WHEREAS, the County has determined to cooperate with the City pursuant to
the Act in the exercise of its powers under the Act for purposes of the Home Mortgage
Finance Program; and
WHEREAS, the City, pursuant to the Act, has adopted a home mortgage finance
program and has determined to cooperate with the County pursuant to the Act in the
exercise of its powers under the Act for purposes of the Home Mortgage Finance
Program; and
NOW, THEREFORE, in consideration of the mutual covenants hereinafter
provided, the parties hereto agree as follows:
SECTION 1. The words and phrases of this Cooperative Agreement shall, for all
purposes hereof unless otherwise defined herein, have the meanings assigned to such
words and phrases in the Act.
SECTION 2. The County shall staff d program for the effective administration of
an MCC Program within the geographical boundaries of the City. The County shall
cooperate with local real estate and lending institutions in order to maintain their
participation in securing applications from eligible applicants for review and approval by
County representatives on behalf of the County and the City.
SECTION 3. The County intends to undertake a Home Mortgage Finance
Program and to issue revenue bonds pursuant to the Act, as such programs are
deemed to be beneficial.
SECTION 4. The City herby agrees to cooperate with the County in the exercise
jointly or otherwise of their powers for the purpose of financing home mortgages
pursuant to the Act by agreeing that the County shall exercise such powers to make or
acquire home mortgages under the Home Mortgage Finance Program, all as more
specifically set for the in the Act, with respect to property located within with geographic
boundaries of the City.
SECTION 5. Nothing in this Cooperative Agreement shall prevent the County
from entering into one or more similar agreements with other municipal corporations
within the County, if deemed necessary and advisable to do so by the County, so long
as such other agreements are not inconsistent with this agreement.
SECTION £. The City agrees to undertake such further proceedings or actions
as may be necessary to carry out the terms and intent of this Cooperative Agreement as
expressed in the recitals; provided, however, that nothing in this Cooperative
Agreement shall require the City to appropriate any funds to the County for services
under this Cooperative Agreement. Funds for the administration of the MCC Program
and the Home Mortgage Finance Program shall be derived by the County from the fees
paid by the MCC applicants and from administrative fees paid by the Home Mortgage
Finance Program respectively.
SECTION 7. Nothing contained herein shall be interpreted to impose a
relationship of partners or joint ventures between the City and the County.
IN WITHNESS WHEREOF, the parties hereto have caused this Agreement to be
executed and attested by their proper offices thereunder duly authorized, and their
officials seals to be hereunto affixed, all as of the day first above written.
