Recommended Action: WAIVE contract procedures of the Blackhawk Geologic Hazard Abatement District (GHAD) for the repair of a landslide on Hole#6,Blackhawk Lakes Course,Blackhawk Country Club,and AUTHORIZE the General Manager to negotiate a contract for the repair work. IL Financial Impact: No impact on the County General Fund. The Blackhawk CHAD is funded through revenues generated by County Service Area M-23. Reasons for Recommendation and Background: A landslide occurred in the slope adjacent to the sixth fairway on Blackhawk County Club's Lakes Course during the winter of 1998/99. The landslide is within the boundaries of the Blackhawk CHAD. The adopted Plan of Control authorizes repair of landslides. Funds for the repair of this landslide were included in the GHAD's approved FY 1998/99 Program Budget. Repair of the landslide was deferred until the summer of 2000 1) because it had a relatively low priority in comparison with other major landslides within the Blackhawk GHAD and 2) in anticipation of then planned renovations to the golf course by the Blackhawk Country Club. Renovation of the golf course is now underway. Temporary erosion control and stabilization measures were applied during the winters of 1998 and 1999. The GHAD's geotechnical engineering consultant,Engeo,Inc., San Ramon,California completed an analysis of the landslide and identified a series of repair strategies for consideration by GHAD management. While the GHAD's adopted FY 98/99 budget included funds for the repair,Engeo's analysis found the landslide to be much deeper and significantly larger than originally thought. Estimates of the cost to repair the landslide now range from approximately $450,000 to over$1.2 million. After a review of the situation and Engeo's recommendations, the General Manger is recommending proceeding with the least expensive option—construction of a buttress fill within the fairway. Because this option requires the placement of fill on the sixth fairway of the golf course,the General Manager has been coordinating with the Blackhawk County Club with respect to the planned renovations to the golf course. This project that both economically repairs the landslide(to the satisfaction of the CHAD)and enhances the golf course. The Blackhawk Country Club has submitted a letter in support of the project. As currently planned, the GHAD will be responsible for the structural elements of the repair. The Blackhawk Country Club responsible for final grading,repair of the golf course irrigation system and replacement of turf(i.e. the visual and cosmetic elements of the project). This joint approach to the repair of the landslide will result in savings to the CHAD of between$125,000 to$200,000. Board Resolutions 86/370 and 98/329 define procedures related to advertising and awarding of CHAD maintenance and repair contracts. To facilitate coordination with the Country Club, the General Manager recommends that the provisions of these Resolutions related to competitive bidding be waived and that he be authorized to negotiate a contract with the Country Club's Contractor or another qualified contractor for the repair of the landslide. Such a waiver is consistent with state law,which does not require competitive bidding for CHAD construction projects. Following negotiation of the contract, it will be presented to the Board for approval. License Agreements providing the GHAD with sufficient rights to enter upon and repair the landslide as well as necessary indemnification will be executed with the Blackhawk Country Club and the Blackhawk Homeowners Association. IV. Consequences of Negative Action: The landslide could not be repaired this season and the GHAD's cost of repairing the landslide would increase significantly. The annexation will provide additional funds to maintain the detention basins. Reasons.for Recommendations and Background: The Veale Tract/Byron Tract Work Group has been addressing drinking water quality issues in the community of Knightsen and recognized that flooding and stormwater can impact the water quality. The Work Group was granted $500,000 this fiscal year through the CALFed to implement water quality improvements. One hundred thousand dollars ($100,000.00)is being made available,by means of a grant application to the United States Environmental Protection Agency, for use by the Contra Costa County Flood Control District. The Flood Control District would establish a Community Services District that would be an entity able to fund construction and maintenance of drainage infrastructure and water quality improvements. It would also fund a feasibility study for the use of wetland biofilters to filter stormwater and irrigation taiiwater flows from Knightsen before it is discharged into the slough. This would be an opportunity to fund improvements long requested by the residents of Knightsen, but for which there has been no revenue in the past. 1V. Consequences of Negative Action: The Flood Control District would lose out on the opportunity to improve both drainage in the community of Knightsen and water quality to the Delta.
