1. Recommended Action:
APPROVE and RATIFY the execution, by the Public Works Director, of Amendment No. 1 to the
Consulting Services Agreement with The Covello Group, Inc. to provide legal advisory services for
the Fish Ranch Road Slide Repair Project.
11. Financial Impact:
There will be no impact on the County General Fund. The $15,000.00 increase is funded by
Federal Highway Admnistration Funds (88.53%) and Road Funds (11.47%).

Ili. Reasons for Recommendations and Background:
The Board of Supervisors on December 14, 1999 authorized the Public Works Director to execute
a Consulting Services Agreement, for $30,000.00, with the Covello Group, Inc. to provide legal
advisory services for the f=ish Ranch Road Slide Repair Project. This amendment to the original
Agreement brings the total value of the contract to $45,000.00.
IV. Conseguences of Negative Action:
The lack of approval would prevent the County compensating the consultant for services
rendered by the Covello Group, Inc.
AMENDMENT NO. 1
CONSULTING SERVICES AGREEMENT
PROJECT NAME: FISH RANCH ROAD
PROJECT NO. 0672-6R6346-98
1, Parties:
Effective on April 10, 2000, the County of Contra Costa, a political subdivision of the State of
California, hereinafter referred to as "Public Agency," and The Covello Group, Inc. hereinafter
referred to as "Consultant," mutually agree and promise as follows:
2. Purpose:
The parties desire to amend the agreement they entered into effective October 1, 1999 entitled
"Consulting Services Agreement," hereinafter referred to as the "Agreement." The Agreement is
for providing engineering expertise for claims analysis and assisting in the preparation of materials
for mediation. This Amendment provides for an increase in the estimated contract cost by $15,000
to a new total of$45,000.
3. Amendment(s)to Agreement:
A. The payment limit, Item 1(e) of the existing Consulting Services Agreement is amended
to now read Total Payment $45,000 (Including Phases I, 11, and 111).
B. Estimated Work Effort and Budget, Appendix A, is amended to reflect the payment limit
changes described in the attached letter from Consultant dated March 28, 2000.
4. Remaining Provisions:
Except for the changes made by this Amendment, all provisions of the Agreement shall remain
in full force and effect.
5. Signatures:
These signatures attest the parties' agreement to this Amendment.

Status of Budget
Dear Mike:
Through March it is estimated that our budget status will be as follows:
Attachment A services: $19,000
Mediation Activities: $4,000
Total: $23,000
It is anticipated that the remaining Mediation Activities through the end of April will cost
approximately $9,600 bringing our total expenditure to $32,600. If the Contractor provides the
additional information and documents requested, another$4,400 may be expended for a total of
$37,000. Even with a successful mediation, finalizing our report may require $7,000 for a total of
$44,000. Of this amount the Mediation Activities, which are extra to the Contract, total $13,600.
Accordingly, a budget increase of$14,000 is warranted. Please advise us if you concur with this
request.

SUBJECT: First Amendment to Agreement to Provide Right of Way Services to the Contra Costa
Transportation Authority
Project No. 4660-6X4287 Task No. ACQ Account No. 3540
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action: APPROVE amendment to the Agreement to provide right of way services
to the Contra Costa Transportation Authority (CCTA) for the State Route 4 Widening Project at
Railroad Avenue to Loveridge Road, and AUTHORIZE the Board Chair to sign the agreement on
behalf of the County.
I1. Financial Impact: Contra Costa Transportation Authority will pay the actual costs for Real Property
staff right of way services.
III. Background and Reasons for Recommendations: Contra Costa Transportation Authority requires
a variety of right of way services but has no right of way staff and has contracted with the County for
these services. On April 4, 2000, the Board approved the original agreement. The above-referenced
amendment expands the total agreement value by $490,000 to a total value of $550,000. All other
terms and conditions of the original agreement remain in effect.
IV. Consequences of Negative Action: Less efficient government because the Contra Costa
Transportation Authority would have to hire additional private contractors at a greater expense.

WHEREAS,the Contra Costa Transportation Authority and Contra Costa County Real Property Division
("CONSULTANT")entered into Agreement No. 124 on January 1, 2000; and
WHEREAS,the parties now wish to further amend the Agreement and increase the total compensation; now
therefore be it
MUTUALLY AGREED:
(1) that Article 4 of the Agreement is amended to increase the base work compensation by$490,000 for an
overall total Agreement Value of$550,000; and
(2) that all other items and conditions of the Agreement shall remain in effect.

The State Route 4 (East) widening project, Railroad Avenue to Loveridge Road,
requires the acquisition of several properties west of Railroad Avenue in Pittsburg for
the reconstruction of Frontage Road. The Public Works Department recommends the
services of Pacific Relocation Consultants to provided relocation services for the project.
Pacific Relocation Consultants has provided relocation assistance for other agencies
and has met required time lines, and are known for their reliable performance.
IV. Consequences of Neaative_Action:
The County would be unable to retain the services necessary to complete the project
in a timely manner.

I• Recommended Action:
AUTHORIZE the Public Works Director to EXECUTE, on behalf of the County, a Rental Agreement,
effective May 1, 2000, with Gabor Consulting for the premises at 175 Frontage Road, Pittsburg; and
AUTHORIZE the Public Warks Director, or his designee, to arrange for the payments of rents,
security, legal, and maintenance fees as specified in the attached Rental Agreement.
II. Financial Impact:
Payments required are to come from the State Route 4 East 1 Railroad Avenue to Loveridge
Road Widening Project fund which is 100% reimbursable from the Contra Costa County
Transportation Authority.

Iii. Reasons for Recommendations and Background:
A. The County may acquire the land and improvements located at 175 Frontage Road,
Pittsburg, for use as rights of way for the State Route 4 East i Railroad Avenue to
Loveridge Road Widening Project. The improvements consist of eight duplexes/sixteen
apartment units.
S. As the apartment units become available, the County wishes to enter into a rental
agreement with the property owner to minimize relocation costs that may mature for
future occupants, since the County cannot prevent the units from being occupied again
prior to purchase of the property. Three units are currently available for rent.
C. The owner is in agreement with the County's objectives of having the units remain vacant,
the County paying rent on the units as they become vacant, and securing the premises
against vandalism, trespassers, or other unauthorized occupants.
IV. Consequences of Negative Action:
The County could be liable for additional relocation expenses if the project proceeds and the
property is acquired for purposes of the project.
