NOTICES ARE TO BE SENT : CASPER, MEADOWS & SCHWARTZ A Professional Corporation 2121 North California Boulevard, Suite 1020 Walnut Creek, CA 94596 DATE OF OCCURRENCE : November 19, 1999 PLACE OF OCCURRENCE : Contra Costa County Jail Martinez, California 1 HOW DID CLAIM ARISE: On or about November 16, 1999, Claimants' decedent, JOSE RODRIGUEZ, was arrested by officers of the Concord Police Department. At the time of his arrest, the aforesaid officers were told by numerous family members that the decedent, JOSE RODRIGUEZ, age 29 at the time, was acting strange, appeared to be mentally ill, and had recently suffered from a heart condition. Claimants have reason to believe that this information was communicated in some fashion to the staff at the Contra Costa County Detention Facility in Martinez where Claimant was taken on said date and housed as an inmate. Said facility is operated, maintained, and controlled by the County of Contra Costa under the authority of the Sheriff of Contra Costa County, Warren Rupf. This claim is based upon the personal injuries sustained by Claimants as a result of the death of their husband and father, JOSE RODRIGUEZ, on November 19, 1999. On that date, JOSE RODRIGUEZ was mated and had excessive force applied to his person by Sheriff's deputies when they transported him to a safety cell where he was shackled by the ankle and left unattended. As a result of this treatment, JOSE RODRIGUEZ stopped breathing shortly thereafter, either from the effects of positional asphyxia, a cardiac arrhythmia, a combination of both, or some other cause that could have been avoided had JOSE RODRIGUEZ been properly classified, managed, and provided reasonable medical care. To date, Claimants are unaware of the names of any County employees involved in the aforementioned incident. The claims asserted herein include,but are not limited to: (1) The failure of the County, through its employees, to provide reasonable medical care to JOSE RODRIGUEZ whose condition required such care; (2) JOSE RODRIGUEZ was so negligently and carelessly confined, assigned, treated, classified, managed, controlled, supervised, and cared for as to proximately result in the injuries above described; (3) JOSE RODRIGUEZ was treated by health care providers who were the agents, servants, and employees of Contra Costa County, and who negligently and carelessly treated, diagnosed, examined, classified, assigned, confined, and otherwise cared for JOSE RODRIGUEZ so as to proximately cause the injuries set forth above; (4) At all times relevant, the County of Contra Costa failed to provide adequate or sufficient equipment, personnel, or facilities, required by State law and as further required by the regulations of the State Department of health Services, Social 2 Services, Developmental Services or mental health prescribing minimum standards for equipment, personnel, or facilities proximately resulting in the injuries set forth above; (5) The detention facility was carelessly, negligently, and defectively designed, constructed, owned, operated, repaired, controlled, inspected, supervised, installed, used, and maintained by the County of Contra Costa as to render it unsafe, defective and dangerous, proximately resulting in the injuries to Claimants' decedent. The injuries sustained by Claimants, as of the date of the presentation of this claim, consist of the loss of future earnings, love, comfort, society, and the companionship of r their husband and father, JOSE RODRIGUEZ. A t f is < 11 # ri " • # ! ! the following is my relation to you of what happened on Wednesday.January 12th 2000 at approximately 9.1.5 am . I woke up hearing someone yelling "open up or were coining in". I.got up right away and started to go to the front door. I said "wait a.minute" so I.could open the door but by the time I could gel: to the living room.the police.had already broke down the front door and were in the front room. They were pointing guns at my HEAD and yelling ",get on the ground and put your hands behind your back" So I slid . At this point I.was really.confused because I.had.been woke out of a sound sleep to find police in my house after breaking down my front door.and pointing,guns at ane and yelling. It was really frightening, nothing.like this had ever happened to me before. After that they put handcuffs on.me.they were really tight and my wrists were red and swollen for the zest of the night. Then.they left me face down on the floor for.about fifteen minutes while they wanderedaround making jokes.with each.other and laughing.: During all this I not even understand what was,going on after that a police officer told me to get on my side and get.up. Then he searched me and told me.to.get on the couch so I did as I was told. After that I asked if"I was under arrest"'? and the offici,r said "no", so I asked "then why do I need to.be in handcuffs"? He did not answer. After that he went and looked.in the fridge while he was doing that another officer came in and told me they had a search warrant for Eric Conn. He asked me "does Eric.Conn live in this house'l I said no, he stays in the motor home. then he asked "does.eric ever store any.of.his stuff in this house?" I told him no, he always keeps his stuff with him in.the motor home. Then they asked me "how well do you know eric?" I said not very well. Then he asked "how long has he been living in the motor home?" I said "a couple of months". Then he asked "is your mother dating Eric?" I said "no there just friends". Thenhe asked "wellwhere did your mom:meet Erik?" I said "I don't know" then he started talking to the other officers. Since I didn't get a straight answer from the other officer I asked again "If I was under arrest he said no" So I asked "why do I need to be in handcuffs then"? "he said for our protection. Since I was awakened out of a sound:sleep, and was shaken up by this whole thing I asked if I could smoke a cigarette they said no they don't like cigarette smoke then they all left me while they wandered around. About thirty minutes latera police officer came in and saw I was alone. Be asked the other policemen whythey left me alone. Nobody answered. Then the Police officer asked my name and who else lives in the house. I told him my moan and my brother.live with me. But he didn't write anything dawn. He asked "do you know where Eric is"? I said "no". Then he asked me "when did he leave?" I told.hum "early this morning". He asked "well where does he go everyday"? I said "that was none of my business". I don't know. He asked "has Eric brought home any doors or windows"? I said no he has.not. He asked "have you seen him with any animal furs or pelts"? I. said no. I realized that they had left the gate open and asked if they could shut it so.the dogs.don't get out he ignored me. Another officer-came in and asked "where did the windows inn the back yard come.from"? I told himwe were remodeling our house and my morn got them when we first moved hers. The first officer said that "he had.noticed:the.electrical work we had been doing from the light switch..nextto the front door. He said it looks better than when he had seen it last time he was here with the lady that had livedhere before us. A little while later another police officer came in and told the other officer that they were finding.a:whole bunch of stuff in the motor home , .and asked if he wanted him to stay with me so he could.go look. .The other officer said "that should be fun" and left. Then the other.cop.asked me if anyone took down my infonnation. I said yes but nobody wrote it down so he.asked for nay name and my moms and wrote it all down. After that another cop came in from the back and asked "where are the keys to the tool box?" I said I didn`t know. "He said "well you need to tell me so we can get into.them without having to cut the locks." "I said I don't know where the keys are." "He said "this thing would go alot faster if you would just tell.me. "Then.he left and walked back to the back of the house. After about another 30 minutes another cop carne in and switched the handcuff's.to the front. Then they got all confused about who's handcuffs were still really tight and hurting my wrists. They said they were waiting for a truck to load everything up in. Then a cop asked his partner for a cell phone so he could call the lady about the windows they found. I heard the. cop.talking.to her in the.back yard asking her to explain the.windows to hien. We just.come downhere and claim it then if its your. Then he came in and.told his partner he talked to the lady and asked her to explain the windows to him and she said "well.they look like the windows on the front of my house". He said he told her that he wasn't looking at the front of the house and to come over and look at what they found and claim what's hers. Then the other cop said it would..be easier if she jusx takes her stuff with her so we don't have to load it all into the truck. About.20 minutes later the lady showed up and.a cop led her into the backyard to look at everything. After I saw her walking back theand and realized she was the lady we saw wandering around in our back yard after we put the no trespassing sign up. I.told the cop but he ignored me. I asked "so can anyone see something they want and make a report that it was stolen and come over and claim anything they want?" He said ".no" but didn't go into it fiirther. The lady was back. there for about 20 minutes and claimed a pair of shutters they let her take with her. Then I heard our shower running and a bunch of cops in the bathroom. While they were back there the cope who was watching me took a knife out of.his pouch and started.playing with it. It was a browns knife with copper ends and it was really.dull. I realized that it was the knife my mom used for gardening. Then he put it.back in his packet:. .I was.to scared to say.anything about it. Then an officer they called 'Skip„ came in and gave me the search warrant they had and showed me a picture ofthe shutters they.let the lady.take with a receipt that had the shutters on it,.but it didn't,have.the knife the corp took on it. Then they left and the cops,who were in the.bathroom came out.and their shoes were wet so I assume that they washed their shoes off in the shower. After they left our house was really messed:up.because they looked through our drawers and everything. And the,fi-ont doom.and the door to the motorhome.was. severely damaged. I spent the rest of the day.cleaning.up everything.
