I. Recommended Action:
APPROVE and AUTHORIZE the Public Works Director, or his designee, to EXECUTE, on behalf of
the County, a Fourth Amendment to Lease and a County's Consent to Leasehold Encumbrance; Estoppel
between County, as Landlord, Byron Aviation Services Limited, as Tenant, and CivicBank of Commerce,
as Tenant's Lender, for leased premises at the Byron Airport.
II. Financial Impact:
There will be no financial impact from this action.

111. Reasons for Recommendations and Background:
The Lease provides that upon Tenant's completion of Phase 2 of its improvements,Tenant will be entitled
to take out permanent financing for all of the improvements. Tenant has completed the Phase 2
improvements to County's satisfaction. The Fourth Amendment to Lease and the County's Consent to
Leasehold Encumbrance; Estoppel allow the Tenant to finance those improvements.
1V. Consequences of Negative Action:
Neither the Fourth Amendment to Lease nor the County's Consent to Leasehold Encumbrance; Estoppel
will be executed, and the Tenant may not be able to finance its improvements.

AUTHORIZE and APPROVE the Public Works Director,or his designee,to RELEASE, on behalf of the
County, Payment and Performance Bonds between County, as Landlord, Head Real Properties, Inc.,
representing Byron Aviation Services Limited, as Tenant, and AMWEST Surety Insurance Company, as
Surety, for improvements completed by Tenant at the Byron Airport.

III. Reasons for Recommendations and Background:
The County entered into a lease with the Tenant on August 8, 1995. The lease provided that the Tenant
would complete improvements to the lease premises and would provide the County with Payment and
Performance Bonds naming the County as the beneficiary. The Tenant has completed the improvements
and has requested that the County release the bonds. The improvements have been completed to the
County's satisfaction. Therefore, it is in the County's best interest to release both the Payment Bond and
the Performance Bond.
I'V. Consequences of Negative Action:
County will not release the Payment or Performance Bonds.

SI.JBJECT: Approve Amendment No. 1 to CALTRANS grant for Federal AIP Matching funds

III. Reasons for Recommendations and Background:
On February 23, 1999, the Board of Supervisors approved the California Aid to Airports Program Grant
Agreement for Federal AIP Matching Funds. This grant was for four and one-half percent (4%%) of the
eligible project costs. On September 2, 1999,the final claim for all of the construction costs was submitted
to the Federal Aviation Administration(FAA). nue to the engineering design, site work, and excavation
costs being higher than when the FAA Grant Application was made, the actual costs were higher than
original grant amount. The eligible project costs covered under the California Aid to Airports Program were
increased from $550,000 to $656,298 which in turn increased the grant amount from$27,500 to $32,815
a total increase of$5,315.
IV. Consequences of NNeeative Action:
The Airport would not receive the additional Grant funds from CALTRANS and all of the additional costs
would be paid out of the Airport Enterprise Fund.
