GRANT DEED OF DEVELOPMENT RIGHTS
Restricted Development Area(Scenic Easement)
To meet condition of approval number 5-F of Subdivision 8262, we, Sherman Ranch LLC, a
California Limited Liability Company,(Omer) hereby grant to the County of Contra Costa, a
political subdivision of the State of California (Grantee) and its governmental successor or
successors, the future development rights, as defined herein below over a portion of that real
property known as Lots one through nine of Subdivision 8262 situated in the County of Contra
Costa, State of California, and more particularly described in Exhibit A.
Development rights are defined to mean and refer to the right to approve or disapprove of any
proposed construction, development or improvement within the areas marked "restricted
development area." The development rights are and shall be a form of covenant, which shall run
with the said property and shall bind the current owner and any future owners of all or any
portion of said property. In the dvent of a disapproval of proposed construction by the Grantee or
its successor, said proposed construction shall not be performed. Grantee or its successor may
condition its approval of any proposed construction upon prior or subsequent performance of
such conditions as Grantee may deem appropriate.
Any owner or owners of all or any portion of said property desiring to develop any improvement
requiring the approval of Grantee or its successor herein shall submit to such entity a written
proposal describing the nature, extent, and location. of such improvement. Grantee or its
successor shall have sixty (60) days from receipt of such proposal in which to grant its approval
or disapproval. Failure by Grantee or its successor to respond in said time period shall be
equivalent to the approval of such proposal.

SUBJECT: Authorizing the Public Works Director to Arrange for Completion of Improvements,
and Authorizing County Counsel to Secure Funds for Completion of Improvements,
MS 34-91, Pacheco area.
The Board on October 13, 1992, having approved a subdivision agreement with Clyde A.
Cola and approved extensions to the agreement until October 6, 1999 for construction of certain
improvements in MS 34-91, Pacheco area.
The Public Works Director having reported that the developer has failed to satisfactorily
complete the work as required by said agreement.
The Public Works Director having further recommended that he be authorized to arrange for
completing the work(estimated to be$28,900.00,plus the cost of preparing plans and specifications,
solicitation of bids, administering the contract, and any cost involved in recovering monies from
Indemnity Company of California (Bond No. 217811S in the amount $28,900.00 for faithful
performance),using the$1,000.00 cash deposit(Auditor's Deposit Permit No.210860, dated July 23,
1992)made by Clyde A. Cola to help defray the County's cost.
The Public Works Director having further reported that the County cannot fund the
construction of said improvements without first obtaining monies from the surety or financial
institution securing the agreement, and recommends that County Counsel be authorized to proceed
against the subdivider and the corporate surety bond dated July 21, 1992, and issued by Indemnity
Company of California(Bond No.217811 S) in the amount $28,900.00 for faithful performance,
to make the funds available to complete said improvements and to defray County's cost incurred in
securing said funds.
IT IS BY THE BOARD ORDERED that the recommendations of the Public Works Director
are APPROVED.

The Public Works Director having notified this Board that the improvements for LP2036-97
have been completed as provided in the Road Improvement Agreement with Stevens-Hemingway-
Steven, Inc.,heretofore approved by this Board;
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of June 20, 2000 thereby establishing the six-month terminal period for the.filing of liens in case

DECLARED to be a County road;the right of way was conveyed by separate instrument,recorded
on June 26, 1998, Series number 98-0146585-00.
BE IT FURTER RESOLVED that the beginning of the warranty period is hereby
established, and the $1,900.00 cash deposit (Auditor's Deposit Permit No. 314773, dated June 4,
1998) made by Stevens-Hemingway-Stevens, Inc., and the performance/maintenance surety for
$190,700.00, Bond No. 08131551 (June 1, 1998) issued by Fidelity and Deposit Company of
Maryland be RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code
until released by this Board.
