Fiscal Impact: Contra Costa Regional Medical Center (CCRMC) will be eligible for a maximum of$10.0 million in matching Federal funds. See background information for full discussion. Background: Federal grants to the State of the Medicaid program (Medi-Cal in California) are authorized under Title XIX of the Social Security Act to provide medical assistance to certain persons with low income. These Medicaid programs are jointly financed by the Federal and State governments and administered by the States. State Medicaid agencies conduct their programs according to the Medicaid State plan approved by the Administrator of the Health Care Financing Administration (HCFA). To carry out the Medicaid Program, the State agency pays providers for medical care and services provided to eligible Medicaid recipients. The Federal government pays its share of Medicaid program expenses to the State on a quarterly basis according to a formula. The State share of Medicaid program expenses is paid from "State funds", that is, those funds over which the State legislature has unrestricted power of appropriation. In California, the program "split" is 50% Federal financing, 50% State financing. SBA 255 (Chapter 996, Statutes of 1989) added Section 14085.6 to the Welfare and Institutions Code and established a program whereby certain voluntary transfers and donations will be utilized by the State to provide funds to disproportionate share hospitals to assist them in enhancing or maintaining access for Medi-Cal beneficiaries. This program is similar in nature to those established in Tennessee and other states. CCRMC is a disproportionate hospital eligible for reimbursement under this program. The California Medical Assistance Commission (CMAC) is responsible for administration of SB-1255. The Commission solicits the donations and distributes the funds collected through the Medi-Cal contracting processing. ISSUES: Issue 1: The State SB-1255 Plan may be disallowed at the Federal level. Discussion: If a disallowance were to occur, some part of the "increased" Federal share might be required to be reimbursed. Issue 2: Facilities which make a "voluntary" donation are not guaranteed of return of either the matching Federal funds or the donation itself. Discussion: SB-1255 is intended to provide a workable program. If the most "needy" facilities in the State make donations and do not receive back, at a minimum $1.50 for each $1.00 donation, the program will fail. While, because of Federal restrictions, the State cannot guarantee the return of the transferred funds, it is the intent of the program that no "donating" facility will be disadvantaged. To date, the Medi-Cal Commission has held twelve rounds of voluntary Donations and supplemental contract negotiations. CCRMC has voluntarily contributed a total of$39,250,000; supplemental Medi-Cal contract payments have been $67,300,000. 49 TO: BOARD OF SUPERVISORS • CONTRA FROM : Victor J. TERM• The term of this Agreement shall be from July 1,2000,through June 30,2001,unless renewed before then or terminated pursuant to Section 7. 3. CO,UNTY'S OBLIGATION. A. In consideration of County Schools Insurance Group's promise to pay the amounts stated herein, County,through its County Counsel, shall provide oral and written legal advice to County Schools Insurance Group and represent County Schools Insurance Group in all administrative proceedings and litigation except: 1) Suits involving personal injury and property damage. 2) Matters involving labor negotiations. 3) Suits involving worker's compensation and employer's liability claims against Group and its members. B. Matters pertaining to unfair practice charges arising under the Educational Employment Relations Act(Gov. Code §§ 3540 et seq.)may be handled,but County Schools Insurance Group will first consult with and obtain County Counsel's concurrence for representation and handling of any such matters as they may arise. C. County Counsel shall be truthful with County Schools Insurance Group, cooperate with it,keep it informed of developments,perform the obligations required by this Agreement, and immediately notify County Schools Insurance Group of any discovered actual or apparent conflicts for representation decisions. 4. COUN'T'Y SCHOOLS INSURANCE GROUP'S OBLIGATION. A. COMPENSATION. In Consideration of the County's provision of these legal services during the term of this Agreement,the County Schools Insurance Group shall pay the County as follows: 1) For Legal Services: a. Deputy Mary Ann Mason $ 116.00/hr. b. Deputy Kevin T. Kerr $ 119.00/hr. c. Deputy David F. Schmidt $ 119.00/hr. d. Legal Services Clerk $ 41.00/hr. e. Any other Deputy County Counsels utilized at the same hourly rate charged county departments, but in no event to exceed$ 106.00/hr. f. Assistant County Counsels $ 128.00/hr. 2) For reasonable costs, as follows: a. Automobile mileage at$ .31 per mile. b. Reporter's fees, witness fees, any extraordinary postage and long distance telephone charges, and all filing fees and court expenses as incurred to perform the services described in Section 3. B. Obligations. In connection with any legal work assigned to County Counsel, County Schools Insurance Group shall take reasonable steps to respond to County Counsel's inquiries thereon and pay the County's bills as provided in Section 5. 5. BILLING AND PAY N . The County shall submit itemized billings to the County Schools Insurance Group at least quarterly. County Schools Insurance Group shall pay the billings within 45 days of receipt. 6. EMPLOYEE STATUS. In performing legal services for the County Schools Insurance Group,the County Counsel and his staff shall be regarded as employees of County Schools Insurance Group, for the purposes of the Tort Claims Act(Gov. Code § 810 et seq.; specifically, § 820 et seq. and § 825 et seq.) 2 7. TERMINATION, This agreement may be terminated at any time by either party,at its sole discretion, upon 30 days' advance written notice to County Schools Insurance Group by the County or upon 5 days' advance written notice to the County by County Schools Insurance Group. 8. QNGOING LITIGATION, If this Agreement is not renewed or otherwise terminated during its term and County Counsel is representing County Schools Insurance Group in ongoing litigation,County Counsel shall cooperate with the attorneys chosen by County Schools Insurance Group to enable them to assume control of such litigation on behalf of County Schools Insurance Group. RECOMMENDED ACTION: Authorize the Sheriff or his designee to execute, on behalf of the County, a contract in the amount of $24,000 with the 23rd Agricultural District of the State of California to provide security services for the 2000'Contra Costa County Fair. Il. FINANCIAL IMPACT: There will be no financial impact on the County. All expenditures will be reimbursed by the State of California. 111. REASONS FOR RECOMMENDATION: The Sheriff has provided police/security services for the Contra Costa County Fair for the past sixteen (16)years at no cost to the County. The 2V Agricultural District of the State. of California is requesting that the Sheriff again provide these services for this year's fair. Security services will be provided by Reserve Sheriff's Deputies on a per-diem basis. The contract will provide for reimbursement to the Sheriff for up to one-thousand, one-hundred hours of security service.This contract is authorized pursuant to Government Code section 26226(a). IV. CONSEQUENCES OF NEGATIVE ACTION Failure to authorize this action will leave the 2000 Contra Costa County Fair without security services, since the fairgrounds are located in unincorporated territory,the Sheriff is responsible for providing police services for this area. Without contracted security,the Sheriff's law enforcement response for services would be increased,thereby incurring non- reimbursed costs to the County. The amount of these costs would be based on the number of problems or calls for services which occur during the five (5) day fair. RECOMMENDED ACTION: APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to apply for a grant in the amount of$56,000 to partially fund the cost of safety vests purchased from June 1, 2000 to June 30, 2003, for law enforcement officers employed by the County, and to execute a contract to accept such funding if awarded. II. FINANCIAL IMPACT: Federal funding is available to offset 50% of the cost of protective vests approved by the National Institute of Justice and purchased for use by law enforcement officers. The availability of this funding will reduce the County cost of these essential purchases. The application submitted in 1999 for this program was partially funded. Reimbursement is provided after purchase is made from appropriated funds; matching funds are within FY2000/01 target budgets. III. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The Federal Bulletproof Vest Partnership has again announced the availability of funding to assist in the purchase of safety vests approved by the National Institute of Justice. The County is defined as a "jurisdiction" for the purpose of this funding, with one application per jurisdiction permitted. The Sheriffs Office is by far the largest purchaser of safety vests among the County agencies and applied last year on behalf of the County agencies with law enforcement powers. The prior application was partially funded, and this year's application, if fully funded, would complement that award to provide support for safety vests for law enforcement personnel in the Sheriffs Office as well as other County agencies such as Probation and the Fire Districts. (No County Match) BACKGROUND/REASONS FOR RECOMMENDATIONS Effective January 1 , 2000, the existing law governing California's Beverage Container Recycling and Litter Reduction Program was modified (SB 332) to include appropriation of funding to provide payments to cities and counties for specific activities. The California Department of Conservation (DOC) is responsible for administering this program which provides funds to cities and counties for certain beverage container recycling and litter cleanup activities. This is not a grant program and is not competitive, cities and counties only need to submit a Resolution and completed Funding Request Form. The funding amounts available to each jurisdiction is based on their population. The DOC plans to provide payments for approved activities prior to June 30, 2000. The maximiurn funding for the unincorporated area for the FY 1999/2000 cycle is $41,861.
