The Parcel Map of Subdivision MS 8-99, property located in the Alamo area, said
map having been certified by the proper officials;

A subdivision agreement with Scott W. Bryant, subdivider,whereby said subdivider
agrees to complete all improvements as required in said subdivision agreement
within one year from the date of said agreement. Accompanying said subdivision
agreement is security guaranteeing completion of said improvements as follows:

Creek Structure Setback
To meet condition of approval number 33 of Minor Subdivision 22-98,Warren L.Deckelman and
.Miriam J Deckelman, (Owners) hereby grant to the County of Centra Costa, a political
subdivision of the State of California(Grantee) and its governmental successor or successors, the
future development rights, as defined herein below over a portion of that real property known as
Parcel C of Minor Subdivision 216-71, filed February 24, 1972,Book 21,Parcel Maps,Pages 4 and
S situated in the County of Contra Costa, State of California, and more particularly described in
Exhibit"A"(written description) and shown on Exhibit"B" (plat map) attached hereto.
Development rights are defined to mean and refer to the right to disapprove of any proposed
construction, development or improvement within the areas marked "restricted development area-
creek structure setback." The development rights are and shall be a form of covenant, which shall

collected and conveyed within an adequate storm drainage facility, to an adequate natural
watercourse having definable bed and banks,or to an existing adequate public storm drainage facility
which conveys the storm waters to an adequate natural watercourse,in accordance with Division 914
of the Ordinance Code.The:nearest acceptable point of discharge,if shown to be adequate,is Catch
Basin#1,as shown on the improvement plans for Subdivision MS 0022-98. Grantee or its successor
shall review such proposal and if deemed to be acceptable,shall quitclaim development rights back
to owner.
