This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330, et. seq. A description of the portion to be
vacated is described in Exhibit "A" and shown on Exhibit "B" attached hereto, and is located in the
Bay Point area.

This vacation request is based on the fact that the street or highway has been superseded
by relocation (S. & H. Code Section 8330).
The Board reviewed and approved the project on June 18, 1996, and determined the
project to be exempt from the California Environmental Quality Act as a Class 12 Categorical
Exception. A Notice of Exemption was fled July 1, 1996. This activity has been found to conform
to the County's General Plan.
This Board declares that-the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes
a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

Real property in an unincorporated area of the County of Contra Costa, State of
California, being a portion of the Northwest % of Section 15, Township 2 North, Range
1 West, Mount Diablo Meridian, described as follows:
Commencing at the most southerly corner of PARCEL 1 (50859-1) as described in the
Final Order of Condemnation," No. C92-01465, filed March 25, 1993, in Book 18381 of
Official Records at page 690; thence along the southwest line of said PARCEL 1 north
58040'51" west 22.96 feet; thence leaving last said line, north 16006'10" west 120.56
feet; thence north 10°11'57" west 66.77 feet to the Point of Beginning; thence from said

DESCRIPTION OF THE ACTIVITY:
The project consists of the vacation of a roadway easement. Pleasant Hill Road was
realigned and the underlying fee owner of the roadway segment (approximately 20 feet
wide by 113 feet wide) has requested its abandonment to incorporate the area into its
development project. Contra Costa County no longer needs the easement.
LOCATION_:
The project is located on Pleasant Hili Road east of Whitfield Court, in the central county
area near the Cities of Pleasant Hill and Martinez. (Figures 1 --3).

This Board hereby FINDS that the proposed vacation will not have a significant effect on
the environment, and that it has been determined to be exempt from the California Environmental
Quality Act under State CEQA guidelines Section 15061 (b)(3) and DIRECTS the director of
Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the
Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for
filing and a $25.00 fee to Community Development for processing of the Notice of Exemption. This
Board having considered the general plan, FINDS pursuant to Govemment Code Section 65402
that in accordance with its Resolution No. 81/522 this vacation is minor in nature and-therefore
exempt from general plan conformance review.

AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to Community
Development for processing, and a $25 fee to the County Clerk for filing the Notice of Exemption.
11. FINANCIAL IMPACT:
The estimated project cost is $99,000.00, funded by Transportation Fund for Clean Air(90%)and
Measure C (10%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
This project consists of minor road widening; installing concrete curb, gutter, and sidewalk; bike
lane signing, striping, and lane markings along the 8-mile bikeway corridor from Rodeo Transit
Station in Hercules (Fig. 3) to Del Norte BART Station in EI Cerrito (Fig. 8). The route will be a
combination of Class 11 (bike lane striping and signing) and Class Ill (bike route signing only)
bikeway throughout the project. A section of San Pablo Dam Rd. between Morrow Dr. and Alpine
Road (Fig. 7) need to be excavated and widened approximately four feet in order to accommodate
Class II bike lanes and concrete sidewalk. An encroachment permit will be obtained from
Caltrans, so that traffic can be routed around the project areas. Each city (Hercules, Pinole, EI
Sobrante, San Pablo, and EI Cerrito)will issue a "No Fee Encroachment Permit"to the contractor,
as stated in the Letter of Understanding between the County and the Cities. No additional right
of way is required. Some trees and shrubs may need trimming throughout the project limits.
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because it can be seen with certainty that there is no possibility that the activity may have
a significant adverse effect on the environment. The project consists of the creation of bicycle
lanes within existing rights-of-way, which is a minor public alteration in the condition of the land
and vegetation. No scenic resources will be removed as a result of the activity. This project is
consistent with CEQA Guidelines § 15034. No scenic resources will be removed as a result of
the activity.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize
funding.

based on the following: The project consists of the creation of bicycle lanes within existing rights-of-way, which
is a minor public alteration in the condition of the land and vegetation. No scenic resources will be removed as a result

of minor road widening; installing concrete curb, gutter, and sidewalk; bike lane signing, striping,
and lane markings along the 8-mile bikeway corridor from Rodeo Transit Station in Hercules (Fig.
3)to Del Norte BART Station in EI Cerrito (Fig. 8). The route will be a combination of Class 11 (bike
lane striping and signing) and Class III (bike route signing only) bikeway throughout the project.
A section of San Pablo Dam Rd. between Morrow Dr. and Alpine Road (Fig. 7) need to excavated
and widened approximately four feet in order to accommodate Class II bike lanes and concrete
sidewalk. An encroachment permit will be obtained from Caltrans, so that traffic can be routed
around the project areas. Each city (Hercules, Pinole, El Sobrante, San Pablo, and El Cerrito)will
issue a "No Fee Encroachment Permit" to the contractor, as stated in the Letter of Understanding
between the County and the Cities. No additional right of way is required. Some trees and shrubs
may need trimming throughout the project limits. Project location: West County area through
Hercules, Pinole, El Sobrante, San Pablo, and El Cerrito. Along portions of San Pablo Avenue,
Appian Way, San Pablo Dam Road, McBryde Avenue, Amador Street, Clinton Avenue, Conlon
Avenue, and Key Boulevard. (Figures 1-8)

The estimated project cost is $276,244.00, funded by Caltrans Environmental Enhancement and
Mitigation Grant (69%) and Landscaping/Lighting Assessment District, Zone 36 (31%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project consists of planting trees, shrubs, and bulbs on 60,000 square feet along
approximately 1 mile of Stone Valley Road. Twenty-five trees will be planted in accordance with
the Stone Valley Road Improvements project. Three hundred and sixty trees will be planted to
enhance Stone Valley Road. Trees and vegetation were chosen as to re-introduce native trees
and shrubs and for their resistance to frost, drought, smog, and wind; their tolerance of poor soil
conditions; their ability to encourage the return of wildlife, and; their capability to offset vehicular
emissions and provide shade cover (large crowning trees).
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because it can be seen with certainty that there is no possibility that the activity may have
a significant adverse effect on the environment. The project consists of minor alterations in the
condition of land, water and/or vegetation as identified in Section 15304. No scenic resources will
be removed as a result of the activity.
The Notice of Exemption was previously filed by the County Clerk on April 27, 2000.
