SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
L Recommended Action:
AUTHORIZE William R. Gray and Company, as General Manager of the Blackhawk Geologic Hazard
Abatement District(GHAD),to EXECUTE amendments to the existing License Agreements with John and
Nancy Dommes,property owners at 189 Silver Pine, and David Strahorn and Barbara Kortes,property owners
at 190 Silver Pine,not to exceed a total of$58,435,to provide for reimbursement of landscaping and other
improvements damaged in conjunction with the GHAD's repair of the Silver Pine landslide,Danville,
California.
IL Financial Impact:
No impact on the County General Fund, The Blackhawk GHAD is funded through revenues generated by
County Service Area M-23. Expense reimbursement authorized in the proposed amendment is consistent with
the adopted FY 99/00-program budget.

III. Reasons for Recommendation and Background:
During the winter of 1998, a landslide occurred in the rear of two homes on 189/190 Silver Pine in
Blackhawk,Danville, California. The landslide occurred within the boundaries of the Blackhawk CHAD.
The repair of the landslide is substantially complete.
GRAD policies and practices provide for the replacement of landscaping, fencing and other improvements
damaged by the landslide or during its repair.
Standard form License Agreements were executed on November 10, 1998 with the two homeowners(Dommes
and Strahorn/Kortes)and provided the CHAD with the necessary rights and indemnification to proceed with the
repair, with the understanding that the agreements would be subsequently amended to provide for partial
reimbursement to the homeowners for the cost of repairing and/or replacing damaged landscaping and other yard
improvements.
William R. Gray and Company, as General Manager of the Blackhawk GRAD, is in the process of negotiating
the amount each property owner shall receive for reimbursement of landscaping that was damaged by the original
landslide and/or the CHAD's contractors. It is recommended that the Board of Directors authorize the General
Manager to execute amendments to the above referenced license agreements in an aggregate amount not to
exceed 10'/0 of the total contract, or $58,435.00, to provide for reimbursement of landscaping and other
improvements damaged in conjunction with the GHAD's repair of the Silver Pine landslide.
IV. Consequences of Neggtive Action:
If the amendments are not approved,the owner(s)will not receive reimbursement for damaged landscaping

APPROVE the Plans and Specifications for the San Ramon Creek Drop Structure 3A
Rehabilitation Project and
ADVERTISE for bids to be received on Tuesday, June 20, 2000, at 2:00 p.m.
DIRECT the Clerk of the Board to publish the Notice to Contractors in accordance with Section
22037 of the Public Contract Code, and

SUBJECT: Approve Plans and Specifications and Advertise for bids for the San Ramon Creek

II. FINANCIAL IMPACT:
The estimated contract cost of the project is $71,000, funded by Federal Emergency Management
Agency (75%), State of California (20%), Flood Control Zone 3B (5%).
111. REASONS FOR RECOMMENDATIONIBACKGROUND:
The project is needed to repair a failed subdrain system and concrete apron on Drop Structure
3A in San Ramon Creek.
The Chief Engineer has filed with the Board of Supervisors the Plans and Specifications for the
project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project, have
been filed with the Clerk of the Board and copies will be made available to any interested party
upon request.
The Board reviewed and approved the project on May 16, 2000 and (a) determined the project
to be exempt from the California Environmental Quality Act as a Class 1 d Categorical Exemption,
A Notice of Exemption was filed with the County Clerk on March 9, 2000,
IV. CONSEQUENCES OF NEGATIVE ACTION:
If the project is not approved for advertising, it will not be constructed.
