SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
AWARD the contract for furnishing labor and materials for the subject project to California
Pavement Maintenance Company, Inc., the low bidder, in the amount of$527,143.63 and at the
unit prices submitted; and REQUIRE the contractor to present surety bonds for Payment and
Faithful Performance in the amounts of$527,143.63 and $527,143.63, respectively.
DIRECT the Public Works Director to prepare the contract for the project.
AUTHORIZE the Public Works Director to sign the contract on behalf of the Board subject to the
Director having reviewed and found sufficient all required documents, including the contract
signed by the contractor, the aforementioned surety bonds, and a certificatep6f insurance.

I. RECOMMENDED ACTION: (continued)
DIRECT that, in accordance with the project specifications and/or upon the execution of the
contract by the Public Works Director, any bid bonds posted by the bidders be exonerated and
any checks or cash submitted for bid security be returned.
Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under
Public Contract Code Sections 4107 and 4110 to the Public Works Director or his designee.
Pursuant to Section 6705 of the Labor Code, the Board also DELEGATES to the Public Works
Director or to any registered civil or structural engineer designated by him the authority to accept
detailed plans showing the design of shoring, bracing, sloping or other provisions to be made for
worker protection during trench excavating covered by that section.
DECLARE that, should the award of the contract to California Pavement Maintenance Company,
Inc. be invalidated for any reason, the Board would not in any event have awarded the contract
to the second listed bidder or any other bidder, but instead would have exercised its discretion to
reject all of the bids received. Nothing herein shall prevent the Board from reawarding the
contract to another bidder in cases where the successful bidder establishes a mistake, refuses
to sign the contract or fails to furnish required bonds or insurance (see Public Contract Code
Sections 5100-5107).
IL FINANCIAL IMPACT:
The project, including engineering and appropriate overhead charges, is funded by Road Funds
(100%).
Ill. REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The plans and specifications were approved and the project advertised for bids by the Board of
Supervisors on March 28, 2000. The bids were received and opened at 255 Glacier Drive,
Martinez, California, on May 2, 2000. The construction bids received were as follows:

I. RECOMMENDED ACTION:
REJECT all bids received on April 25, 2000 for the Delta Road Bridge Replacement Project and,
DIRECT that any bid bonds posted by the bidders are to be exonerated and any checks or cash
submitted for security shall be returned.
APPROVE the Plans and Specifications for the Project and
ELECT to use the alternative bidding procedures of Public Contract Code Sections 20390-20397
to expedite completion of the above bridge project.

Replacement Project in the Knightsen area.

ADVERTISE for bids to be received on Tuesday, June 6, 2000, at 2:00 p.m.
DIRECT the Clerk of the Board to publish the Notice to Contractors in accordance with Section
20392 of the Public Contract Code.
AUTHORIZE the closure of Delta Road Bridge between 10 p.m. and 5 a.m. for approximately four
nights.
111. FINANCIAL IMPACT:
The estimated contract cost of the project is $731,000, funded by Highway Bridge Rehabilitation
and Replacement (Federal) Funds (80%), Road Funds (20%).
1111. REASONS FOR RECOMMENDATION/BACKGROUND:
The project is needed to replace an aging, one-lane bridge with a two-lane, concrete bridge.
The Public Works Director has filed with the Board of Supervisors the Plans and Specifications
for the project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project, have
been filed with the Clerk of the Board and copies will be made available to any interested party
upon request.
Rejection of all bids is in the County's best interest, and the Public Works Department
recommends that all bids be rejected. Pursuant to Public Contract Code Section 22038, as well
as the Notice to Contractors, the Board in its discretion may reject all bids.
The Board reviewed and approved the project on March 21, 2000 and found, on the basis of the
initial study and all comments received, that there is no substantial evidence that the project will
have a significant effect on the environment and adopted the Negative Declaration in compliance
with the California Environmental Quality Act. A Notice of Determination was filed with the County
Clerk on March 23, 2000.
In 1993, the County adopted the Uniform Public Construction Cost Accounting Act for County
construction projects (see Ordinance No. 93-60). Pursuant to County Ordinance Code Section
1108-3.210, the Act does not apply where other statutory authority is available and the County
elects to use such alternative procedures. Sections 20390-20397 of the Public Contract Code,
which normally apply to construction contracts for County highways, provide alternative authority
and procedures for the bridge project. In particular, Section 20392 would allow a shorter bid
advertising period than that required under the Uniform Public Construction Cost Accounting Act.
To accommodate the above project schedule, it is recommended that the Board elect to use the
alternative procedures of Sections 20390-20397.

be jeopardized.

The Board of Supervisors of Contra Costa County RESOLVES that:
The County of Contra Costa on December 30, 1998 contracted with Steiny and Company, Inc., for
installing signal interconnect, highway lighting, and minor concrete work, with Liberty Mutual Insurance
Company as surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of May 15, 2000.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

II. FINANCIAL IMPACT:
The estimated contract cost of the project is $335,000, funded by Measure C (100%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project is needed to reconstruct a street that has extensive base failure and to replace curb
and sidewalk that were damaged by the adjacent slide.
The Public Works Director has filed with the Board of Supervisors the Plans and Specifications
for the project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project, have
been filed with the Clerk of the Board and copies will be made available to any interested party
upon request.
The Board reviewed and approved the project on december 14, 1999 and determined the project
to be exempt from the California Environmental Quality Act as a Class 2C Categorical Exemption.
A Notice of Exemption was filed with the County Clerk on December 16, 1999.
IV. CONSEQUENCES OF NEGATIVE ACTION:
If the project is not approved for advertising, it will not be constructed.
