(See attachment A) Staff of the County and ten cities has jointly hired Miller & Van Eaton P.L.L.C. and the Buske Group to conduct the necessary studies in preparation for cable franchise renewal negotiations. As part of this renewal process and in cooperation with the ten cities, the Buske Group conducted a telephone survey in October 1999 and 409 interviews were completed. in November, ten focus groups were conducted by the Buske Group throughout the County with over 170 people participating. To afford an opportunity for additional community input on customer service and technical standards (outages, picture quality) and future cable related needs, the County and the cities are holding public hearings. The information from these hearings will be included in the draft needs assessment report that will be submitted by the Buske Group in April and will be part of the information used to develop a negotiation strategy by the County and the cities. 2 ADDENDUM TO ITEM D. 2 April 4, 2000 Agenda On this date,the Board of Supervisors conducted a hearing to consider comments from citizens in the unincorporated area of Contra Costa County on AT&T Cable Services' performance and future cable-related needs of the community. (See the attached Board Order). Patricia Burke, Executive Director, Contra Costa Television(CCTV)presented the staff report. The Board briefly discussed the matter. Lowery DATE: March 13, 2000 RE: Renewal/Needs Assessment Status Summary This memorandum will review the requirements of the federal Cable Act governing franchise renewals, summarize the types of issues commonly addressed in cable franchise renewals, briefly discuss the assessment of future cable-related needs that the Contra Costa County Telecommunications Coordinators Group has performed to date, and advise the Group and residents of the member communities on the next steps to be taken. (Jur goal at this stage is to gather additional information from the residents of each community through public hearings. Such public input is an important part of the needs assessment process, and it will be used to help identify the goals for the communities as they negotiate renewal franchise agreements with AT&T. This information will also be used to begin preparing initial drafts of a new franchise agreement, and to prepare revised versions of a draft cable ordinance. We hope that this memorandum will help residents better understand the process, and give them a framework for participating in the public hearings. The Cable Act. Federal law establishes a mechanism for renewing cable franchises that imposes significant limitations on local governments. The Cable Act states that if a cable operator invokes the procedures of the Act, which is referred to as"formal renewal,"a franchising MILLER& VAN EATON,P.L.L.C. - 2- authority can only deny renewal of the franchise if it takes certain steps and applies certain standards. Communities and cable operators have the option of negotiating a so-called "informal"renewal outside the formal procedures established by the Act, but the operator always has recourse to the formal procedures if negotiations do not proceed to its liking. This gives the operator a powerful negotiating position, and makes it very important for the City to make the most of the leverage that it has. Under the formal renewal process, each community can only deny renewal if it first issues a formal request for renewal proposals. The operator then must submit a response for the community to evaluate. The community is permitted to consider only four factors in evaluating the proposal. These are(i)whether the cable operator has substantially complied with the material provisions of the current franchise; (ii)the quality of the operator's services; (iii) whether the operator has the financial, legal and technical ability to provide the services set forth in the proposal; and(iv)whether the proposal meets the fixture cable-related needs and interests of the community. The community must then either grant the renewal franchise, or preliminarily deny renewal. If renewal is denied,the operator has the right to ask for an administrative proceeding,which operates much like a trial. If renewal is finally denied as a result of this proceeding,the operator has the right to appeal the denial in federal court. The formal process is burdensome,expensive, and time-consuming. Consequently, practically all franchises are renewed under the informal process. But communities typically go through the preliminary steps of the formal process and conduct needs assessments designed to address the standards under which renewal may be denied. Conducting a needs assessment both gives some direction for informal negotiations, and strengthens the community's negotiating position with the operators. If the operator knows that no needs assessment has been conducted, or that the needs assessment is weak,the operator will be less likely to make concessions in negotiations. If it becomes necessary to issue a formal request for renewal proposals, communities often find that their initial needs assessments must be supplemented and strengthened. The Communities' Needs Assessment. The Group intends to pursue informal negotiations, and has retained The Buske Group ("Buske")to conduct a needs assessment, consisting of, among other elements, (1) a telephone survey, and(2)community focus groups,to assess, among other things,the communities' public, educational, and government access needs and interests. Buske has completed the telephone survey and conducted a series of focus groups,and is currently preparing a draft needs assessment report. In addition, the Group retained Columbia Telecommunications Corporation ("CTC")to conduct a technical evaluation of the cable system. CTC is currently working with the franchisee to inspect the system as part of the evaluation process. Residents may be interested in knowing more about what issues are commonly addressed in cable franchise renewals in other communities. These include: MILLER+cit VAN EATON,P.L.L.C. � — 3 - Institutional Network(I-NET): An I-Net is a telecommunications network which links key government buildings and schools together through the use of fiber optic technology. An i- Net can be used by the community government, other governmental units, and the schools to communicate internally, and to enhance communications with the public. Among other things, an I-Net could be used to cut the City's communications costs; provide advanced communications capabilities; and provide high-speed connectivity to schools and community colleges that can enhance learning opportunities. System Upgrade: A strong commitment by the operator to upgrade the cable system to the state-of-the-art, so that it provides more cable services and other advanced services, such as internet services. Public,Educational,and Government(PEG)Channels: An agreement to provide channels that can be used by government, schools,non-profit organizations and members of the public, as well as the equipment, facilities and support required to make use of these"access" channels. Increased Customer Service Standards: Stronger customer service requirements, such as commitments to telephone answering time,appointment scheduling, service call response time, etc., as well as strong penalties for non-compliance. We cannot provide a detailed summary of the needs assessment findings at this time, because the community input from the public hearings must be factored into the initial findings before the Buske report can issue. however,the initial needs assessment findings to date appear to indicate a community interest in several of the franchise renewal issues mentioned above. For example,the initial Buske findings appear to show a strong community interest in public, educational, and government access programming. In addition,the needs assessment to date appears to indicate a need the availability of newer, advanced telecommunications and cable services. We anticipate that the CTC technical evaluation will show that the current system cannot provide such services -- which, combined with the initial Buske findings,will indicate that the system must be rebuilt if it is to meet community needs and interests. Additionally,the needs assessment to date appears to indicate a dissatisfaction with the operator's customer service performance, which would support the need for stronger customer service standards in the renewed franchise. It is important to note that these general findings are preliminary, and may be modified as a result of the public hearings. The initial needs assessment report will contain a specific and detailed statement of needs and interests based on all the information gathered by Buske. M LLER tit VAN EATON,P.L.L.C. - $- Purpose of the Public Hearings The public hearings will help each community answer this question: What matters to the community and what does it want out of the renewal process? The needs assessment process as a whole is designed to identify"the cable-related needs and interests" of the communities. Those needs and interests can cover a broad range of issues, as the list above demonstrates. In essence,the public hearings are intended to give residents the opportunity to describe their concerns regarding cable service, both with respect to the types of services and capabilities that residents would like to see made available over the cable system, and with respect to current and past problems that they wish to see addressed or avoided in the future. We encourage residents to make their views known—views cannot be considered in the needs assessment if they are not expressed in some fashion. The list of issues above includes items that may or may not apply in a given community because each community has its own needs and interests, although most communities find that most items on the list apply in one form or another. In addition,the list is not comprehensive—a particular community may have special concerns that do not appear. This makes public participation all the more important. Next Steps At the conclusion of the public hearing process, the Buske Group will complete the draft needs assessment report. CTC, upon completing its audit of the current systems,will issue a technical audit report. These reports should form the basis for developing negotiation strategy. In the meantime,we will begin preparing a draft franchise agreement,and continue work on a draft cable ordinance. µ � January 24, 2000 Dear Cable Community Needs Assessment Focus Group Participant: You may recall that a public hearing before the Walnut Creek City Council was planned as part of the needs assessment process. I am representing; the Latina Leadership Council of Contra Costa ('LLC). The Latina Leadership Council was established in 1998 as a mutually supportive Latino leadership network to empower and serve the multi-cultural community of Contra Costa County. LLC was .formed to forge relationships, consolidate resources, mentor emerging Latino leaders, and work collaboratively to address issues that affect Latinos in. Contra Costa. Currently, we have an over 300 members representing East, West, Central and South Contra Costa County. Our milestones in the last year include: • The establishment of five (5) Action Committees: Education, Political.Advocacy, Health and Community Services, Youth Leadership Development and Economic Development. • Sponsored three (3) Community Summits: Latino Leadership in March 1999; Latino Leadership Council Meeting in May 1999 ; and Advocacy & Community Mobilization 2000 in September 1999. • In December 1999, we secured funding for the development of a Strategic Plan 2000 - 2005 with a specific component addressing health issues in East and Central County. We are currently in the process of hiring a facilitator to help us complete this project. We are a volunteer organization. Alvarado Summary of Proposal To improve the immunization levels of young children from the largest ethnic group in Contra Costa County and the San Francisco Bay .Area, the goal is to launch a one year pilot Radio Program that would provide educational information regarding young children's general health issues, with an emphasis on immunizations to the wide Spanish speaking audience. Because of the documented efficacy of radio as a information dissemination tool in the Spanish speaking community, it is anticipated that the Radio Program would help reach the US Public Health Service's Healthy People Year 2000 goal to have 90% of 0-2 year olds fully immunized. Goal: Increase the immunization levels of Hispanic young children in Contra Costa County and the greater San Francisco Bay Area. Develop a creative immunization enhancement outreach strategy that can become a California model and be replicated. By: Use of Radio, because it is the most important information disseminating media in the Hispanic community. Rationale: Immunization information from radio is an important predictor of Hispanic children's timely immunizations. Sixty eight percent (68%) of Hispanic parents that had children up-to-date, reported hearing immunization information on the radio. Nation wide, Hispanic families are targeted with educational/health media massages in Spanish. Ob ectives of the Educational Radio Program: 1. Weekly radio program for a period of 12 months. This format provides an effective way to reach a target audience with important health/immunization educational messages. 2. Professional host of the program, Dr. Gloria Sotelo. Dr. Sotelo is a doctor from Mexico with many years of experience in mass communication and media campaigns. Coordinated the very successful state wide Latino media campaign for the State Department of Health Services, Immunization Branch during the years 1995, 1996, 1997. 3. Weekly Professional Health Specialists as radio program guests discussing and providing health information with a Latino perspective. 4. Wide audience reach because of the prime time radio availability that will be sought. Program the hours of the radio program during the time that most young Latina mothers who are at home listen to radio. 5. Documented acceptability by the targeted population. Research shows that Latinos prefer information in Spanish. 6. Develop a collaboration with organizations in the commercial market who will be identified as "Ambassadors" for children's well being to sponsor the Radio Program. 7. Develop an outreach/health education model that incorporates Public Health needs and the sponsorship of the Private sector. 8. Demonstrate the success of the project. Mid year, develop an evaluation of the Radio Program. 9. Increase the immunization levels of the largest single,group of babies in California. 10. Collaboratively,with corporate support reach the national year 2000 goal: 90% fully immunized children 0-2 years of age in the United States. r i! s Statement of Need The lastest 1998 Kindergarten Retrospective Survey, conducted by the Department of Health Services,Immunization Branch, Berkeley, California, shows that while immunization levels continue to increase throughout California, all counties appeared unable to reach the 1998 goal of having 80%of young children fully immunized by 2 years of age. There are two immunization goals that have been established for 2 year olds. The California State goal is 80% fully immunized by the end of 1998. The National goal, set by the US Public Health Services HEALTHY PEOPLE INITIATIVE is to have 90%of 2 year olds fully immunized by the year 2000. "While our geographic region,the San Francisco Bay Area, has the highest immunization rate in California, 67.7%, this rate is in need of dramatic additional outreach/intervention to reach the 90% goal by the year 2000. According to focus groups and clinic surveys with Hispanics, it is the lack of information that has been identified as one of the principal reasons for low immunization rates. Hispanics are a people who feel that "It is their responsibility, as good parents to keep their children safe and healthy", and who want more information regarding immunizations and infant care. Ethnicgroups in California have generally low immunization rates. Of all ethnic groups, Hispanics have the largest population numbers, including the largest baby population. Currently, fifty percent(50%) of all hospital births are Hispanics. The Hispanic population growth during 1980 exceeded all other groups combined. From 1980 to 1990, the Hispanic population had approximately a 64% increase in the Bay Area. Hispanic households are larger and younger than the general population. The average age of Hispanics parents with young children is twenty-six years of age(21% younger than the general population). In all State Department of Health Services Immunization Branch Kindergarten Retrospective Surveys, Hispanics and African-Americans have had lower rates than White, and Asians. (Sub- groups of Asian ethnicity, including Southeast Asian, Filipino, and Pacific Islander had too few children included in the survey to allow specific conclusions about their immunization rates.) Hispanics have the highest actual numbers of under immunized children because of the high percentage they represent in the total California population. African-Americans represent 7.5% of the total California population,while Hispanics represent approximately 30% of the California population and have the largest population of babies in the targeted age group, 0-2 years of age. Additionally, Latino children have been disproportionately impacted in children's disease epidemics. Between 1988 and 1991, the nation experienced an unprecedented measles epidemic. At the peak of the epidemic in 1990, over 500 cases of measles were reported each week(a total of 27,672 cases), compared to 18,193 cases reported for 1989. In California, over 12,504 cases were reported, resulting in 31 deaths and over S21 million in medical care costs. The majority of deaths were among children agefour and under. The epidemic had a disproportionate impact on Latino children. Of the 28,000 arses reported nationwide in 1990, 19%were among Latinos even though Latinos only comprise 9%of the US population (1998 = 10916). In California, 40%or 5,051 cases, were among Latinos. Even more alarming is that in 1992, while the number of reported cases of measles fell to nearly 2,000 Latinos accounted for 45% (997) of the cases for that year. Developing a Radio Program targeting Hispanics with immunization education and other health issues would be reaching a prime population in California. In a Los Angeles study,the authors found that for Hispanics families "exposure to information from the media was a very important predictor of child's timely receipt of the first immunization". In a survey conducted by the State Department of Health Services Immunization Branch in 1993, it was found that Hispanics validate the importance of immunizations and want more information made available to them in a linguistically and culturally appropriate manner. The use of radio as a means of reaching large numbers in the Spanish speaking communities has a long tradition. Currently in Mexico radio talk programs which present valuable information, from health issues to international news are very popular. Educational efforts implemented by means of radio have proven to be effective in relaying essential information on the importance of immunizations in Mexico. Here in California, both first generation and the majority of Hispanics of second and third generation listen to Spanish language radio programs. The 1993 survey conducted by the State Department of Health Services documented the Hispanic preference for the Spanish language regarding important messages directed to them. Spanish language radio remains the number one communication vehicle in the Hispanic communities, Methodology The proposed radio program will be weekly for one year, approximately 52 actual programs. Air time is to be negotiated(possibly 15 minutes minimum to 1/2 hour maximum). The following proposed budget is for a'/2 hour radio program. Dr. Gloria Sotelo will coordinate, host and moderate the program. A clerical assistant will provide general assistance and will monitor, document, tally, and screen calls made to the program. Answers to questions will be replied to on the radio program. Listeners will be encouraged to call and write, and periodically the radio program will host small special events using incentives for listener participation. The majority of the radio programs will be pretaped. Dr. Sotelo and the weekly guest speaker, who will be a local professional medical expert, will solely address issues and questions dealing with the medical specialty of the guest speaker. The weekly radio programs will have preselected topics that are announced to the public one week in advance. A typical radio program would be structured per the following format: * Welcome, outline the day's program, and covering secondary topics, e.g., information regarding health events occurring in the different areas that are reached by the radio program, and answering questions received from the public. * Interview with a Professional Medical Specialist to talk about the "main topic's of the week. * The State of California immunization jingle "2-4-6" will be used to break into station identification and sponsors' identification. Some examples of programs include: An anthropology course which explores a wide range of different cultures • A health science course that not only looks at diseases,but considers lifestyle choices in diet exercise and stress management; • An ethics course that considers such questions as the responsibility of the press and whether soldiers should follow orders that violate international conventions, and • A political science course that looks at the functioning of government on the federal, state and local levels. Contra Costa College is also using our channel for live, interactive teleconferences that are primarily aimed at high school students and special populations. In the last three years we have held 35 of these conferences on topics such as AIDS prevention, services for special-education students, financial aid for college, issues facing immigrants, and teen pregnancy.
