FISCAL IMPACT
None. The cost for processing the extension is borne by the applicant.
DISCUSSION/RECOMMENDATION
The Board of Supervisors approved the Stone Valley Oaks project on May 25, 1999 for
construction of 47 homes on 100 acres. The approved permit allows the applicant three years
to file the final map. In addition, Section 65863.9 of the Government Code provides that permits
(e.g. preliminary and final development plans) issued "in conjunction with the vesting tentative
map for a planned unit development shall expire no sooner than the approved tentative map,
or any extension thereof, whichever occurs later."

BACKGROUND/REASONS FOR RECOMMENDATIONS
The site involves a 26-acre parcel within the Alhambra Valley area. The site has access from Reliez
Valley Road at Lomas Verdes.
In 1987, the subdivision was originally submitted as a 29-lot proposal which included a rezoning to a
Planned Unit District and a Final Development Plan. An EIR was prepared and certified for the
project. Through the processing of the application and the recommendations of the Commission, the
project was ultimately approved by the Board of Supervisors for 22 lots under the single-family
residential zoning (R-20).
As outlined in the attached letter from the owner's attorney, and verified for accuracy by planning staff,
the original subdivision was approved on February 12, 1991. Due to economic considerations and
a change in ownership, a map has yet to be filed. The original approval was granted for a period of
three years. Permitted extensions under the Subdivision Map Act kept the map active for a total of
9 years, up to February 12, 2000.
The applicant indicated in the letter that the final map and improvement plans are currently under
review by the Public Works Department. If the final map is not filed within the additional year
requested,the applicant will have the opportunity to apply for one additional one-year extension under
the Subdivision Map Act.

Dear Dennis.
Please consider this letter a request to extend the term of the Seclusion Valley Tentative
Subdivision Map No. 6884 for one more year. Please see the copy of the enclosed letter
dated November 24, 1998 from Patricia Curtin to Jim Ball confirming the Community
Development Department determination that the tentative map does not expire until February
12, 2004. As discussed with and confirmed by the Community Development Department
last Fall, the tentative map may be extended for an additional term of one year.
The final map and improvement plans have been in plan check at the Public 'Works
Department for several months. We anticipate that that final plan check will be completed
soon. California Pacific Bank intends to complete the final subdivision map process at the
earliest possible opportunity.
My understanding is that the Contra.Costa County Planning Commission was the advisory
agency that made the final decision to approve Seclusion Valley Tentative Map No. 6884.
Therefore, my understanding is that pursuant to the Contra Costa County Ordinance Code
Section 94-2.610, this request for an extension of the term of the tentative map is to be
presented by the Community Development Department to the Contra Costa County Planning
Commission.

RECOMMENDATION(S):
1. Adopt the attached Resolution of Application to the Local Agency Formation Commission (LAFCO)
to detach the territory of the Oakley Fire Protection District contained in the Cypress Lakes &
Country Club project (Subdivision 7562) and attach said territory to the Bethel Island Fire Protection
District and to amend the Spheres of Influence of the Oakley and Bethel Island Fire Protection
Districts.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
1. The Cypress Lakes and Country Club project is currently in both the Bethel Island and Oakley Fire
Protection Districts. Annexation to one district from the other district is required in the Conditions of
Approval for the subdivision. The property owner has made the decision to annex to the Bethel
Island Fire Protection District and detach from the Oakley Fire Protection District.
2. When the Board of Supervisors, acting as governing body of each of the two fire districts, adopts a
resolution of application for a reorganization of all or any part of the districts the Local Agency
Formation Commission shall approve, or conditionally approve, the proposal. (Government Code
56639)
3. This application will accompany the landowner petition, (LAFC 00-16), tentatively scheduled for the
May 10, 2000 LAFCO meeting.

1} Suspend earthmoving or ether dust-producing activities during periods
of high winds;
2} Provide equipment and personnel as necessary for watering of all
exposed or disturbed soil surfaces. An appropriate dust suppressant,
added fo.water before application, should be utilized;
3) Water or cover stockpiles of debris, soil, sand or other materials that can
be blown by the wind;
4) Sweep adjacent streets of all mud and debris, since this material can be
pulverized and later resuspended by vehicle traffic,

5) Water, seed, cover or apply dust suppressants to completed cuts or
graded areas as soon as grading activities cease,
6) In addition to the dust control measures proposed as part of the project,
the project applicant should post the name and phone number (business
and non-business hours) for the dust control coordinator along the
perimeter of each construction site and provide this information by mail
to residents within 1,000 feet of the area of construction;
7) Earthmoving and other dust-producing activities should be suspended
when watering and other dust control measures are unable to eliminate
visible dust plumes.

65. The proposed new fire station on the project site shall be operational prior to the
occupancy of the first homes on the site. The fire station shall meet all applicable
requirements of the appropriate fire district (Oakley Fire-Protection district or Bethel
Island Fire Protection District or their successor). if necessary, a special district fee
may be required to augment and provide adequate funding to fully staff the new
station.
_._66. Prior to recording the parcel map for Phase 1, the site shall have been annexed into
either the Bethel Island Fire Protection district or the Oakley Fire Protection District or
their successor.

67. Prior to construction of the various residences on this site, landscaping plans for
frontyard landscaping of the residences shall be submitted to the Zoning Administrator
for review and approval. The landscaping plan shall include an alternative landscaping

areas of this site shall be installed prior to occupancy of residences.

The Board of Supervisors of the County of Contra Costa, acting as the governing board of the Oakley and
Bethel Island Fire Protection Districts, hereby requests that the Local Agency Formation Commission of Contra
Costa County concurrently 1) approve the detachment of the territory of the Oakley Fire Protection District
contained within the southern portion of subdivision 7562 (known as the Cypress Lakes & Country Club
Project), 2) approve the annexation of the detached portion to the Bethel Island Fire Protection District, 3)
amend the spheres of influence of the Oakley Fire Protection District and the Bethel Island Fire Protection
District.
1. This proposal is made pursuant to the Cortese-Knox Act, Government Code section 56500 et seq.
2. The nature of this proposal is a reorganization consisting of 1) the detachment of the portion of
Subdivision 7562 (known as the Cypress Lakes & Country Club project) that lies within the boundaries
of the Oakley Fire Protection District along with a concurrent amendment of the sphere of influence of
the Oakley Fire Protection District to accommodate this detachment, 2} the concurrent annexation of
the detached portion of the Oakley Fire Protection District to the Bethel Island Fire Protection District
along with the concurrent amendment of the sphere of influence of the Bethel Island Fire Protection
District to accommodate the annexation. The reason for the reorganization is that Subdivision 7562 is
in both fire districts. Annexation to one district and detachment from the other district is required on the
conditions of approval for the subdivision. (Exhibit A) An application from the Board of Supervisors will
accompany the landowner petition of application (LAFC 00-16)which has been filed by the property
owner to LAFCO. (Exhibit B)
3. The boundaries of the territory of the detachments and annexations and of the sphere of influence
amendments are set forth in Exhibit C (map of the area).
4. The persons to be informed as to any notice of proceedings and to receive copies of any reports of the
Executive Officer are:
