5. ADOPT the Evora Road/Goble Drive General Plan Amendment, as recommended by staff,
changing the land use designation for the subject sites to Commercial (CO) on the Land
Use Element map, as the first consolidated General Plan Amendment for 2000 (see Exhibit
"All);ll);
6. APPROVE the rezoning of the subject sites from General Agriculture (A-2) to General
Commercial (C);
7. INTRODUCE ordinance giving effect to the rezoning, waive reading, and set date for the
adoption of same; and,
8. DIRECT staff to post the Notice of Determination for both the General Plan Amendment and
rezoning approvals with the County Clerk.
FISCAL IMPACT
None. All staff costs for the General Plan Amendment and Rezoning are covered by a fee
charged to the applicant.
BACKGROUND/REASONS FOR RECOMMENDATION
The Contra Costa Transportation Authority (CCTA) and Real Property Division, Contra Costa
County Public Works Department have requested an amendment to the Land Use Element of
the County General Plan and rezoning to redesignate the following parcels in the Bay Point
area to Commercial (CO): Site # 1: Goble Drive - 2.91 acre site located at the southwest corner
of realigned Willow Pass Road and Goble Drive on the northside of Highway 4; and, Site #2:
Evora Road - 2.35 acre site located on the southside of Evora Road, west of realigned Willow
Pass Road opposite Pomo Street on the northside of Highway 4. The County Public Works
Department in the early 1990's acquired the two sites to provide right-of-way for an improved
and realigned Willow Pass Road interchange to Highway 4. The sites are now considered as
surplus and are no longer needed for the public purpose of providing right-of-way for a roadway
improvement.
Most of the Goble Drive site is currently designated under the General Plan as Single Family
Residential-High and Multi-Family Residential-Medium with a General Agriculture (A-2) zoning
designation. The remainder of the Goble Drive site is former public road, which does not have
General Plan or Zoning designations. The Evora Road site is currently designated Single
Family Residential-High under the General Plan with a General Agriculture (A-2) zoning
designation. It is noted that County General Plan Land Use Element map has not been
updated to reflect the roadway improvements and realignment of Willow Pass Road/Highway
4 in the vicinity of the two sites.

BACKGROUND/REASONS FOR RECOMMENDATION -continued
Staff determined that the proposed General Plan land use redesignation and rezoning for the
two sites to a commercial use is warranted because the roadway realignment and highway
improvements have significantly altered their suitability for residential development. The small
parcel sizes (less than 3 acres) surrounded on three sides by roadway and irregular shape of
each site would yield too few units to be economically feasible. Conversely, the sites are now
more proximate to the freeway interchange making the proposed commercial designations
more appropriate.
The East County Regional Planning Commission conducted a public hearing on this matter on
November 8, 1999. At this hearing, several residents of the Crestview Mobile Home Park
adjacent to the Goble Drive site spoke in opposition to the General Plan Amendment and
rezoning. They expressed concern about how a commercial use, which would be adjacent to
the mobile home park, could increase traffic and noise and would pose a potential public safety
problem for the area. In response to these concerns, it was noted by staff that the Goble Drive
site is separated by a masonry soundwall constructed as part of the roadway and highway
improvements. It was also noted that any subsequent development proposal on the site would
be reviewed and evaluated for project specific impacts and mitigation measures in accordance
with CEQA.
In addition to public comments, the applicants (CCTA/CCC-PWD) reviewed for the Commission
the history of right-of-way acquisition for the improved and realigned Willow Pass Road
interchange at Highway 4 In Bay Point. They explained how the sites became remnant and
surplus properties following completion of the highway and roadway improvements. Two
commissioners were concerned that surplus property acquired by a public agency for roadway
right-of-way should be offered back to the original owner to allow them an opportunity to
develop the site. As a follow-up to the commissioners' comments, CCTA staff provided further
background information regarding acquisition of the subject sites (see letter from Paul Maxwell,
Dep. Dir., Projects, CCTA, dated 11/19/99, attached as Exhibit "B")
After closing the public hearing, the East County Regional Planning Commission voted 3-2 to
recommend approval of the General Plan Amendment and rezoning. Staff advised the
Commission that four affirmative votes are necessary to forward an approval recommendation
for a General Plan Amendment to the Board of Supervisors (Govt. Code Sec. 65354, 65361).
The General Plan Amendment and rezoning requests and the associated actions by the East
County Regional Planning Commission have been forwarded to the Board of Supervisors for
consideration.

This is the date and time noticed by the Clerk of the Board of Supervisors for the hearing
on the recommendation of the East County Regional Planning Commission on the request
by the Contra Costa Transportation Authority(OCTA) and Real Property Division,
Contra Costa County Public Works Department, for an amendment to the Land Use
Element of the Evora Road/Goble Drive General Plan to designate parcels in the Bay
Point community as Commercial, (County File#GP 97-0010): The property is located
at: Site#1 Goble Drive--2.91 acre site located at the southwest corner of realigned
Willow Pass Road and Goble Drive on the northside of Highway 4; Site#2 Evora Road--
2.35 acres located on the southside of Evora Road, west of Willow Pass Road opposite
Pomo Street on the northside of Highway 4, Bay Point area, and is a 2.91 acre site and a
2.325 acre site, located near the intersection of State Route 4 and Willow Pass Road,Bay
Point area.
Maureen Toms and Patrick Roche, Principal Planners, Community Development
Department presented the staff report,background and recommendations.
Also present were Dennis Barry, Director Community Development Department and
Silvan Marchesi, Chief Assistant County Counsel.
The Board discussed the matter.
Supervisor Uilkema stated she had concerns with the process. In Recommendation#4,
she said staff would like the Board to accept the vote of the East County Regional
Planning Commission. She said the "normal" process would be that the Planning
Commission has to approve a recommendation by 4 votes to go before the Board—in this
case that did not occur. Supervisor Uilkema then questioned the provisions that would
allow staff to forward the recommendation to the Board, even if the Planning
Commission did not.
Mr. Roche responded that following the 3-2 vote of the East County Regional Planning
Commission, they moved to consider rescinding the vote. The motion failed. The
Planning Commission then forwarded the 3-2 vote to the Board, and acknowledged that
the requirement for 4 votes was not fulfilled according to the Government Code.
Supervisor Uilkema clarified that if a Planning Commission has a requirement that
4 votes are necessary, and staff disagrees, then in the future, the Board can expect to see
staff recommendations contrary to a Planning Commission's approval.
Mr. Roche responded that the Government Code refers to an affirmative
recommendation. A recommendation could still move forward for the Board's
consideration, it just wouldn't have a recommendation from the Planning Commission.

Supervisor Uilkema stated then that the recommendation would come from staff.
Patrick Roche stated that it would, and in this case the Planning Commission requested
that the 3-2 vote be forwarded to the Board of Supervisors for consideration.
Supervisor Uilkema advised that she was concerned about this system. She said it appears
there is a process on which the public relies,there should be 4 votes, and that should be a
recommendation that goes before the Board. In this case, even though that condition was
not met, staff gave the Board the recommendation,that may discount the process on
which the public relies. She stated that she was not comfortable with that,because of
future possibilities that the Board might not be following their own rules.
Public comment was opened, and Steven McCants 83 Geoffrey Drive, Crestview Mobile
Home Park, Bay Point, offered comments.
Those desiring to speak having been heard, the Board considered the issue.
Supervisor Canciamilla advised the Board that this particular interchange would become
a major intersection for Highway 4 and the 2800 homes to be located in the region. He
stated there are concerns about the proximity to the mobile home park, and issues relative
to that could be addressed when an application that comes forward. He stated he would
support the rezoning and trying to mitigate the community issues when a specific plan
comes forward. He then moved the staffs recommendations.
Supervisor Gioia seconded the motion.
Supervisor Gerber reminded the Board that moving the staff s recommendations also
closed the public hearing, The Chair called for the vote,which was as follows:

RESOLUTION NO.35-1999
RESOLUTION OF THE PAST COUNTY REGIONAL PLANNING
COMMISSION, COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA
REGARDING A PROPOSED GENERAL PLAN AMENDMENT (GP 97-0010)
AND REZONING (RZ 99-3078) IN THE BAY POINT AREA.
WHEREAS, on August 30, 1999, The Contra Costa Transportation and Contra Costa County
Public Works Department, Real Property filed related applications pertaining to a General Plan
Amendment and Rezoning (from Agricultural to Commercial) of two parcels, 2.91 and 2.325
acres respectively, located near the intersection of State Route 4 and Willow Pass Road in the
Bay Point area.
WHEREAS, for purposes of compliance with the California Environmental Quality Act
(CEQA), staff determined that the project would not result in any significant environmental
impacts, and a proposed Negative Declaration was posted and noticed as required by law; and
WHEREAS, staff prepared reports recommending changes to the General Plan land use
designation and rezoning for the subject sites and circulated it to interested agencies; and
WHEREAS, after notice was lawfully given, the project was scheduled for hearing before the
East County Regional Planning Commission on November 8,1999, at which time testimony was
taken and, at the conclusion of which, the hearing was closed; and after having fully reviewed,
considered and evaluated all the testimony and evidence submitted in this matter;
NOW,THEREFORE, BE IT RESOLVED, that the East County Regional Planning Commission:
1) HAS CONSIDERED THE PROPOSED Negative Declaration as adequate for
purposes of compliance with California Environmental Quality Act prior to
forwarding a recommendation;
2) VOTED 3-2 to recommend to the Board of Supervisor approval of the Evora
Road/Goble Dr. General Plan Amendment, as recommended by staff, changing
the subject sites land use designation to Commercial (CO);
3) RECOGNIZED that per Government Code Sections 55354 and 65356, an
affirmative vote of the majority of the Planning Commission membership (seven)
is required to forward an affirmative recommendation to the Board of Supervisors
for a General Plan Amendment;
4) RECOMMENDS TO THE Board of Supervisors the APPROVAL of the rezoning
of the sites from General Agricultural (A-2) to General Commercial (C);

BE IT FURTBER RESOLVED, that the East County Regional Planning Commission
makes the following findings pursuant to the Contra Costa General Plan Growth Management
Element and County Code Sections 26-2.1804 and 26-2.1806,
A. Growth Management Performance Standards.
1. Traffic - The proposed change in land use designation and rezoning on the
two sites will not result in an increase of 100 or more peak period trips.
2. The two sites are currently within the following necessary urban service
districts which have an obligation to service the sites:
Water - The subject sites lie within the Contra Costa Water District service
area and the District is capable of serving the sites with the proposed change
in the land use designation and rezoning.
Sanitary Sewer - The subject sites lie within the Delta Diablo Sanitation
District service area and the District is capable of serving the sites with the
proposed change in the land use designation and rezoning.
Fire Protection - The subject sites lie within the Contra Costa Consolidated
Fire Protection District service area and the District is capable of serving the
sites with the proposed change in the land use designation and rezoning.
Public Protection - The subject sites lie within patrol service area of the
Sheriffs Department and the Department is capable of serving the sites with
the proposed change in the land use designation and rezoning.
Parks and Recreation - The subject sites lie within the Ambrose Park and
Recreation District service area and the District is capable of serving the two
sites with the proposed change in the land use designation and rezoning.
Schools - The subject sites lie within the Mount Diablo Unified School
District service area and the District is capable of serving the two sites with
the proposed change in the land use designation and rezoning
The proposed General Plan amendment and rezoning would not cause a violation
of the Growth Management Performance Standards.
B. Rezoning Findings
1. The proposed rezoning to General Commercial will substantially comply with
the proposed General Plan Land Use designation of Commercial.

2. The uses authorized or proposed in the land use district are compatible within
the district and to uses authorized in adjacent district. Currently, there is no
proposed use for the site. Any future use proposed for the site must be
compatible with the general commercial zoning district, if the specific use is
to be authorized.
3. Community need has been demonstrated for the use proposed, but this does
not require demonstration of future financial success. The sites are located in
a Redevelopment Area. Since the sites are close to the highway, there is
potential for development which could be a catalyst for future development
within the redevelopment area.
The decision of the East County Regional Planning Commission was given by on
Monday, November 8, 1999 by the following vote:

NOES: Commissioners-Dell and MacVittie

Julie Pierce 1999,I want to clarify some of the history surrounding the Transportation Authority's request
for the General Plan amendment and rezoning of the Goble drive parcel.

The parcel was acquired by the County Real Property Department as part of the Willow Pass
Grade widening project,which was funded primarily with Measure C half cent sales tax funds.
The Transportation Authority's policy is for our project proponents- in this case the County..to
dispose of excess property as expeditiously as possible,with revenues to be returned to the
Authority. Over the past several years we have consulted with Public Works,Community
Development,the Redevelopment Agency and the Bay Point MAC as to the most appropriate
course of action, given the interest in economic development. Our formal application evolved
from those consultations.
I am not sure that in our presentation we were clear on the prior ownership of the excess parcel.
Of the approximately 127,000 square feet in the excess parcel, 72,000 was the farmer public
right-of-way for Willow Pass Road. (The road was realigned on new right-of-way purchased
with Measure C and subsequently dedicated to the County). Approximately 41,000 square feet
was formerly part of the Walker property,and the balance-only 13,000 square feet was a
storage area for the mobile home park. The owner of the mobile home park asked that the
County acquire that portion of his property as he viewed it as an uneconomic remnant. I believe
the Planning Commission may have thought that the bulk of the parcel had previously been
owned by the trailer park. As you can see,this is not the case.

I. INTRODUCTION
EVORA ROAD/+GOBLE DRIVE GENERAI PI AN AMENDMENT aunty.Pile
#GP97-0010. The Contra Costa Transportation Authority(CCTA) and Real Property
Division, Contra Costa County Public Works Department have requested an amendment to
the Land Use Element of the County General Plan to designate the following parcels in the
Bay Point community as Commercial (CO): Site 41: Goble Drive- 2.91 acre site located at
the southwest corner of realigned Willow Pass Road and Goble Drive on the northside of
Highway 4; and, Site#2: Evora Road -2.35 acre site located on the southside of Evora
Road, west of Willow Pass Road opposite Pomo Street on the northside of Highway 4. The
sites for the requested plan amendment are shown on Figure 1.
H. CEQA AND RELATED ACTIONS
Staff has processed a Negative Declaration of Environmental Significance on this project
and it has been circulated to affected individuals and agencies. Several comments on the
environmental document were received from residents of the adjacent Crestview Mobile
Home Park concerning Site# 1: Goble Drive. Their comments dealt with concerns about
noise and security related to potential commercial development of the site. Comments
were also received from several public agencies, including the City of Pittsburg, Delta
Diablo Sanitation District, and Caltrans.
This staff report deals exclusively with the General Plan Amendment request. A separate
report for the subsequent action to rezone the two sites to General Commercial district
designation has been prepared, and this proposed rezoning action was included in the
Negative Declaration of Environmental Significance prepared for this project.
III. PROJECT SETTING
This part of Bay Point is largely developed or developing.
Site#1: Goble Dri e-Located at the southwest corner of Willow Pass Road and Goble
Drive,just north of Highway 4 at the Bay Point exit and Willow Pass on-ramp. The nearly
3 acre site has a triangular shape surrounded on two sides by public roadways. The eastern

portion of the site fronts Coble Drive, a two lane road that leads to an 87-unit mobile home
park, and the western portion fronts Willow Pass Road, a five to six-lane arterial that
provides direct access from Bay Point to Highway 4. The site is mostly flat and barren with
limited vegetation which is almost exclusively non-native grasses and a few shrubs.
Site#2: Evora Road-Located on the southside of Evora Road opposite Pomo Street in Bay
Point proximate to the Highway 4 exit. Evora Road is planned to be a five-lane road,
although it is currently a two lane road with a center turn lane and right and left turns at the
Willow Pass Road intersection. The southside of Evora Road is an undeveloped corridor.
The northside of Evora Road is primarily residential in character comprised of single
family homes with the exception of small Commercial (CO) designation fronting on
Evora Road. The subject site is approximately 2.35 acres and it has an irregular shape
being long in relation to its width. About half of the site is developable due to an upward
slope to the highway and rear of the property toward Willow Pass Road. There is a
relatively flat triangular section that would be suitable for development which is directly
opposite Pomo Street. The site is barren with limited vegetation which is almost
exclusively non-native grasses and a few shrubs.
Photographs of the two sites are provided in Figure 2.
IV. PRIOR USE OF THE SITE
The two sites were acquired in the early 1990's to provide right-of-way for improvements
to State Route 4.
Site#1: Coble Drive is surplus property previously acquired for road improvement projects
and it is owned by Contra Costa County,Public Works Department. The property was
assembled over a number of years in conjunction with the Willow Pass undercrossing and
Highway 4 widening projects.
Site*2: Evora Road is surplus property acquired in 1991-92 by Contra Costa County,
Public Works Department as part of the improvements to the Willow Pass undercrossing
and Highway 4 widening projects.
V. THE EXISTING COUNTY GENERAL PLAN
Sit-e# 1: Coble Drive is currently designated as Single Family Residential-High and Multi
Family Residential-Medium, and the remainder of this site is former public road which
does not have a designation. The General Plan map has not been updated to show the
roadway improvements and realignment of Willow Pass Road and Highway 4 at this
intersection. The site is located within the Bay Point Redevelopment Plan area.

Site#2: Evora Road is currently designated as Single Family Residential-High. The site is
also located within the Bay Point Redevelopment Plan area. The General Plan map has not
been updated to show the road improvements and realignment of Willow Pass Road,Evora
Road, and Highway 4 at this intersection.
See Figure 3 for the current General Plan land use designations on both sites.
VI. ZONING
Site#_1: Goble Drive is currently zoned A-2, which is not consistent with the existing
General Plan, and the remainder of the site is not zoned being former public road.
Site#2: Evora Road is currently zoned A-2, which is not consistent with the existing
General Plan designation.
A separate report has been prepared that addresses the rezoning of these sites to a zoning
district to match the proposed Commercial (CO) land use designation.
See Figure 4 for the current zoning designations on both sites.
VII. GROWTH MANAGEMENT CONSIDERATIONS
The public entities which serve this site are:
Water Contra Costa Water District
Sewer Delta Diablo Sanitation District
Police Sheriffs Department
Local Parks Ambrose Recreation and Parr District
Regional Recreation East Bay Regional Park District
Fire Contra Costa Fire Protection District
Schools Mount Diablo Unified School District
The site is currently within all necessary urban service districts and they have an obligation
to provide service to the site. The General Plan amendment would not cause a violation of
growth management standards.
VIII. POLICY IMPLICATIONS
There are only few policy implications related to changing the land use designations for
these two surplus sites given their relatively small size(less than 3 acres), surrounding land
uses, and the changed setting in Bay Point for each site with the completed roadway
improvements. The fundamental issue relates to the suitability of the two sites to be
redesignated for Commercial use.

Site#1: Goble Drive is now located at a major traffic-light controlled intersection with
Willow Pass Road in close proximity to an exit for Highway 4. Returning the site to
agriculture use is impractical due to its size, location, and surrounding land uses.
Developing the site for residential use is also problematic for the similar reasons: 1)the
small parcel size would yield too few units to be economically feasible; 2)the site is
located too close to a very busy highway on/off ramp; and 3)the parcel's irregular shape
surrounded on two sides by public roadway creates an isolated island that would not be
attractive for residential development. Conversely this vacant site is now considered a
prime location for a commercial use given its improved visibility and closer proximity to
Highway 4. Access and exposure to the site from the above grade highway appears to be
very good. A Commercial (CO) use would seem to be a more suitable land use designation,
rather than the existing Single Family Residential-High and Single Family Residential-
Medium land use designations.
Site 92: Evora Road has a General Plan designation of Single Family Residential-High
(SFT:). Assuming that one-half of the property is usable due to its irregular shape and
relatively steep slope upward toward the highway, about 8 single family units could be
built on this site using the SH designation. Although developing the site for a residential
use is possible, it is considered less than desirable because it would create a very small
residential island that is physically remote from nearest residential neighborhood.
Returning the site to an agricultural use is also impractical due to its size, location, and
surrounding land uses. Given these circumstances redesignating the site to a Commercial
(CO) designation to take advantage of the site's improved access and exposure to the
highway would see to be more suitable.
IX. CITIZEN GROUP ACTIONS TO DATE
On December 9, 1998, the Bay Point Redevelopment Project Area Committee endorsed
Commercial (CO)redesignation for the two sites.
X. RECOMMENDATION
Staff recommends that the two sites be redesignated to Commercial (CO) in the Land Use
Element of the General Plan as shown on Map A.

I. INTRODUCTION
CONTRA COSTA COUNTY AND CONTRA COSTA TRANSPORTATION
AUTHORITY (Applicant and Owner), County File 4RZ993078. The applicant
requests approval of a Rezoning (from Agricultural to Commercial) of two parcels,
2.91 and 2.325 acres, respectively, located near the intersection of State Route 4 and
Willow Pass Road in the Bay Point area. (A-2) (ZA:E-17) (CT:3150)(Assessors
Parcel Numbers 098-230-037, 040, 046, and 047 and an area of former road right-of-
way, currently with out and APN)
11. RECOMMENDATIONS:
A. Accept the environmental documentation prepared for the project as adequate,
adopt the Negative Declaration
B. Adopt a motion providing for a recommendation to the Board of Supervisors to
approve the proposed rezoning of the sites to General Commercial.
III. GENERAL INFORMATION:
A. GENERAL PLAN: General Plan designation for the parcels are Single-Family
Residential-High and Multi-Family Residential-Medium. A General Plan
amendment to Commercial is pending.
B. ZONING: The two sites are zoned Agricultural (A-2).
C. CEOA STATUS: A negative declaration was posted for the project on September
2, 1999. The public review period ended on September 24, 1999.
D. PREVIOUS APPLICATIONS: None
IV. AREA AND SITE DESCRIPTION
The Goble Drive site is located at the southwest comer of Willow Pass Road and
Goble Drive,just north of Highway 4 at the Bay Point exit and Willow Pass on-ramp.
The site is approximately 291 acres and is triangular in shape. The site is adjacent
to public roadways on three sides. Goble Drive is located to the east, Willow Pass
Road is to the north, and State
The Evora Road site is located on the south side of Evora Road opposite Pomo Street.
The subject site is approximately 2.35 acres and it has an irregular shape. Willow
Pass Road is located southeast of the site. The State Route 4 on-ramp is located south
of the site and a vacant scrip of land between State Route 4 and Evora Road is located
to the west of the site. Single-family residences are located north of the site, across
Evora Road. A large portion of the site slopes upward toward the highway, thus only
a portion of the site is suitable for development.
Both sites are vacant, with limited vegetation which is almost exclusively non-native
grasses and a few shrubs.
V. PROPOSAL:
The proposal involved rezoning the sites to a Commercial designation, to be
consistent with the proposed General Plan designation.
VI. AGENCY COMMENTS:
A. Contra Costa County Public Works Department: No comments.
B. Contra Costa County Flood Control and Water Conservation District: No
comments.
C. City of Pittsburg: Staff evaluated the project and finds it to be in conformance
with the City of Pittsburg.
D. Bay Point Municipal Advisory Council and Project Area Committee: In a joint
meeting on December 9, 1998, the MAC and PAC recommended approval of a
General Plan amendment and rezoning to the two sites to a commercial
designation.

VII. STAFF DISCUSSION
A. BACKGROUND: The two sites were acquired in the early 1990"s to provide
right-of-way for improvements to State Route 4, funded by the Contra Costa
Transportation Authority (CCTA). The sites are surplus property previously
acquired for road improvement projects and it is owned by Contra Costa County,
Public Works Department. The property was assembled over a number of years
in conjunction with the Willow Pass undercrossing and Highway 4 widening
projects. The southwestern portion of the site is the former Willow Pass Road
right-of-way.
B. COMNMRCIAL ZONING DESIGNATION: Given the location of the sites with
the close proximity to State Route 4 and Willow Pass Road, the General
Commercial zoning designation is appropriate. The sites are located in a
Redevelopment Area. Since the sites are close to the highway, there is potential
for development which could be a catalyst for future development along Willow
Pass Road, within the redevelopment area. Any future development of the sites
would require additional public reviews for the development plans. Possible uses
include those associated with commercial activity, including restaurants, hotel,
retail uses, medical offices. In addition, land use permits may also be required,
depending on the type of proposal. Uses such as hotels and restaurants would
require a land use permit. At this time, no specific proposal is pending.
C. BAY POINT MAC/PAC: On December 3, 1998, a subcommittee of the Bay
Point MAC and PAC met with County and CCTA staff to discuss the appropriate
land uses designation(s) for the properties. The Subcommittee members agreed
that the most appropriate designations for these two parcels would be
Commercial. In a joint meeting on December 9, 1998, the MAC and PAC
recommended approval of a General Plan amendment and rezoning to the two
sites to a commercial designation.
VIII. CONCLUSION:
Staff recommends the East County Regional Planning Commission recommend
approval of the rezoning to the Board of Supervisors.
IX: FINDINGS
1. The change will substantially comply with the general plan. A general plan
amendment to commercial is pending for the two sites. The general commercial
zoning designation is complies with the commercial general plan designation. In

addition, the zoning designation is complies with other goals and policies identified
in the general plan.
2. The uses authorized or proposed in the land use district are compatible within the
district and to uses authorized in adjacent district. Currently, there is no proposed
use for the site. Any future use proposed for the site must be compatible with the
general commercial zoning district, if the specific use is to be authorized.
3. Community need has been demonstrated for the use prdposed, but this does not
require demonstration of fixture financial success. The sites are located in a
Redevelopment Area. Since the sites are close to the highway, there is potential for
development which could be a catalyst for future development within the
redevelopment area.

this is to advise you that the Community Development Department of Contra Costa County
has prepared an initial study on the following project:

as Figure 1. They are requesting that the two parcels be redesignated from Single Family
Residential-High and Multi-Family Residential-Medium to a Commercial land use designation.
The two parcels were acquired in the early 1990's by the Contra Costa County Public Works
Department to provide for right-of-way for improvements to Willow Pass Road involving a
realignment and new undercrossing for State Route 4. Prior to acquisition by the Contra Costa
County Public Works Department, the two parcels each had a residential land use designation
under the County General Plan. The now vacant parcels are no longer needed for the roadway
improvements as originally intended and are now considered as surplus right-of-way. The
proposed action sought by the County Public Works Department is to amend the Land Use
Element in the General Plan to redesignate each parcel as Commercial (CO) and to rezone each
parcel to a General Commercial District.
The proposed project will not result in any significant impacts. A copy of the negative
declaration and all documents referenced in the negative declaration may be reviewed in the
offices of the Community Development Department, and Application and Permit Center at
the McBrien Administration Building, North Wing, Second Floor, 651 Pine Street, Martinez,
CA, during normal business hours.

The Board of Supervisors of Contra Costa County RESOLVES that:
There is filed with this Board and its Clerk a copy of Resolution No.35-1999 adopted by the
East County Regional Planning Commission which discusses the Evora Road/Goble Drive General
Plan Amendment and Rezoning (County File#GP97-0010 and#RZ99-3078).
On Tuesday, April 18, 2000 the Board held a public hearing on said General Plan
Amendment discussed by the East County Regional Planning Commission,Resolution No. 35-1999.
Notice of said hearing was duly given in the manner required by law. The Board at a hearing,called
for testimony of all persons interested in this matter.
On Tuesday, April 18, 1999, the Board APPROVED the General Plan Amendment and
Rezoning, and directed that the Evora Road/Goble Drive General Plan Amendment, and map
changes as attached, be APPROVED as the first consolidated General Plan Amendment for 2000
as allowed by State Planning Law.
