RELEASE AND INDEMNIFICATION
1,Keith E. Karam, declare the following:
a. I am the owner of a parcel of land located at 430 Livorna Road,Alamo, California, shown as Parcel C on
the parcel map of Subdivision MS 94-90,filed September 19, 1996,in Book 169 of parcel maps at page 48(the"Property').
b. We have obtained a permit to construct a pool in a restricted development area(development rights grant
deeded to Contra Costa County,recorded September 16, 1998, Series 98-0224310-00).
C. In consideration of, and as a condition to, the granting of the permit referred to in subparagraph(b)above,
I agree to construct said pool in accordance with the building permit.
d. In further consideration of the granting of said permit,I hereby release the County of Contra Costa,including
the Public Works Department and the Flood Control District,respective officers,agents and employees from any claim,cost,
or liability arising out of or in connection with any damage to the site improvements resulting from allowing permission for
construction in the restricted development area.
e. In further consideration of the granting of said permit to construct,I hereby agree to defend,indemnify and
hold said County, including the Public Warks Department and the Flood Control District,respective officers, agents and
employees harmless from any claims,costs,demands,expenses or liability,including,without limitation, all consequential
damages arising out of or in connection with any damage to the site improvements resulting from allowing permission for
construction in the restricted development area.
f. This Agreement is an instrument affecting the title or possession of the real property deseribed above, and
shall be binding on and inure to the benefit of all our heirs, successors,and assigns.
