Barry, AICP Costa Community Development Director County DATE: April 18, 2000 SUBJECT: CONSIDER RATIFYING THE DETERMINATION OF THE COMMUNITY DEVELOPMENT DIRECTOR REGARDING RELOCATION OF TWELVE HOMES FROM THE LEVEE ON BETHEL ISLAND SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS RATIFY the determination of the Community Development Director that the movement of 12 homes from within the Bethel Island Hazard Mitigation Plan (HMP) profile to a location on the same property is not subject to design review under Section 82-10.002 of the County Code. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS The Bethel Island Municipal Improvement District has secured limited funds with which it hopes to assist owners of 12 homes built within the levee geometry profile to remove or relocate the homes consistent with the HMP. In reviewing the 12 structures included in Attachment 1 to the letter from the Director to the District on March 27, 2040, the Community Development Director determined that application to relocate these residences would not constitute an application for occupancy of a substandard lot by a residence within the meaning of Section 82-10.002 of the County Code. Accordingly, such units would not be required to go through the "small lot review, process under the conditions specified in the March 27, 2400 letter. In order to allay any concerns the District or residents may have, the Director recommends that the Board of Supervisors ratify this decision. CONTINUED ON ATTACHMENT: ✓ YES SIGNATURES . The Board finds and determines that the foregoing recitals are true and correct. Section 2. This declaration is made solely for purposes of establishing compliance with the requirements of Section 1.150-2 of the Treasury Regulations. This declaration does not bind the Issuer to mare any expenditure, incur any indebtedness, or proceed with the Project. Section 3. The Issuer hereby declares its official intent to use proceeds of indebtedness to reimburse itself and the District for Reimbursement Expenditures. Section 4. This declaration shall take effect from and after its adoption.
