Box 244 Bethel Island, CA 94511-0244 Dear Mr. Gearhart: This letter confirms my discussion of March 23, 2000 with Supervisor Canciamilla and BIMID representatives concerning the Community Development Department's approach to assisting the District and Bethel Island residents in achieving the Districts Hazard Mitigation Plan (HMP) levee geometry standard. The District has identified 12 residences which are built within the HMP profile, preventing the district from achieving the standard. The district has been awarded limited grant funding with which it desires to work with property owners to remove the encroaching structures. In order to inform the owners of the county requirements for moving or replacing the structures, the district requested that I provide an opinion on what the owners would be obligated to do in terms of permitting under various circumstances. The twelve properties in question are listed on Attachment 1. Each of these properties is zoned F�-1 Water Recreational District. This district requires a minimum lot size of 6,000 square feet and an average width of 60 feet. Section 82- 10.002 of the County Code requires an application for a residential building permit on a property which is substandard with respect to lot size or average width to be reviewed for compatibility with the surrounding neighborhood, and all property owners within 300 feet of the subject property given the opportunity to request a public hearing on the matter. This is commonly referred to as a "Small Lot Review". It is my administrative determination that the "Small Lot Review" would not be required in connection with these twelve properties under the following circumstances: Office Hours Monday- Friday: 8:00 a.m. -5:00 p.m. Office is closed the 1 st, 3rd & 5th Fridays of each month Mr. Bill Gearhart Hazard Mitigation Plan March 27, 2000 Page Two 1. The property owner determines to move an existing structure from within the HMP profile to a location on the same property which is outside the profile 2. The new location complies with applicable criteria for setback, side-yard and height requirements of the F-1 Zoning District In the event that the owner elects to add to the structure (exclusive of elevating it for floodplain management purposes), or decides to demolish the structure and rebuild outside the HMP profile, the "Small Lot Review" would apply. I intend to request the Board of Supervisors to ratify this administrative determination and will provide your District Secretary with notice of the date and time once I have place the matter on the Board Agenda.
