BACKGROUNDIREASONS FOR RECOMMENDATIONS: On March 14, 1996, a complaint was received regarding an accumulation of junk and debris and vehicles being stored on the property. A site inspection was conducted and the inspection revealed the following violations of the county ordinance: Title 7 Chapter 712-4.002, U.H.C. 1001 (Substandard dwellings) Title 8.Chapter 88-4.206 (Junkyard conditions) Title 8 Chapter 84-68.1404 (Occupied trailers/storage of trailers) The property was posted on May 6, 1997 for abatement and the property owner was allowed to obtain permits to repair the dwellings. The permits were expired due to lack of activity. The owner of the property has been notified of the violation(s)through written correspondence and certified mail. As of this date, compliance has not been gained. On November 30, 1999,the Building Inspection Department declared the property a public nuisance and pasted a Notice Order to Abate under Title 1,Chapter 14-6. This appeal is being made under the provisions of this title. The public hearing on this matter was opened on February 8, 2000, at that time, the hearing was continued to April 11, 2000 at 9:00 a.m. in the Board's Chambers. Anderson as Trustee of the Oscar D.Anderson Trust, signed a Charitable gift Transfer Agreement along with a Gift Transfer Deed to Shiloh Resources Ministries, Inc.on property they owned at 2416-2426 Olympic Blvd., Walnut Creek, CA. Shiloh will record this deed upon the completion of the two following events:the removal of the last remaining tenants at 2416 Olympic Blvd. (eviction court date set for February 25") and an environmental Phase I Report. Unfortunately, due to the past and present occupants on the site we have not been able to complete this inspection and can not until the removal of the last tenant. We anticipate minor environmental conditions but need to be assured that a major condition such as an underground storage gas tank leak, etc. has not occurred. Barring no major environmental problem on the site, we will complete this Gift Transfer. Mr. Anderson's wishes his donated property will benefit those In need in some way and feels our Idea of providing housing for seniors would be a good use. To that end, Shiloh is looking at two possible plans: 1. To renovate the existing three houses to provide housing for senior citizens. 2. Joint venture with an outside group to build new senior housing (possible assisted living units). An architectural firm has already started a study in this regard. What we are asking of the Board of Supervisors is a little time, (90 days), to formulate a final plan. Within 30 days we will have complete control and access of the property. We can then bring our building consultants and architect to the property for a closer look in determining the best way of accomplishing our goals. In the mean time we will honor the county's wishes to keep the property clean of trash and debris and prevent any further occupancies of the vacated houses. To date (Dec le-Feb 5'")we have accomplished the following: 1. Removed 3 large 25'-55`trailers from premises. 2. Removed 14 loads of trash[Junk with bob tall/flat bed trucks 3. Removed 3 loads(Flathed truck) of scrape iron/metal including 10 refrigerators- one additional load will be removed this week. 4. Fencing has been installed to separate last remaining occupants from vacated two houses as well as driveway entrances. 5. The two houses have been boarded with plywood and posted. 6. Two evictions have been completed as of Feb 4, 2000 (one eviction was for illegal trailer on premises). It has been very difficult for much progress to occur in the clean up until the removal of the 2428 Olympic Blvd tenants which occurred last Friday. It seemed that as soon as we hauled trash away, the tenants would dump an equal amount. We decided to wait until their eviction. Much has been accomplished just from this last weekend with more clean up planned. We feel under the circumstances that the Board should grant our request of 90 days for our own feasibility study as to how this property may best serve Shiloh and the community. Our promise during the 90 days will be to maintain and improve on the clean up as well as securing the properties from further occupancy. Thank you for your consideration on our request. Andersen, individually and as Trustee of The Oscar D. Anderson Trust, dated March 13, 1995, 620 Peony Drive, #2, Grand Junction, Colorado 81503 ("Donor") and Shiloh Resources Ministries, Inc., Post Office Box 1112, Richmond,California 94802 ("Shiloh"), regarding real property which is commonly known as 2424 Olympic Boulevard, Walnut Creek, California ("Deal Property"). 1. Gift. The Donor hereby agrees to give the Real Properly to Shiloh, subject to the conditions expressly contained in this Agreement. 2. Use of the Real Property. Donor and Shiloh agree that the Real Property shall be used to enable or to provide housing for low income senior citizens and for other needy men,women, and children or for the staff of Shiloh or Bay Area Rescue Mission. 3. Donor's Warranty of Authority. The donor hereby warrants that it is the record owner of the Real Property, and that it has the power and authority to effectuate the transfer. 4. Shiloh's Warranty of Authority. Shiloh hereby warrants that it is a duly organized and qualified non-profit corporation under Internal Revenue Code 501 (c)(3). 5. Permits. Donor grants to Shiloh the right to investigate and to obtain all permits necessary to effectuate the use of the Real Property set forth in paragraph 2, above, prior to the completion of the gift and the recordation of the Gift Transfer Deed. 6. Inspection. The Donor grants to Shiloh the right to enter the Real Property and to conduct any investigation which Shiloh deems necessary in making its decision to accept the gift. This inspection shall include, but is not limited to, an inspection as to hazardous conditions and environmental testing for the purpose of determining whether environmental hazards or toxic wastes exist on or under the Real Property. 7. Re,soonsibility for Costs. Shiloh shall be responsible for costs of keeping the Real Property clean as mandated by the County of Contra Costa during Page 1 of 3 the inspection and permit period and for payment of title insurance, liability insurance, escrow costs, real property taxes, upon closing as conditions of the gift transfer. Escrow has been opened with Fidelity National Title Insurance Company, 3100 Oak Road, Suite 100, Walnut Creek, California 94596, Escrow No.: 221021. 8. Right to Decline Gift. Shiloh reserves the right to decline acceptance of the gift if, in its sole discretion: the costs associated with acceptance of the gift are inordinately high: the Real Property is environmentally impaired:title to the Real Property is impaired; acceptance of the gift would result in a liability being created or assumed which would attach to Shiloh; or,for any other reason, Shiloh believes that the Real Property would not be a suitable gift for Shiloh to accept. 9. Gift Cormletion Date. The gift shall be completed as of the date that escrow closes and a Gift Transfer Deed, executed concurrently herewith,is recorded in the Office of the Recorder of Contra Costa County, California. 10, Appraisal. Shiloh shall obtain on appraisal of the Real Property, at its sole expense, establishing the value of the gift for the Donor's income tax purposes. The appraisal shall be completed and the results transmitted to the Donor in sufficient time for the Donor to complete its annual income tax return. Shiloh make no representation as to, and does not warrant the results of,the appraisal to be conducted or its sufficiency to withstand audit by the Internal Revenue Service. 11. Ugtaijy, Notwithstanding the obligation to keep the Real Property clean, Shiloh shall not be responsible for any liability arising from or occurring at the Real Property. The Donor shall be responsible for obtaining and maintaining liability insurance to and including the date upon which the gift is accepted, escrow is closed, and the Gift Transfer Deed is actually recorded. 12. Aareement to Cooperate. Each of the parties agrees to cooperate fully with the other and to execute such documents as may be necessary to effectuate the gift and to transfer the Real Property to Shiloh. - 13. Survivorship of Agreement. This Agreement shall survive the incapacity or death of the Donor and is binding upon the Donor, his heirs, assigns, executors, trustees, and other interested persons. Since 1965 the Mission has been helping folks in great need. For 35 years we've provided emer- gency shelter for the homeless, and meals for the hungry,while sharing God's love and hope to those who have lost everything. It's the hope of the Gospel that has been the focal point of the Rescue Mission. It will always be the message of God's love for the poor and desperately needy through the grace and mercy of Jesus that the Bay Area Rescue Mission will share ' in the future. nahOften I've been asked, "Why does the Mission emphasize spiritual matters when Miss 1 n AN mon t�tis�i�rit�lrbctors helping the homeless?" It's a good question and one that I want to address in this letter. Some 18 years ago I was a successful businessman. I owned a consulting company and managed a data process- ing department for a major oil company. However, I was a functional cocaine addict.The last year I worked in the data processing field, I spent two-thirds of my income on drugs. In spite of having a nice apartment, nice clothes, a nice car, and many other nice possessions, I was miserable and very lonely. Most significantly, 18 years ago I hadn't placed my faith in Jesus Christ as my Savior and as a result I lost every- thing. I became homeless and eventually wandered into a Rescue Mission.At the Rescue Mission, I came to realize the emptiness in my heart that led me to drug dependency was nothing more than the absence of a fulfilling and meaningful relationship with God.At the Rescue Mission I placed my faith in Christ. That's why I've stayed involved in Rescue Mission ministry for 17 years. I know, because I have witnessed first hand in my life and in the lives of countless others, that it is God who can set an alcoholic or drug addict free. It's God who brings a sense of purpose and contentment into a life that is so troubled. Dear Friends,this is what we do at the Bay Area Rescue Mission—we are an extension of God's love to the homeless and desperately needy . . . and we want to be an extension of your compassion to folks in great need, too. As Debra and I embark on this challenge to direct the Rescue Mission we want to ask two things of you. First, please remember us in your prayers. F. D. education, inten- sive job skills training, and job placement assistance. The program boasts a 100% success rate in the place- ment of graduates. WomeWs & Family Services Today more than ever before, homeless women are striving to make a better life for themselves and their families. To assist them in accom- plishing this goal, the Bay Area Rescue Mission offers a variety of com- prehensive services including a 12-step Bible-based recovery program, +' classes in parenting and stress management, job skills training to help them transition from welfare to the workforce, medical and chiropractic care, a State-certified satellite school for their children, and referrals to $ appropriate social service agencies.
